1 L L‐1.4 non‐disclosure agreement Question 1: a. Will the government initiate the process of securing an NDA with the firms identified in paragraph L‐1.4. If so, what is the procedure we are to follow?

a. Offerors are responsible for contacting the firms identified in paragraph L‐1.4 to obtain and complete a NDA.

2 L L‐1.4 non‐disclosure agreement

Question 1: b. If the Offeror(s) are to process NDAs between themselves and the firms identified in paragraph L‐1.4, request the government provide contact information (name, company, email address, phone number) for the assigned individuals within the non‐government agency evaluator organization who is responsible for processing the referenced NDAs.

3 L L‐1.4 non‐disclosure agreement

Question 1: c. The government requires Offeror(s) provide executed NDAs NLT 15 days prior to proposal submission. Assuming there will be no submission extensions, this place an undue burden on the Offeror to coordinate with an outside agency/company, over which they have no influence on the response time, then submit a document to the government. Request the government reconsider this requirement, and require NDAs be submitted with the proposal.

NDAs may be submitted not later than five (5) days prior to the proposal due date. A forthcoming Amendment will incorporate this change.

4 L L‐1.4 non‐disclosure agreement Question 2: Are subcontractors also required to enter into NDAs with the non‐government advisor(s)? If so, should the subcontractor’s NDA be submitted with the Prime Offeror(s), or in a separate posting?

Yes, subcontractors must also enter into NDAs with the non‐ government advisors if they are submitting proprietary information. The subcontractors' NDAs may be submitted with the Prime's NDAs. See Section L, paragraph L‐1.4 instructions for submitting NDAs via email.
