SCOPE OF WORK

1. GENERAL

The Township of Hopewell (“Township”) seeks bids for brush grinding, processing, removal and disposal services for an initial contract term of two (2) years, with an option, at the sole discretion of the Township, to extend the contract for one additional two (2) year period, or two additional, one (1) year periods, to the extent permitted by N.J.S.A.

40A:11-15.

Any extension shall be subject to satisfactory vendor performance, mutual agreement as to pricing where required by law, availability and appropriation of funds, and all applicable provisions of the New Jersey Local Public Contracts Law.

The Township makes no representation or guarantee regarding the minimum or maximum quantity of material that will require processing during any contract year. All quantities provided in these specifications are estimates and historical information only.

2. LOCATION OF WORK

All work shall be performed at the Township of Hopewell Public Works Debris Management Area located at:

201 Washington Crossing-Pennington Road

Hopewell Township, New Jersey

The brush processing area is located at the existing leaf compost/debris management facility on the north side of the

Municipal Athletic Complex and is accessed from the second driveway on Scotch Road north of Washington Crossing-

Pennington Road.

3. TOWNSHIP RESPONSIBILITIES

The Township shall:

1. Collect brush and vegetative debris generated or collected by the Township and deliver the material to the designated processing site.

2. Stockpile the material at the site pending processing.

3. Measure the quantity of unprocessed brush in cubic yards (CY) for purposes of payment.

4. Provide reasonable access to the site for the successful bidder's personnel and equipment.

5. Designate the dates upon which grinding operations are to commence.

Prior to each scheduled grinding operation, the Director of Public Works or designee and a representative of the successful bidder shall meet at the site and review the quantity of material to be processed.

The Township's determination of the quantity of unprocessed brush, expressed in cubic yards, shall be documented prior to commencement of grinding.

4. ANTICIPATED WORK SCHEDULE

The Township presently anticipates conducting brush grinding operations approximately two times per calendar year.

Grinding operations are anticipated to commence:

• On or about June 15 of each year; and

• On or about November 15 of each year.

These dates are estimates only.

The actual commencement date for each grinding operation shall be established by the Director of Public Works or his/her designee.

The Township reserves the right to modify, postpone, cancel or add grinding events based upon the quantity of material accumulated, weather conditions, storm events, operational requirements, emergencies or other circumstances.

The successful bidder shall commence operations on the date directed by the Township.

5. GRINDING AND PROCESSING REQUIREMENTS

The successful bidder shall furnish all labor, supervision, equipment, machinery, transportation, fuel, lubricants, tools and other materials necessary to perform the work.

The successful bidder shall:

1. Grind and process all brush, logs, limbs, stumps and other acceptable vegetative material designated by the

Township.

2. Furnish a commercial-grade tub grinder, horizontal grinder or equivalent equipment of sufficient size and capacity to perform the work efficiently.

3. Furnish excavators, loaders or other equipment of sufficient size to safely load brush, logs and other material into the grinder.

4. Furnish all trucks and transportation equipment necessary to remove processed material from the site.

5. Process all designated material unless otherwise directed by the Director of Public Works.

6. Complete each scheduled grinding operation within seven (7) calendar days following commencement of grinding unless an extension is authorized by the Director of Public Works.

7. Remove all ground material required to be removed under the contract within seven (7) calendar days following completion of grinding operations.

8. Remove stumps and other materials designated for removal by the Township.

9. Maintain the site in a safe, orderly and workmanlike condition throughout the operation.

10. Restore areas disturbed by the vendor's equipment, including the correction of excessive ruts, tire tracks and similar damage caused by the grinding and removal operation.

6. EQUIPMENT CAPACITY

The grinder furnished by the successful bidder shall be appropriately sized for the volume and nature of material anticipated under this contract.

The grinding operation shall be capable of producing approximately 25 to 100 tons of processed wood material per hour, depending upon the type, size, moisture content and condition of the incoming material.

The stated production range is intended to establish the minimum commercial capacity of the equipment and shall not constitute a guarantee by the Township concerning actual hourly production.

7. EQUIPMENT LIST

Each bidder shall submit with its bid a list identifying the principal equipment proposed for use under the contract, including, as applicable:

• Grinder(s);

• Excavator(s);

• Front-end loader(s);

• Material handler(s);

• Transport vehicles;

• Tractor trailers;

• Dump trucks; and

• Other major equipment proposed for performance of the work.

The Township reserves the right to require replacement or supplemental equipment when, in the reasonable judgment of the Director of Public Works, the equipment being utilized is inadequate to complete the work within the required period.

8. REMOVAL AND DISPOSAL OF PROCESSED MATERIAL

Except for material specifically retained by the Township pursuant to the optional triple-ground mulch provision, all ground and processed material shall become the responsibility of the successful bidder and shall be removed from

Township property.

The successful bidder shall be solely responsible for:

1. Loading;

2. Transportation;

3. Hauling;

4. Disposal or beneficial reuse; and

5. All costs associated with removal and lawful disposition of the material.

All material shall be transported, processed, recycled, reused or disposed of at facilities or locations authorized to receive such material and in accordance with all applicable federal, State, county and local laws, regulations and permit requirements.

No processed material may be dumped, deposited or disposed of at an unauthorized location.

Upon request, the successful bidder shall provide the Township with documentation identifying the destination of material removed from the site.

9. OPTIONAL TRIPLE-GROUND MULCH

At the direction of the Township, the successful bidder shall process and leave at the Township site approximately 200 cubic yards per year of triple-ground mulch for Township use.

The actual quantity shall be determined by the Director of Public Works.

The Township shall pay for triple grinding in accordance with the applicable unit price contained in the Schedule of

Prices.

The Township does not guarantee that it will order any minimum quantity of triple-ground mulch.

All mulch not specifically directed to remain at the site shall be removed by the successful bidder as part of the base grinding and removal operation.

10. SITE MAINTENANCE AND CLEANUP

The successful bidder shall be responsible for maintaining those portions of the site affected by its operations.

The vendor shall:

1. Prevent unreasonable tracking of mud, sediment, wood debris and other material onto Township or public roadways.

2. Promptly clean material tracked or deposited as a result of its operations.

3. Maintain safe access through the work area.

4. Remove debris generated by its activities.

5. Repair or grade excessive ruts and tire tracks caused by its equipment.

6. Leave the work area in a neat and orderly condition upon completion.

Any damage to Township property resulting from negligent operation of the vendor's equipment shall be repaired by the successful bidder at no additional cost to the Township.

Unless otherwise authorized by the Director of Public Works, work shall be performed between:

7:00 A.M. and 4:30 P.M., Monday through Friday

The Director of Public Works may authorize alternate or extended working hours when necessary due to weather, emergencies, storm response, operational requirements or other circumstances.

12. MEASUREMENT FOR PAYMENT

Payment for the base grinding and removal service shall be based upon the cubic yards of unprocessed brush measured prior to grinding.

Prior to commencement of each grinding event, representatives of the Township and successful bidder shall inspect the stockpile.

The Township shall determine the estimated volume of material in cubic yards using a reasonable and consistently applied measurement methodology.

The agreed or Township-determined quantity shall be documented prior to processing and shall constitute the quantity used for invoicing.

The successful bidder shall not be entitled to additional payment because the processed material expands, contracts, settles or otherwise differs in volume or weight after grinding.

13. BASIS OF BID

Bidders shall submit a unit price per cubic yard of unprocessed brush for each contract year.

The unit price shall include all costs necessary to complete the work, including but not limited to:
