About this file

This is a Justification for Other Than Full and Open Competition (JOFOC) document for a 9-month sole-source extension of the ACADIA contract (HM0476-19-C-0002) with incumbent contractor Peraton, supporting the National Geospatial-Intelligence Agency (NGA).

The extension includes a 6-month base period (December 1, 2024 - May 31, 2025) and 3-month option period (June 1, 2025 - August 31, 2025) to ensure continuity of Test and Evaluation services while the follow-on ACADIA II contract is competed and awarded. The services include image quality and utility assurance, data quality standards production/maintenance, technical support for enterprise verification testing, and automated test tool development in cloud/DevOps environments. The justification cites FAR 6.302-1 authority due to Peraton's specialized expertise in areas like Configuration Management, Cloud Engineering, GEOINT testing, and access to hard-to-fill positions like Photogrammetrists and Image Scientists. The ACADIA II RFP was released October 4, 2024 with proposals due November 7, 2024, and award expected in Q3 FY2025. A synopsis posted on SAM.gov October 1, 2024 received no capability statements from other interested companies.

JUSTIFICATION

FOR OTHER THAN FULL AND OPEN COMPETITION

PURSUANT TO FAR 6.303

FAR 6.3 Justification for Other Than Full and Open Competition, v6.0, 09/10/2024 1 | P a g e

UNCLASSIFIED

CONTROL NUMBER:

1. IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY.

National Geospatial-Intelligence Agency (NGA) / Office of Contract Services (OCS)

2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED.

The requires the award of a 9-month sole-source extension (a 6-month period of performance plus a 3-month option period) to the Acadia contract, HM0476-19-C-0002, for the incumbent contractor (Peraton) to ensure continuity of mission critical services during the competition and transition (if required) of the follow-on contract (ACADIA II).

3. ESTIMATED VALUE AND PERIOD OF PERFORMANCE OR PROJECTED DELIVERY SCHEDULE.

a. ESTIMATED VALUE ($M): $

b. PERIOD OF PERFORMANCE, INCLUDING ALL OPTION PERIODS, OR PROJECTED DELIVERY SCHEDULE:

Period 7 (01 December 2024 to 31 May 2025)

Period 8 (01 June 2025 to 31 August 2025)

4. IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION.

The statutory authority permitting other than full an open competition is 10 U.S.C. 3204(a)(1) as implemented by FAR 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements."

5. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY S NEEDS.

The ACADIA contract provides Test and Evaluation (T&E) services in the form of image quality and utility assurance services, production and maintenance of data quality standards and scales, technical support and management of an independent enterprise verification testing environment, and development/operation/maintenance of automated test tools in both cloud and DevOps environments.

ervices for ACADIA as well as Software, Hardware, and Travel to support the completion of contract requirements.

6. DEMONSTRATION OF THE PROPOSED CONTRACTOR S UNIQUE QUALIFICATIONS OR THE NATURE OF

THE ACQUISITION THAT REQUIRES USE OF THE AUTHORITY CITED.

This action is justified pursuant to FAR 6.302-1(a)(2)(iii), this is a follow-on contract for the continued provision of highly specialized services and it is likely that award to any other source would result in

substantial duplication of cost or unacceptable delays. The ACADIA contract provides a high-level of specialized support to NGA, with the Contractor possessing experience and expertise in areas such as Configuration Management and Business Process, Software Application and Web Development, Cloud Engineering, Test Tool Development and Automation, DevSecOps and GEOINT Services Testing, GEOINT Product Quality Engineering, GEOINT Product Quality Risk Analysis and Assessment. The Contractor is able to employ and utilize qualified personnel with the appropriate combination of education, training and experience for labor categories that are highly technical, and very difficult to fill such as the Photogrammetrists, Image Scientists as well as Software Developers. The Contractor has been able to ensure the performance of individuals in these highly specialized categories and overall man-hours meet the contract requirements.

It is not possible for any other vendor to provide the necessary support without a transition period. The time needed for any transition, coupled with the time to complete a full and open competition, would result in an unacceptable break in services supporting Acadia functions.

The current vendor and their sub-contractors are the best feasible solution for the Government.

analytic needs and take full advantage of new sensors and advances in technology and tools will be severely impacted. NGA will be unable to develop and modify training on new sensors, tools, techniques, and standards for the National System for Geospatial Intelligence (NSG) and international partners.

The Government cannot afford a gap in service for the testing work performed by the TAC office, especially with imagery validation. The testing enables and ensures the imagery meets the standards for use in analysis. The critical function of imagery validation performed during testing provides more precise imagery, and thereby, improves reporting in the protection of the United States and its Foreign Partners.

The follow-on contract was planned to be awarded by 01 November 2024. However, requirements have requirements. The ACADIA II solicitation was released in early October 2024 and is expected to be awarded by the 3rd quarter of fiscal year 2025.

7. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY

POTENTIAL SOURCES AS IS PRACTICABLE.

A synopsis of this proposed sole source action was posted to the SAM.gov website on 01 October 2024 with responses due by 15 October 2024. Per FAR 5.207(c)(16), interested companies may submit a capabilities statement which shall be considered by NGA. Per DFARS PGI 206.302-1, the result of this synopsis was that NGA did not receive a capability statement from any interested companies.

In collecting market research for the follow-on, ACADIA II, the Government identified other vendors that may be interested and potentially capable of performing a portion of the work identified for the Program. NGA is in the process of a full and open competition for the ACADIA II follow-on contract.

The ACADIA II Request for Proposal (RFP) was released on 04 October 2024, with proposals due no later than 07 November 2024.

8. CONTRACTING OFFICER DETERMINATION THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL

BE FAIR AND REASONABLE.

Before award of the contract extension, the Contracting Officer will determine a fair and reasonable price for the resulting contract action. The contractor will provide a technical and cost/price proposal that will undergo the appropriate analysis to ensure the negotiation of an adequate approach to fulfill the requirements at a fair and reasonable price, pursuant to FAR 15.404-1(b)(1).

9. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS OR A STATEMENT OF THE

REASON MARKET RESEARCH WAS NOT CONDUCTED.

Market research for the proposed action was conducted to the extent of the notice of intent publicized to industry, as detailed in Section 7 above, due to unacceptable delays that would occur without the award for continuing ACADIA support beyond 30 November 2024.

A request for Information (RFI) for the follow-on contract, ACADIA II, was posted on the unclassified Acquisition Research Center (ARC) website, to which potential vendors responded. The Government's research found that no other NGA engineering contract satisfied the schedule or technical requirements. Furthermore, no existing, Government-wide acquisitions contracts provided access to vendors with the requisite technical skills to perform NGA's image quality mission. Due to the results of the market research conducted, a full and open competition was determined to be the best strategy for the ACADIA II contract, and a Draft Request for Proposal (RFP) was released on 08 March 2024.

10. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION.
