REFERENCES:
In accordance with FAR 8.405-6(b)(1), Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer. A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer. Brand name specifications shall not be used unless the particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs.
DFAR 208.7402 – Departments and agencies shall fulfill requirements for commercial software and related services, such as software maintenance, in accordance with the DoD
Enterprise Software Initiative (ESI) (see website at http://www.esi.mil/). ESI promotes the use of enterprise software agreements (ESAs) with contractors that allow DoD to obtain favorable terms and pricing for commercial software and related services. ESI does not dictate the products or services to be acquired.

2.NATURE OR DESCRIPTION OF THE ACTION:

http://www.esi.mil/
The procurement strategy is to issue a Request for Quote (RFQ) through Department of Defense
(DoD) Enterprise Software Initiative (ESI) in accordance with DFARS 208.7402.
3. DESCRIPTION OF SUPPLIES/SERVICE:
Adobe LiveCycle and its associated component Oracle Policy Modelling (OPM) and Oracle
Policy Automation (OPA) is XXXXXXXXXXXXXX used by the XXXXXXXXXXX organization that provides completeXXXXX work area automation solutions. The proposed acquisition extends the use of AEM Forms technology in DFAS to allow for new customers to be supported, and existing customer’s solutions to be sustained XXXX. The proposed licenses are required because they provide a complex, integrated set of tools and capabilities which make it possible to tie into the existing Oracle tools, and greatly leverage the existing investment in both technologies. By so doing, this solicitation ensures continuity of operations for XX, and that XX will be able to continue to support the existing and planned solutions in sustainment.
The current need for AEM licenses follows an acquisition tool from XXXXXXXXXXXX.
Initially in XXXXX when the procurement for Adobe Licenses were being established various contracts were setup in which XX licenses were procured. Currently XXXXXXX in which this procurement fullfills the need for the XXXXX additional licenses. The established period of performance is based upon aligning XXXXXXXXX licenses with the already established contract so that in the future the Adobe contracts can be combined into one effort.

4. PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS
As part of its continuous software process improvement and standardization program, Defense
Finance and Accounting Service (DFAS) set a standard of XXXXXXX XXXXXXX technology and tools for our agency in XXXXX.
The proposed acquisition extends the use of AEM Forms technology in DFAS to allow for new customers to be supported, and existing customer’s solutions to be sustained by LT. The proposed licenses are required because they provide a complex, integrated set of tools and capabilities which make it possible to tie into the existing XXXXX tools, and greatly leverage the existing investment in both technologies.
Adobe supports extension capability of existing applications that will extend capacity, there is no other alternative product that will support this continued development process.
5. DETERMINATION OF BEST VALUE
Based on an RFQ issued against DoD ESI Contract Vehicles, it is anticipated the pricing will be fair and reasonable, as determined under the terms and conditions of the RFQ to be submitted to all DoD ESI vendors. The expectation is to directly solicit the sole authorized reseller
(XXXXXX) and obtain additional discounts from the DoD ESI price lists, where pricing has already been determined to be fair and reasonable.
FAR 8.404(d) states that “By placing an order against a schedule contract using procedures at
FAR 8.405, the ordering activity has concluded that the order represents the best value and results in the lowest cost alternative to meet the Government’s needs.” Based on the justification to continue with its current software/hardware solution/configuration, market research conducted via both open market and DoD ESI, and by utilizing the streamlined procedures under FAR Part 8, DFAS has determined that the RFQ will result in an order that represents the best value to the
Government at the lowest potential cost.
These products/services are available from one or multiple authorized resellers. Based on market research, it is anticipated that ESI pricing will be lower than open market pricing.
Leveraging DFAS’ current use of the Vendor/Manufacturers product and services with the competitive pricing under ESI, and open market price comparison the contracting officer is confident in obtaining the best value for DFAS.
6. DESCRIPTION OF MARKET SURVEY / EFFORTS TO OBTAIN
COMPETITION
Availability and pricing information was sought from:
o XXXXXXXX o XXXXXXXXXXXX o XXXXXXXXXX
Market research was conducted for the purpose of seeking as many potential sources as possible.
Although Adobe is the sole manufacturer and provider of the product, there are multiple distributors though XXXXXXX is the XXXXXXXXX ESI with the required software/maintenance and support. An RFQ will be provided via email XXXXXXXXX for a quote in accordance with DFARS 208.7402. Though competition is limited on ESI market research has shown the XXXXXXXXXXX reasonable and comparable to the XXXXX products available in a competitive environment via GSA.
