SECTION SF 30 BLOCK 14 CONTINUATION PAGE

The purpose of this amendment is to (1) provide questions and answers, (2) add one 12-month option period, (3) amend sections L&M to include evaluation of the option period, and (4) extend the proposal receipt date.

SUMMARY OF CHANGES

Questions and answers regarding "Instructions to offerors", section 1.2 page 48 are below:

Question 1: Does the page limit of 20 pages include SF33, Sections B, G or I (where fill-ins are required)?

Answer: No. The page limitation applies to the technical proposal only as delineated in this RFP, Section L, paragraph 2.2.6. The page limitation does not include the SF33 or Sections B through K.

Question 2: Does the requirement for the electronic version of the proposal include the SF33 and Sections B, G, I and K (where fill-ins are required?

Answer: Yes

Question 3: If the answer to question 2 is "yes", may the forms and pages with fill-ins be scanned to a pdf file?

Answer: Yes Question 4: Will MDA consider modifying the OCI provisions of the subject RFP (Clause H-09) to only the key individual providing advisory services and not the entire company that employees the individual?

Answer: No. Clause H-09 ORGANIZATIONAL CONFLICT OF INTEREST (OCI) (MAY 2005) will not be modified. Whether or not to pursue an award under HQ0006-09-R-0004 or some future potential developmental effort resulting from the work coming out of the contract that will be awarded as a result of HQ0006-09-R-0004 is a business decision. As required by the clause, offerors are required to submit an “OCI Analysis/Disclosure Form” with their proposal. Offeror’s may also submit a Mitigation Plan for Government consideration. The Government will review the Plan and notify the contractor of its acceptability. However, there is no guarantee the mitigation plan will be approved.

Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

(End of provision)

The following have been modified:

M-1 EVALUATION CRITERIA

GENERAL BASIS FOR CONTRACT AWARD

1.0 BASIS FOR CONTRACT AWARD

The Government will select the best overall offer(s) using the Evaluation Factors discussed in M.2 of this solicitation. This is a best value source selection conducted in accordance with FAR Part 15 and its supplements.

1.1 NUMBER OF CONTRACTS

The Government intends to award one or more contracts with a one (1) year basic period of performance and a one (1) year option period of performance which may or may not be exercised by the Government.

1.2 ACCEPTABLE PROPOSALS

The Government reserves the right to consider acceptable only those proposals submitted in accordance with all instructions set forth or referenced in this solicitation. A proposal that omits material elements required by Section L of the RFP may be dropped from further consideration. Failure to comply with the requirements of laws and regulations set forth in the solicitation may affect eligibility for award. The Government may reject any or all offers if such action is determined to be in the Government’s best interest. The technical proposal is limited to 20 pages. If the technical proposal exceeds 20 pages, only the first 20 pages will be considered.

1.3 CONTRACTOR RESPONSIBILITY

The Offeror must be determined responsible in accordance with FAR Part 9.1.

1.4 DISCUSSIONS

In accordance with FAR 52.215-1, the Government intends to award without discussions (except for clarifications as described in FAR 15.306(a)); therefore, the initial offers should contain the Offeror’s best terms from both a technical and cost perspective. However, the government reserves the right to conduct discussions if the contracting officer later determines them necessary (FAR 52.215-1 ALT 1). If discussions are conducted, the Government will request a final proposal revision. Offerors are advised that, if final proposal revisions are requested, unsupported changes may result in a lower overall proposal evaluation, and an otherwise acceptable proposal could be placed in jeopardy.

1.5 CLARIFICATIONS

Proposal clarification requests may be issued that encompass any and all aspects of the evaluation process as may be deemed necessary by the Government to fully understand and evaluate the merits of the proposals submitted.

M.2 EVALUATION

2.0 EVALUATION FACTORS, RELATIVE ORDER OF IMPORTANCE, AND REVIEW PROCEDURES

2.1 EVALUATION FACTORS AND THEIR RELATIVE ORDER OF IMPORTANCE

Offerors will be evaluated according to the following factors and sub-factors.

Pass/Fail: Contractor must have a Top Secret Sensitive Compartmented Information security clearance to be eligible for award.

Factor 1: Capabilities and Understanding

a. Working knowledge of ballistic missile threats and countermeasures

b. Working knowledge of ballistic missile defense systems and technologies

c. Understanding of modern space systems RDT&E, deployment, operations and costs

Factor 2: Technical

a. Experience in space systems development

b. PhD in a related science or engineering field

Factor 1 and 2 are equal in importance.

Both evaluation factors, when combined, are significantly more important than cost or price

2.2 DESCRIPTION OF REVIEW PROCEDURES

a. Rating System

Exceptional – Demonstrates a full understanding of the Statement of Work (SOW) requirements, proposes personnel for conducting the study with more than 20 years of relevant experience, and who possesses a PhD in a related science or engineering discipline.

Acceptable - Demonstrates less than full, but adequate, understanding of the SOW, proposes personnel for conducting the study with at least 20 years of relevant experience, and who possesses a PhD in a related technical discipline.

Unacceptable – Offeror does not demonstrate an understanding of the SOW requirements and the offeror does not possess adequate experience or education requirements.

b. Cost

It is anticipated that there will be adequate price competition. Therefore, price will be determined fair and reasonable based on adequate price competition in accordance with FAR 15.403-1( c)( 1). For evaluation purposes the Government will use an estimated level of 1000 hours each for CLINs 0001 and 0101. To arrive at a total estimated contract value for CLINs 0001 and 0101 the Government will multiply the offeror’s loaded labor rate times 1000 hours for each CLIN. Evaluation of this proposal is inclusive of the option.

c. Award will be made to the offeror(s) whose proposal represents the best value to the Government.
