LIMITED SOURCES JUSTIFICATION
Design, Construction, & Physical Security Analytical Support for
BRAC Program Office (BPO) Washington Headquarters Services (WHS)
JUSTIFICATION
I. Contracting Activity:
Acquisition Directorate (AD) Washington Headquarters Services (WHS) 2521 South Clark Street, Suite 3000 Alexandria, VA 22202
II. Requiring Activity:
BRAC Program Office (BPO) Facilities Services Directorate (FSD) Washington Headquarters Services (WHS) 4800 Mark Center Drive, Suite 08G08 Alexandria, VA 22311
III. Description of Action:
This Limited Sources Justification anticipates the award of a 12-month follow-on task order to the Gilbane Building Company for Design, Construction, & Physical Security Analytical Support to the BRAC Program Office. The task order will be procured in accordance with FAR 8.405-2 (Ordering procedures for services requiring a statement of work), and will be fully funded with Fiscal Year 2012 Operations & Maintenance funds.
IV. Description of Services:
The objective of this requirement is for a follow-on effort of the Design, Construction, & Physical Security Analytical Support for the BRAC Program Office. The support program provides an in-depth analysis of the technical remediation and modification requirements to efficiently and effectively enhance the protection of Department of Defense (DOD) assets and security interests within the Fort Belvoir Mark Center Campus facility.
The support program is also responsible for validating the planning, design and construction management services administered by the United States Army Corps of Engineers (USACE) to ensure all operational, physical security and life safety requirements are executed, as required by the BRAC 133 contractual obligations. The responsibilities of the support program includes, but is not limited to: requirements gathering; program planning; design, cost and schedule analysis; deficiency reports; coordination with building tenants for access into restricted areas; and other support activities as the building owners’ representative.
The Mark Center was designed and constructed for WHS under a contract awarded and administered by USACE.
Since tenant occupancy and use of the Fort Belvoir Mark Center Campus facility, it has become apparent that several operational requirements were not identified or anticipated during the initial design phase. This included the need for dedicated access to telecommunication rooms (TRs) and electrical rooms (ERs), and the application of Americans with Disabilities Act (ADA)-compliant door closures on access/egress to tenant spaces. Additionally, construction of the framing and surrounding walls for the physical security-compliant doors, the fire egress doors, and the exterior entry & egress doors have been found to be inadequate to support the required physical security hardware and door specifications. Substantial latent defects must be addressed. Thus, an unplanned remediation project to address the structural and physical security failures is required to ensure physical security and life safety standards for entry and egress are maintained, and that the security of classified spaces is not compromised. All three activities will ensure classified infrastructure protection, enhance force protection, and life-safety egress requirements are met. USACE is primarily responsible for designing and implementing the changes necessary to enhance physical security at the Mark Center.
The support program will continue to provide WHS security oversight management on behalf of the tenant security managers for any physical construction in secure spaces and oversight of all other construction to ensure physical security requirements are achieved. By providing oversight management support, the program will ensure that the design intent of operational flexibility within the Mark Center Building is achieved, by allowing for easy accreditation or certification of non-secure space at any time in the future.
V. Authority Permitting Use of Limited Sources:
FAR 8.405-6(a)(1)(i)(B) -- Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.
VI. Rationale for Authority Cited:
The period of performance commencement for the contemplated task order will occur during the peak of the operations that this follow-on support requirement needs to address. The amount of time required to procure a competitive award document and to train potential new support personnel will exceed the current period of performance of the United States Army Corps of Engineers (USACE) design-build construction contract that the subject support will monitor. The contracting office administering the current BPO support task order will not be extending the period of performance of the support requirement to mirror the extension of the period of performance for the USACE design-build contract. The USACE design-build contract has been extended beyond the planned project completion date to address numerous latent defects associated with the security features of over 700 doors within the Mark Center. The latent defects of the 700 doors include structural support and security issues with how the doors were framed during initial construction, as well as the failure of the associated door enclosures to meet required American Disabilities Act (ADA) compliance. The contemplated task order will provide Design, Construction, & Physical Security Analytical support to the Government during the period of performance extension of USACE’s design-build contract. The period of performance for the follow-on task order will be from 29 SEPT 2012 to 28 SEPT 2013, with an estimated maximum dollar value of $1,624,147.20.
Gilbane Building Company has been providing the required services to WHS since construction started on the Mark Center. Gilbane has the requisite knowledge of the building and tenant operations to efficiently and effectively perform the services at a reasonable cost to the Government. The services are required for 12-months and will involve intensive coordination with tenant operations as the repairs are performed. Given Gilbane’s prior experience, Gilbane is the only source able to perform the work and to enable USACE to perform the repairs within the requisite time. The Gilbane support staff is already adequately trained to perform the required services, which is essential because this requirement will need the provided support staff to be fully trained and experienced with a working knowledge of the defect issues upon immediate implementation of the task order. Because this task order will become effective during the period of performance of the contract that it will be directly supporting, the cost savings of an adequately trained support staff could not be made up through competition.
VII. Market Research/Efforts to Identify Potential Sources:
Market research concluded that if the current support provider is not used for this requirement, the Government would experience a substantial gap in institutional knowledge, and a duplication of training costs that could not be recovered through competition. Furthermore, by limiting the source of award, the Government attempts to mitigate unacceptable delays that would affect the Design, Construction, & Physical Security Analytical support that this requirement provides.
VIII. Actions to Increase Competition:
This procurement is considered to be a one-time requirement for follow-on work, for support currently being provided through a contract administered by the General Service Administration (GSA). However, if similar support is required for future BPO projects, a comprehensive market research report will be developed to assess the capabilities of the marketplace to determine the appropriate level of competition for the new procurement.
IX. List of Interested Sources:
As described above in Section VIII of this justification, since the required support will be procured via a follow-on task order, additional interested sources were not sought. Any potential interested sources will be notified of the Government’s decision to award the subject procurement on a limited sources basis when this Justification is published in accordance with FAR 8.405-6(a)(2)(i).
X. Other Factors:
The Gilbane Building Company is currently providing the required support services to the BRAC Program Office under GSA BPA No. GST008ACPDL0744, Task Order #0006. The current support task order’s period of performance ends on September 28, 2012.
XI. Determination of Price Reasonableness:
The Contracting Officer will ensure that the Government receives the best value in the direct award to Gilbane Building Company consistent with FAR 8.404(d).
