SECTION SF 30 BLOCK 14 CONTINUATION PAGE
SUMMARY OF CHANGES
SECTION SF 1449 - CONTINUATION SHEET
SOLICITATION/CONTRACT FORM
The required response date/time has changed from 28-Nov-2016 11:00 AM to 01-Dec-2016 02:00 PM.
The following have been modified:
52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (OCT 2015)
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) "Remit to" address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.
(i) Availability of requirements documents cited in the solicitation. (1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to--GSA Federal Supply Service Specifications Section, Suite 8100, 470 East L'Enfant Plaza, SW, Washington, DC 20407, Telephone (202) 619-8925, Facsimile (202) 619-8978.

The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “DUNS” or “DUNS +4” followed by the DUNS or DUNS +4 number that identifies the offeror's name and address. The DUNS +4 is the DUNS number plus a 4-character suffix that may be assigned at the discretion of the offeror to establish additional SAM records for identifying alternative Electronic Funds Transfer (EFT) accounts (see FAR Subpart 32.11) for the same concern. If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one. An offeror within the United States may contact Dun and Bradstreet by calling 1-866-705-5711 or via the internet at http://fedgov.dnb.com/webform. This section shall present a clear, concise description of how offerors plan to meet the PWS requirements. This section shall not contain any pricing data.
6. The technical proposal shall specifically address the requirements of the PWS succinctly and in detail. Simply repeating or paraphrasing the requirements as stated in the solicitation document (stating the Offeror can and/or will meet the requirements without a detailed description of how the work will be done), is not acceptable and may cause the Government to reject the proposal as technically unacceptable. Failure to furnish current and complete information requested may cause a proposal to be determined unacceptable.
6. Management Approach (FACTOR 2) Offerors are to set forth a comprehensive management approach that demonstrates the offerors’ capability to satisfy the Government’s requirements.
7. Management approach will be evaluated in accordance with the evaluation criteria listed in the addendum to FAR clause 52.212-2, Evaluation – Commercial Items. In addition, the offeror shall:

Note 2: Résumés shall be limited to three pages per key personnel.
6. Past Performance (FACTOR 3)
8. Offerors shall submit information on no more than three (3) contracts considered most relevant in demonstrating the ability to perform the proposed effort. This information is required on offerors, subcontractors, teaming partners, and/or joint venture partners considered critical to overall successful performance. The contracts can be any combination of projects between the prime contractor and subcontractor(s) to be evaluated for Factor 3 – Past performance. The offeror has the choice to submit past performance as the Prime or Subcontractor.
8. Each relevant contract shall have been performed during the last three (3) years from the final solicitation release date. This includes contracts that were awarded prior to this period, but still had performance during the last three years.
8. Offerors shall submit information on contracts deemed relevant in demonstrating the ability to perform the proposed effort and explain how/why the referenced contracts are relevant to the proposed effort. The Past Performance Questionnaire shall provide a brief history of the contract to include the agency or firm for whom the work was or is being performed, the contract number, the date of award, the period of performance, the contract value, the type of contract (IDIQ, fixed price, cost reimbursable, time and material, etc.), whether the offeror performed as a subcontractor or as a prime, the Point of Contact information (including name, telephone and fax number and the title of a reference who can verify quality of performance on the contracts(s) identified).

8. Contracts listed may include those entered into by Federal Government, agencies of state and local governments, and commercial customers for the same or similar services as described under this RFP. If a firm has no relevant past performance history of the same or similar scope, size, or complexity of this requirement, the proposal must affirmatively state that it possesses no past performance experience of the same or similar scope, size, and complexity.
8. For all contracts submitted the offerors are responsible for having each of their customer POCs complete a Past Performance Questionnaire (Attachment 4). The customer must return the Past Performance Questionnaire directly via email to the Contracting Office as indicated in the questionnaire. All questionnaires are due by 5:00 PM on 7 November 2016. Once complete, PPQs will be treated as source selection information in accordance with FAR Part 3.104.
8. References other than those identified may be contacted by the Government in the evaluation of the firm’s past performance. The Government reserves the right to contact and verify past performance experience with references, and to use any other past performance information available to the firm. 8. Offerors shall provide past performance references to include the following: name, title, agency, telephone, email, contract/order number; contract type; description of work performed, and dollar value. The past performance references information should clearly address relevancy as well as similarity to this PWS. Failure to provide the correct, current telephone and fax number, and/or email address for each point of contact (POC) listed may result in a lower rating for this factor.
6. Price (FACTOR 4)
9. While the Contracting Officer anticipates that pricing for this acquisition will be based on adequate price competition and therefore does not require submission or certification of or pricing data, offerors are cautioned against unbalanced and unrealistic pricing and should reflect a clear understanding of work to be performed, take into account differences in skills, the complexity of various disciplines, and professional job difficulty.
9. Price Reasonableness: These instructions are to assist you in submitting information other than cost or pricing data that is required to evaluate the reasonableness of your proposed price. Compliance with these instructions is mandatory and failure to comply may result in rejection of your proposal. Note that unrealistically low or high-proposed prices, initially or subsequently, may be grounds for eliminating a proposal from competition either on the basis that the offeror does not understand the requirement or has made an unrealistic proposal. Offerors should be sufficiently detailed to demonstrate their reasonableness. The burden of proof for credibility of proposed prices rests with the offeror.
9. Estimating Techniques and Methods. When responding to the Price Volume requirements in the solicitation, the offeror may use any generally accepted estimating technique, including contemporary estimating methods (such as cost-to-cost and cost-to non-Cost Estimating Relationships (CERs), commercially available parametric cost models, in-house developed parametric cost models, etc.) to develop their prices.
9. Cost or Pricing Information Requirements. In accordance with FAR 15.403-1(b) and 15.403-3(a), information other than cost or pricing data may be required to support the price reasonableness. Information shall be provided in accordance with FAR 15.403-5.
9. Offerors shall provide a pricing matrix with the proposed hourly labor rates for each labor category (See Attachment 5 – Schedule of Prices). Offeror shall propose composite Fully-Burdened Fixed Labor Rates (FBFLRs) that are reasonable, realistic, and achievable for the proposed effort. FBFLRs represent the total proposed labor rate including burden and profit and all fringe benefits, on a per-hour basis. Each composite FBFLR should be developed utilizing competitive pricing strategy. FBFLRs shall be rounded to the nearest dollar.
** Note the proposed FBFLRs will be incorporated into the contract as FIXED, maximum FBFLRs ceilings for future task order pricing. Offerors are permitted to propose lower FBFLRs for each individual task order. FBFLRs will establish maximum rates for pricing both prime and subcontractor labor rates (including prime contractor burden/profit) on individual task order proposals.
9. Offerors shall submit pricing for materials using the Excel spreadsheet for Exhibit A-E, RRMC Materials List (See Attachment 6). Material items are brand name or equal, except for the items identified in the attached brand name justification (See Attachment 7 – Brand Name JA Nutanix). Offerors must clearly state if they are submitting an item with equal salient characteristics. The Government will make a determination if the item meets the functionality required during evaluation.
6. The Offeror’s Price Volume shall consist of the following:
7.11.1 Pricing information and supporting data. Offerors shall submit a pricing matrix for labor rates using the information in Attachment 6, Schedule of Prices Worksheet or similar format and Exhibits A-E, RRMC Materials List to submit pricing information. This pricing information will be used as labor rate and material list pricing for task/delivery orders. PLEASE DO NOT ENTER ANY PRICING INFORMATION IN THE SCHEDULE OF THE SF1449. Price ceiling information for the basic contract will be entered at contract award. Task/delivery orders will be issued against the basic contract.
7.11.2 The offeror shall also include a narrative to support the data provided in the Schedule of Prices Worksheet. Include documentation regarding the fully burden rates and how they were derived.
1. Competitive Range Determination
7. If a competitive range determination is necessary, the Government intends to limit the number of contract proposals to only the most highly rated proposals in accordance with FAR 15.306( c )(2).
1. Final Proposal Revisions (FPR)
8. Once discussions, if required, have been concluded, the CO will request that Offerors provide a FPR.
1. Incurring Costs
9. WHS/AD shall not be obligated to pay any cost incurred by the Offeror in the preparation and submission of a proposal in response to the solicitation. The Offeror is advised that the Contracting Officer is the only person who can legally obligate WHS/AD for the expenditure of public funds in connection with this procurement.
1. Amendments to Proposals
10. Amendments to proposals shall be submitted prior to the solicitation closing date as a complete revised proposal and labeled "Revised Proposal." Change pages will not be accepted.
1. Proprietary Information
11. The exclusive responsibility for Source Selection will reside with the Government. Proprietary information submitted in response to this solicitation shall be clearly marked as such and will be protected from unauthorized disclosure as required by Subsection 27 of the Office of Procurement Policy Act as amended (41 U.S.C.423) (hereinafter referred to as "the Act") as implemented in the FAR. Any unmarked proprietary information will be considered releasable under the restrictions of the Freedom of Information Act.
1. Disposition of Unsuccessful Proposals
12. In compliance with FAR Subpart 4.8, the Government will retain one copy of all unsuccessful proposals. Extra copies of unsuccessful proposals will be destroyed. No destruction certificate will be provided.
1. Amendments to the Solicitation

13. Prospective Offerors bear complete responsibility for ensuring that all amendments have been downloaded, reviewed, and complied with in the preparation of the proposal. Furthermore, Offerors are required to acknowledge ALL amendments as a part of their proposal submission.
