JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY
Pentaho Software Subscription with Maintenance
NITYS20RC066
1. Identification of the Requiring and Contracting Activity:
(a) Requiring Activity:
a. Requesting Activity
DFAS-ZTBTB/CL
555 88th Street
Bratenahl, Ohio 44068
XXXXXXXXXXXXX
(b) Contracting Activity
DFAS Columbus
Contract Services Directorate
Building 21, Room 2B218
3990 E. Broad St.
Columbus, Oh 43213-1152
2. Nature or Description of the action being approved:
The purpose of this document is to obtain approval for an exception of the fair opportunity acquisition in accordance with:
FAR 16.505(b)(2)(ii)(A) Orders exceeding $3,500.00, but not exceeding the simplified acquisition threshold.
Competition is limited to the following brand name products: Pentaho software.
The procurement strategy is to issue a request for quote (RFQ) on the NASA Solution for Enterprise-Wide
Procurement (SEWP), and the fair opportunity procedures set up by the SEWP will be followed.
3. A Description of supplies/services required to meet the agency needs (including the estimated value – base and option years)
This procurement is for the renewal of Pentaho Software Subscription.
The software subscription comes standard with one year of maintenance, which requires renewal annually.
Pentaho Data Integration Enterprise Edition Subscription is needed for the production environment while
Pentaho BI Suite Enterprise Edition Subscription - Development & Test are needed for the Development/Test environment.
The estimated cost of this procurement is XXXXXXXX
Period of Performance: 10/1/19 to 9/30/20
4. Identification of the exception to fair opportunity (see FAR 16.505(b)(2)):
General Exceptions used as DFAS for the fair opportunity process:
(a) Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies ordered are unique or highly specialized.
(b) The order must be issued on a sole source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under contract, provided that all awardees were given a fair opportunity to be considered to the original order.
(a) Reason that this is sole source/brand name procurement (i.e., proposed contractor's unique qualifications, etc.):
This request is for the acquisition of maintenance for the software application, Pentaho. Pentaho is a commercial software product that is used to extract, translate and load data. Retirement and Annuitant Pay
(R&A Pay) – JFB uses Pentaho to support Defense Retiree and Annuitant System (DRAS) production payroll applications. The Defense MilPay Office (DMO) – ZTB uses Pentaho software to support Business
Intelligence (BI) COGNOS reporting. Although it is possible to change to a different software product, it would take more than a year to re-train employees and make all the necessary software changes to transition from Pentaho to an alternate tool. In order to continue to use Pentaho, DFAS must renew the Pentaho licenses at the beginning of each fiscal year. Retaining the Pentaho software subscription is the most reasonable and cost effective alternative at this time.
5. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
Pentaho software license costs have remained relatively static over the 10 years we have used the product.
There have been small increased in the cost per unit, which is expected. Overall cost has gone up because we have increased the number of licenses over time. Each year, we compare the new quote to the previous quote to ensure that proposed costs are in line with government expectations. The annual DFAS operating budget includes funds each year to renew Pentaho.
6. Any other facts supporting the justification: None
7. A Statement of actions, if any, the agency may take or remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made:
Hitachi Vantara is the sole manufacturer and provider of the product/service and XXXXXXXX is a trusted authorized distributor. We work with both each year to obtain a new quote for the next fiscal year.
