To allow the public to view commission proceedings, the Deputy Secretary of Defense directed OMC to provide Closed Circuit Television (CCTV) feed capability from U.S. Naval Station Guantanamo Bay, Cuba (GTMO) to the Continental United States (CONUS). The CONUS locations are Fort Devens, MA; Fort Hamilton, NY; Fort Meade, MD; Joint Base McGuire/Dix/Lakehurst, NJ, and Naval Station Norfolk, VA. The contractor shall provide maintenance, satellite time, repairs, changes, and hearing support for the CCTV equipment located at GTMO and CONUS. See the Performance Work Statement.

The anticipated dates of performance are December 2015 to September 2020, including options;

however, the Government is not required to exercise any options. The places of delivery and acceptance are: Guantanamo Bay, Cuba (GTMO); Fort Devens, MA; Fort Hamilton, NY; Fort Meade, MD; Joint Base McGuire/Dix/Lakehurst, NJ; and Naval Station Norfolk, VA. Delivery shall be FOB Destination.

To better communicate the requirement, a table of Historical Monthly Hours by Labor Category is attached. This demonstrates the range of hours used to satisfy the requirement previously but is not a complusory staffing plan. The historical data is for informative purposes only, offerors must make their own determinations as to how to propose and staff this requirement. The Government does not guarantee this information and, should an awardee who relied on this information disappoint the PWS, then their reliance on the historical information will not insulate them from any remedies the Government pursues to address the contractor’s performance issues.

The provision at 52.212-1, Instructions to Offerors – Commercial (April 2014) and the following supplemental instructions apply to this acquisition. The offeror should also provide:

1. TECHNICAL CAPABILITY: The contractor shall provide a narrative describing their technical capability and management approach to perform the work in the PWS, CCTV Architecture, and Anticipated Workload – Asset List. This narrative shall include descriptions of any relevant personnel, expertise, or subcontractors. The staffing section should demonstrate how the Offeror will ensure personnel coverage during absence of sick and personal leave of employees. Proposals that omit or merely reiterate tasks under the PWS may be rejected.

2. PRICE: the contractor shall provide prices for line items 0001, 1001, 2001, and 0002, 1002, 2002. For line item 0001, the contractor shall provide a monthly price and a total price for the duration of service. In support of these prices, the contractor shall provide a spreadsheet identifying the total labor hours, labor categories, direct costs, indirect costs, subcontract costs, and profit.

For line item 0002, 1002, and 2002 the contractor shall provide one hourly labor rate that will be used for all contractor and subcontractor personnel. This rate shall be weighted per the contractor’s anticipated mix of labor categories and be burdened so as to include all direct costs, indirect costs, and profit. The contractor should not provide a quantity of hours or a total price for this line item as it will be issued on a not-to-exceed basis.

For line items 0003, 1003, and 2003 the contractor should not provide any price information as it will be ordered on a not-to-exceed basis.

For line items 0004, 1004, and 2004 the contractor should not provide any price information as it will be ordered on a not-to-exceed basis.

Pricing information shall not be included anywhere within the other sections.

3. PAST PERFORMANCE: the contractor shall coordinate with their points of contact to provide the past performance questionnaires to the point of contact listed below.

The provision 52.212-2, Evaluation – Commercial Items ( applies to this acquisition.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government anticipates awarding a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The Government may reject all proposals received in response to a solicitation, if doing so is in the best interest of the Government. The following factors shall be used to evaluate offers:

(i) technical capability;

(ii) price;

(iii) past performance

Technical capability will be evaluated by how well the proposal meets the Government requirement. The narrative will be reviewed to assess the likelihood that the offered technical capability, management approach, personnel, expertise, or subcontractors can successfully perform the work in the PWS, CCTV Architecture, and Anticipated Workload – Asset List. Price will be evaluated for reasonableness and realism.

For past performance, the Government will evaluate how well the offeror has performed on contracts that have been determined to be both recent and relevant to the PWS. Performance of each reference must be recent, meaning on-going or completed within the previous three (3) years of the date of this solicitation. The first aspect is to evaluate the offeror’s past performance to determine how relevant a recent effort accomplished by the offeror is to the effort to be acquired through the evaluation. See the attached Definitions table.

The second aspect of the past performance evaluation is to determine how well the contractor is expected to perform on the current effort. The past performance information collected will be evaluated to determine the quality and usefulness as it applies to performance confidence assessment. In conducting a performance confidence assessment, each offeror shall be assigned one of the ratings listed in the attached Definitions table.

The Government may also use other information available from other sources that may include Federal, State and local Government agencies, and electronic databases to evaluate an Offeror’s past performance. Databases such PPIRS, the Past Performance Information Retrieval System or other past performance assessment tools may be used. The Government reserves the right to limit or expand the number of references it decides to contact and to contact references other than those provided by the Offeror.

Note. In the case of an Offeror without a record of relevant past performance or for whom no information on past performance is available, the Offeror will not be evaluated favorably or unfavorably on past performance. In addition, the offeror will have the opportunity to address the adverse past performance, if any is received.

Technical and Past Performance, when combined, are more important than Price. Offers that take exception to any requirement may be deemed to be unacceptable.

(b) Options. The Government shall evaluate the prices for the two option years.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). Therefore, the offeror’s initial proposal should contain the offeror’s best terms from a cost or price and technical standpoint.

The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.

The provision 52.212-3, Offeror Representations and Certifications – Commercial Items (March 2015) applies to this acquisition

The provision 52.212-4, Contract Terms and Conditions – Commercial Items (May 2015), applies to this acquisition.

The provision 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders– Commercial Items (May 2015), applies to this acquisition.
