About this file

This is a Performance Work Statement (PWS) for the Hill Hazardous Waste Disposal Contract (SP4500-27-D-XXXX), a firm-fixed-price, indefinite-delivery/indefinite-quantity (IDIQ) contract with the Defense Logistics Agency (DLA) covering waste management services for Department of Defense installations.

The contract encompasses removal, transportation, and disposal or recycling of various waste streams including Resource Conservation and Recovery Act (RCRA) hazardous wastes, non-RCRA wastes, state-regulated wastes, universal wastes, compressed gases, polychlorinated biphenyls (PCBs), and per- and polyfluoroalkyl substances (PFAS). Service areas include military installations within a 50-mile radius of designated pickup locations, with the Government retaining the right to add new locations at no additional cost. The contract structure consists of one 30-month Base Period followed by one optional 30-month Option Period. Pricing is primarily based on container sizes for containerized wastes and gallons, pounds, or cubic yards for bulk wastes, with a $2,000 minimum charge per task order unless otherwise specified. The contract utilizes a six-character Contract Line Item Number (CLIN) system combining a four-character base CLIN representing waste type with a two-character suffix designating unit of measure.

Key performance requirements include standard removal timeframes of 5 business days for bulk waste and 15 business days for containerized waste, with expedited options available. The Contractor must maintain qualified facilities and transporters from the DLA Qualified Facilities List and Qualified Transporters List, provide Certificates of Disposal/Destruction for regulated wastes (PCBs, PFAS, DEMIL items), and comply with all federal, state, and local environmental regulations. Special services include industrial cleaning, waste analysis and profiling, packaging services, rental equipment (roll-off boxes, vacuum boxes, FRAC tanks), and cylinder management. The Contractor assumes full accountability upon receipt of items, must provide 24-hour emergency response capability, and is responsible for all spill cleanup, atmospheric releases, and regulatory compliance. Acceptable Performance Levels are defined with no more than three occurrences of late performance or five documentation deficiencies permitted during a 12-month period before monetary deductions apply.

The scope includes Resource Conservation and Recovery Act (RCRA) hazardous wastes (HW), non-RCRA wastes, State- Regulated wastes, Universal Wastes (UW), compressed gases, Polychlorinated Biphenyls (PCBs), and Per- and Polyfluoroalkyl Substances (PFAS). The scope of this contract further encompasses special services, including but not limited to waste analysis and waste packaging, to support environmental management programs across Department of Defense (DoD) installations and activities.

b. Service areas include military installations and activities within a 50-mile radius of any designated pickup or special services location. The Government reserves the right to add new locations within the specified region throughout the contract performance period at no additional cost.

SP4500-27-D-XXXX Page 6 of 54

c. The Contractor must provide all services necessary for the transportation, final treatment, disposal, and recycling of the waste items listed in the Price Schedule IAW all local, state, and federal laws and regulations, and the terms of this contract. These services must include providing all necessary personnel, labor, transportation, equipment, and the compilation of all required documentation.

1.2 CONTRACT STRUCTURE AND PRICING

a. This is a firm-fixed price, indefinite delivery/indefinite quantity (IDIQ) contract. It is written as a performance-based contract, which allows the Contracting Officer (KO) to make monetary deductions and/or a negative mark on the Contractor’s Past Performance when an Acceptable Performance Level (APL) is not met. The contract consists of one (1) 30-month Base Period, followed by one (1) 30-month Option Period.

b. Pricing for containerized wastes will primarily be based on container sizes. Pricing for bulk wastes will primarily be based on gallons, pounds, or cubic yards, as applicable. The minimum charge for any single Task Order (TO) is $2,000, unless otherwise specified in the contract.

c. The six-character disposal Contract Line-Item Number (CLIN) consists of a four-character “Base CLIN” representing the waste description and a two-character “CLIN Suffix” designating the unit of measure. Example: Base CLIN “CS01” represents Corrosive Acids, Inorganic other than HF and HNO3, <50% in Water, and the CLIN Suffix “C4” designates the unit of issue as a 55-Gallon Container. Accordingly, one (1) 55-gallon drum of this waste would be represented by ordering one (1) Each of CLIN CS01C4.

d. Certain CLINs, such as those for Demilitarization-required items, AFFF/PFAS, and regulated PCB wastes, require the Contractor to provide a Certificate of Destruction or Disposal (CD). The Contractor must provide a CD when specified in the Price Schedule CLIN description.

1.3 KEY PERFORMANCE REQUIREMENTS AND TIMEFRAMES

a. Standard Removal Times: The standard removal time for containerized waste and bulk waste is identified in Table 5: Standard Performance Times.

b. Business Days: For timekeeping purposes on services, the day a TO is issued constitutes “Day 0,” and the following business day constitutes “Day 1.” A business day is any day normal business is conducted and does not include weekends, federal holidays, or days where installation access is denied.

c. Calendar Days: For timekeeping purposes on equipment rentals, the day of equipment placement constitutes “Day 0,” and the following calendar day constitutes “Day 1.” A calendar day is defined as every day of the calendar year.

2.0 ADMINISTRATIVE AND OPERATIONAL PROCEDURES

SP4500-27-D-XXXX Page 8 of 54

This section outlines the requirements for the removal of wastes under this contract: Preparation & Scheduling (Section 2.1), Waste Collection & Transport (Section 2.2), and Documentation & Verification (Section 2.3). The general safety and personnel requirements applicable to all phases are detailed in Section 1.

2.1 PREPARATION AND SCHEDULING

2.1.1 WASTE DOCUMENTATION AND MARKINGS

The Government agrees that all items placed on a TO on this contract will be accompanied by Generator-supplied initial documentation and markings that comply with all applicable laws and regulations relating to the generation and storage of waste. The Contractor must then use this information as a basis for manifest preparation.

2.1.2 CLIN STRUCTURE AND SELECTION PRINCIPLES

a. CLINs are assigned by the Government and are designed around RCRA regulations and disposal technology standards. The primary considerations for CLIN selection are the waste description, generation process, physical state, and the Government-assigned EPA Waste Codes, if any.

b. DOT regulations, including Proper Shipping Name (PSN) and Hazard Class, are not a basis for CLIN selection.

c. The Government is responsible for assigning a correct profile-based CLIN to every waste stream. The Contractor must adhere to this assignment unless a formal dispute is initiated and resolved per Section 2.1.8.

d. Management of EPA Listed Wastes: While the Order of Precedence in Section 2.1.5 accounts for EPA Listed Wastes (F, K, P, U), the Contractor should be aware that uncommon, listed waste codes may require handling on a case-by-case basis, as determined by the KO.

e. The Price Schedule is a curated subset of all available disposal CLINs, tailored to the specific historical and anticipated needs of the Generator-customer(s) supported by this contract.

2.1.3 DEFINITIONS OF WASTE TYPES

2.1.3.1 BULK WASTE

a. Bulk Waste: Refers to waste that is typically removed via Rolloff box (ROB), vacuum or sludge boxes, dump trucks, tank trucks, vacuum trucks, pump trucks, and trucks with vacuum-loaded or pump-loaded tanker trailers.

SP4500-27-D-XXXX Page 9 of 54

b. Heavy Solids: Refers to bulk waste solids/sludges with a density greater than 600 lbs./yd³. These are ordered using the appropriate bulk CLIN Suffix (B1-B4) based on the net weight of the load as defined in Table 2.

c. Lightweight Solids: Refers to bulk waste solids with a density of less than or equal to 600 lbs./yd³. These are ordered using the Cubic Yard CLIN Suffix (B6). When ordering, the Government pays for disposal of a minimum of 75% of the volumetric capacity of the associated

ROB.

d. Pumpable Liquids: Refers to liquid material which is transferable by conventional pumping devices designed to pump low-viscosity liquids, largely free of suspended or settled

(vs. dissolved) solids, and typically removed via vacuum truck or tanker under CLIN Suffix B5.

When ordering, the Government pays for disposal with a 1,500-gallon (GL) minimum load charge applied. The method for determining the billable volume is as follows:

(1) Calculation from Weight: Gallons may be calculated by dividing the net weight of the liquid by its density as listed on the waste profile sheet. Volumes are rounded to the nearest whole gallon using conventional rounding rules.

(2) Tank Strapping: Volume may be determined by using a graduated strapping rod and a table specifically calibrated to the tank being measured. The Contractor must perform the measurement, which must be verified and agreed upon by the Government representative. The tanker must be on a level surface for the measurement to be valid.

(3) The Government reserves the right to choose which method will be used to determine the final billable volume.

e. Debris: Refers to a solid artifacts, fragments, or rubbles which are present, but not primarily present by volume, and are intermingled or suspended in an otherwise fully solid, liquid, or sludge waste stream as described above, or a waste stream which meets the definition of debris in 40 CFR § 268.2(g).

(1) Bulk Waste in this section meets the “Mixed” or “Various” Physical State designation indicated in the Price Schedule for this contract, as CLINs with a “Mixed” or “Various” physical state refers to solids, liquids, sludges, debris, or any combination thereof.

(2) Heavy Solids in this section meets the “Debris” Physical State designation indicated in the Price Schedule for this contract.

f. Solids: Refers to solid material, which is largely free of free liquids (e.g., soil, silt, sand, gravel, filter cake, powder, granules, crystals, fines, artifacts) that do not meet the definition of debris (as defined in 40 CFR § 268.2(g)).

g. Sludges: Refer to materials that meet any of the following criteria: (1) multiphasic substances consisting of a combination of liquid and solid phases; (2) slurries or mud-like

SP4500-27-D-XXXX Page 10 of 54 materials, such as liquid-saturated soil or tank bottoms, in which solids are largely or entirely suspended in liquid, typically flow under gravity, and may or may not be conveyable by high-capacity pumping or vacuuming devices designed for heavy materials; or (3) highly viscous liquids that are not pumpable by conventional devices designed for low-viscosity fluids.

2.1.3.2 CONTAINERIZED WASTE

a. Containerized Waste: Refers to waste that is typically transported by a box truck or semi-truck and trailer or van, including waste contained in drums, totes, cubic yard boxes, military tri-wall boxes, cubic yard bags/super sacks, lamp boxes, cylinders, or palletized waste.

b. Weighing: While most containerized CLINs are priced by the container size (CLIN

Suffixes C1-C6, and T1-T3), the Contractor must weigh all containers, pallets, and dunnage using contractor provided portable, calibrated scales prior to removal for manifesting and reporting purposes. If a U.S. facility has already weighed the containers, the Contractor may agree to accept the weights at its own discretion.

c. Drums larger than 55 gallons (C5 Suffix) are to be used only for overpacking smaller drums. The Contractor must bill based on the size of the outer overpack drum.

d. Pallet (C6 Suffix): Refers to a flat wooden, plastic, or metal transport structure not more than 48” L x 48” W that supports goods in a stable manner while being lifted by a forklift, pallet jack, front loader, or other lifting device. Skids may be used in lieu of pallets when well suited to support the cargo and are accessible to movement via typical material handling equipment. Containers/items placed on a pallet are often secured with dunnage (i.e., banding straps, stretch, or shrink wrap for stability in movement). The sum weight of the dunnage, pallet, and palletized waste cargo will collectively comprise the weight of the waste and must not exceed a weight of 1,600 pounds and/or a height of 42” including the pallet unless otherwise authorized by the Contractor.

e. Tote (T1-T3 Suffix): Refers to a portable tank or Intermediate Bulk Container (IBC) designed for storage and transport of bulk liquids. For purposes of this contract, liquid wastes that are removed in totes are considered containerized wastes. Tote sizes are commonly designed in increments of 55 gallons, i.e., 220, 275, and 330 gallons. CLIN Suffixes T1, T2, and T3 apply to these tote sizes, respectively. The unit of measure for these CLIN Suffixes will be Each (EA), regardless of the actual volume of liquid contained in the tote, and not to exceed the design capacity. Totes are not be returned to the Government unless ordered under a separate service CLIN and disposal pricing will include any associated processing fees, if applicable.

2.1.4 BASE CLIN CATEGORIES

The following subsections define the high-level Base CLIN categories used for waste disposal.

The Price Schedule provides detailed descriptions and specific four-character Base CLINs that fall under the applicable category list.

SP4500-27-D-XXXX Page 11 of 54

a. Batteries (BA): Used for all battery types, some, or all of which may be turned in as UW where no EPA Waste Codes are assigned, or as HW, where applicable EPA Waste Codes are assigned.

b. Corrosives (CS): Used for all corrosive wastes meeting the EPA definition of corrosive and carrying the EPA Waste Code D002, unless it is a Lab Pack/Loose Pack, or unless the waste is concurrently assigned a D001 (ignitable) or D003 (reactive) Waste Code. Some corrosive acid oxidizers may carry the D001 Waste Code and be assigned a CS CLIN.

c. Compressed Gas Cylinders (CY): Used for all types of compressed gas cylinders, vessels, canisters, and cartridges. The specific Base CLIN sequence number assigned is based on the specific chemical name of the gas or gases comprising the contents, as detailed in the Table of Compressed Gases in the Price Schedule.

d. Flammable/Combustible/Ignitable (FL): Used for all ignitable and other than reactive or corrosive oxidizers carrying the D001 Waste Code, unless it is a Lab Pack or Loose Pack or unless the waste is concurrently assigned a D003 (reactive) Waste Code. FL CLINs may also be assigned to waste streams not carrying the D001 Waste Code but containing flammable/combustible/ignitable constituents.

e. Lab Packs/Loose Packs (LP): Used for most overpacked small containers of chemicals and consumer commodity-type products. "Lab Packing" refers to the overpacking of laboratory chemicals, a service performed by the Contractor. "Loose Packing" refers to the consolidation of consumer-type products and may be performed by the Generator. For disposal, Lab Packs and Loose Packs share the same Base CLIN depending on their contents.

f. Non-RCRA (NR): Used for wastes that is not deemed hazardous under federal RCRA regulations, which may or may not be regulated by the State.

g. PCB-Related (PC): Used for all wastes containing or contaminated by PCBs at or above 50 parts per million (ppm) and regulated under the Toxic Substances Control Act (TSCA).

h. PFAS-Related (PF): Used for various wastes containing or contaminated by PFAS, including some AFFF wastes.

i. Recycle/Recovery (RE): Used for various wastes that, by contract or regulation, require the recycling or recovery of their constituents (e.g., used oil, anti-freeze, lamps).

j. Reactive (RX): Used for various reactive wastes bearing the D003 Waste Code or potentially exhibiting reactive characteristics.

k. Toxic (TX): Used for various toxic wastes that are not primarily ignitable, corrosive, or reactive.

2.1.5 ORDER OF PRECEDENCE FOR CLIN SELECTION

SP4500-27-D-XXXX Page 12 of 54

When a waste stream could potentially fit under more than one CLIN category, the following hierarchy is used as the order of precedence for selection. There are some exceptions to this rule such as (RE) CLINs and universal waste.

1. PFAS-and/or PCB-Related (PF, PC, regulations vary by state)

2. Reactive (RX, D003)

3. Ignitable/Oxidizer (FL, D001)

4. Corrosive (CS, D002)

5. Toxic (TX, D004-D043)

6. All other EPA Listed Wastes (P, F, U, K)

7. Non-RCRA, State-Regulated Waste (NR)

8. Non-RCRA, Non-State Regulated Waste (NR)

2.1.6 CLIN SUFFIX TABLES

The final two characters of a CLIN are the "CLIN Suffix," which designates the unit of measure or the type of service.

c. Supply CLINs (SP): Designates a supply commodity item (e.g., empty drums, labels, spill kits).

d. Sampling and Analysis CLINs (SA): Designates sampling and laboratory testing (e.g., pH, TCLP Metals, Total VOCs).

2.1.7 SPECIAL RULE FOR RECYCLE/RECOVERY (RE) CLINS

If the Contractor asserts that a waste designated for mandatory recycling under a CLIN beginning with "RE" cannot be recycled, the Contractor must:

a. Notify the KO in writing at least five (5) business days before pickup, providing rationale and supporting documentation from at least two qualified recycling facilities (one of which is not owned by the Contractor).

b. The final decision to change a CLIN beginning with “RE” to a disposal CLIN rests solely with the Government.

2.1.8 CLIN RECONCILIATION

a. Discrepancies noted by the Contractor before or during removal must be addressed immediately with the COR and Generator. A TO modification will be issued if all parties concur with a change.

b. If the Contractor asserts that an incorrect CLIN was assigned on a specific TO, they must submit electronic documentation supporting the assertion to the KO and COR within 10 business days of the waste's receipt at the TSDF, at no additional cost to the Government. The burden of proof for any such assertion lies solely with the Contractor. The waste in question must not be treated or disposed of until the Government makes a final determination on the disputed TO line item. Failure to adhere to this process constitutes a waiver of the Contractor's objection.

c. Resolution: If the dispute cannot be resolved to the satisfaction of the parties, the KO will treat the dispute as a Contractor claim under the Contract Disputes Act. The KO will issue a final, written decision to the Contractor resolving the matter within 60 days or such another

SP4500-27-D-XXXX Page 15 of 54 reasonable time as may be appropriate. The KO will provide a copy of this final determination to the COR.

2.1.9 PERMIT AND SPECIAL REQUIREMENTS

a. Fees and Permits: At no additional cost to the Government, the Contractor is responsible for obtaining and paying all fees for any necessary licenses, permits, notifications, and waste profiles resulting from its transportation and disposal decisions. This includes any and all fees associated with the EPA's national electronic manifest (e-Manifest) system.

b. Use of Qualified Vendors: The Contractor and any subcontractors must only use facilities and transporters currently listed on the DLA Qualified Facilities List (QFL) and Qualified Transporters List (QTL).

c. Special Training: The Contractor may be required to attend special training, seminars, or safety orientations provided by the Government to gain or maintain access to an installation (e.g., antiterrorist training, local EMS policies).

d. International Shipments: Any import or export of waste must comply with all applicable international agreements and all foreign laws. For any export shipment, the Contractor is required to provide a current copy of the "Acknowledgement of Consent" from the receiving country to the COR with each manifest.

e. Prohibited Exports: The Contractor must not ship waste outside of the United States for the purpose of circumventing EPA Land Disposal Restrictions (LDR). Furthermore, mercury wastes subject to the Mercury Export Ban Act (MEBA) of 2008 (Pub. L. No. 110-414) must not be exported outside the United States under any circumstances.

2.1.10 SHIPPING DOCUMENTATION

a. Manifest Requirement: The Contractor must use only a Non-Hazardous Waste Manifest (NHWM) or a Uniform Hazardous Waste Manifest (UHWM) for all waste shipments under this contract. The use of Bills of Lading (BOL) is strictly prohibited.

b. Pre-Removal Review: The Contractor must provide the COR and the Generator with a copy of the completed manifest(s), LDR, and any additional shipping documentation notifications for review. These documents must match the items listed on the approved TO and provided at least five (5) business days prior to the removal of containerized wastes and two (2) business days prior to the removal of bulk wastes. All shipping documentation must follow the https://www.epa.gov/mercury/environmental-laws-apply-mercury#:%7E:text=Mercury%20Export%20Ban%20Act%20of%202008,-The%20Mercury%20Export&text=The%20Act's%20three%20main%20provisions,Departments%20of%20Energy%20and%20Defense https://www.epa.gov/mercury/environmental-laws-apply-mercury#:%7E:text=Mercury%20Export%20Ban%20Act%20of%202008,-The%20Mercury%20Export&text=The%20Act's%20three%20main%20provisions,Departments%20of%20Energy%20and%20Defense https://www.epa.gov/mercury/environmental-laws-apply-mercury#:%7E:text=Mercury%20Export%20Ban%20Act%20of%202008,-The%20Mercury%20Export&text=The%20Act's%20three%20main%20provisions,Departments%20of%20Energy%20and%20Defense https://www.epa.gov/mercury/environmental-laws-apply-mercury#:%7E:text=Mercury%20Export%20Ban%20Act%20of%202008,-The%20Mercury%20Export&text=The%20Act's%20three%20main%20provisions,Departments%20of%20Energy%20and%20Defense https://www.epa.gov/mercury/questions-and-answers-mercury-export-ban-act-meba-2008#Contact https://www.epa.gov/mercury/questions-and-answers-mercury-export-ban-act-meba-2008#Contact

SP4500-27-D-XXXX Page 16 of 54 format specified by the Government. The advanced reading copies must replicate the format used on the day of removal and no variations such as drafts, Word documents, or other alternative will be accepted.

c. e-Manifest System: All manifests, whether paper or electronic, must comply with the EPA's national e-Manifest system requirements.

d. Use of Mock EPA ID Numbers: For tracking purposes, DLA Disposition Services will create unique "mock" EPA ID numbers for certain facilities and transporters that do not have an official EPA ID. The Contractor must use these mock IDs on all required documentation, including manifests and invoices, as directed. This primarily applies to non-RCRA TSDFs within the US and any TSDF or transporter located in the United States.

e. UW Shipments: While UW may not always require a hazardous waste manifest, the Contractor must comply with all state and federal regulations for its transport. When a manifest is used for UW, the "Special Handling Instructions" block must be annotated with "Universal Waste Shipment."

f. Generator Guidance on UW and Fuels Blending:

(1) Aerosol Cans: The Government may manage aerosol cans as Universal Waste in some states. However, for disposal purposes, the Contractor must ensure that cans which would otherwise be classified as corrosive (D002) or reactive (D003) are managed under the appropriate disposal CLINs for those characteristics, and not under a general flammable (FL) CLIN, as they may not be suitable for fuels blending.

(2) Fuels Blending: Unless prohibited by regulation, wastes with a minimum energy value of 2,500 BTUs/Lb. will be considered eligible for fuels blending. The Government presumes wastes turned in under designated fuels-blendable CLINs are used for energy recovery even when it’s used for incineration purposes.

2.1.11 NOTIFICATIONS

a. Standard Notification: Unless otherwise specified, the Contractor must notify the COR at least five (5) business days before attempting installation access for routine services. This notification must include a written schedule, transport company name, the specific driver's name, and his or her credential information.

b. Driver Changes: If a driver other than the one scheduled arrives to perform a removal, the COR will verify the personnel change with the Contractor via written notice before the removal commences.

c. Expedited Notifications: For TOs containing expedited service CLINs, the Contractor must provide notification to the Government IAW the "Required Government Notification Time" specified in Table 6: Expedited Service CLINs and Timelines.

SP4500-27-D-XXXX Page 17 of 54

d. Excusable Delay Requests: If the Contractor determines that standard removal times cannot be met due to unforeseen issues at a TSDF beyond the Contractor’s control, the Contractor must notify the KO and COR in writing by close of business the following business day.

(1) Initial Notification Content: The written notification must include the subject TO number, the specific reason(s) for the delay, and substantiable documentation demonstrating that the delay is beyond the Contractor's control. To meet this burden of proof, the documentation must show earnest attempts were made by the Contractor to utilize at least two additional qualified TSDFs.

(2) Waiver: Failure by the Contractor to make a proper and complete notification as required herein constitutes a waiver by the Contractor to exercise its excusable delay request.

(3) Post-Approval Process: Following a proper notification, if the KO determines the Contractor has met the burden of proof, the Government reserves the right to issue a new, standalone TO for the impacted line items. The Contractor must then provide biweekly TO status updates to the KO and COR. The Contractor must also immediately notify the KO and COR once the situation is resolved and standard performance can resume.

(4) Mixed TOs: If a delay situation arises on a TO that contains both impacted and non-impacted waste streams, the KO, COR, and Contractor must mutually agree upon the best method to address the situation, which may include the issuance of follow-on TOs.

2.1.12 INSTALLATION ACCESS AND SECURITY

a. The Contractor is responsible for ensuring all personnel, including subcontractors, are properly credentialed through the Defense Biometric Identification System (DBIDS) or other required installation access systems prior to arriving at the installation.

b. The Government reserves the right to refuse installation access or stop work at any time if a security risk is believed to exist.

c. All contractor personnel must comply with all site-specific security regulations. The detailed requirements for personnel security investigations, Common Access Cards (CACs), and security compliance are detailed in Section 11.0 below.

2.1.13 PACKAGING, MARKING, AND CONTAINER STANDARDS

a. Generator Responsibility for Primary Packaging: The Generator is responsible for ensuring that all waste containers turned in for removal are UN-approved, shippable, in good condition, and compatible with the contents at the time of turn-in.

SP4500-27-D-XXXX Page 18 of 54

b. Contractor Verification and Placarding: Prior to removal, the Contractor must verify that all waste containers are properly packaged, marked, and labeled to meet all applicable DOT, EPA, and state regulations. The Contractor must provide and affix all appropriate placards to the conveyance vehicle before leaving the Government premises.

c. Handling of Non-Compliant Packaging: If the Contractor determines that waste is not properly packaged, marked, or labeled, the Contractor must notify the Generator immediately.

The Generator may choose one of the following options:

(1) Remove the non-compliant item from the TO.

(2) Repackage the item to meet compliance standards.

(3) Order a repackaging service from the Contractor under the appropriate Special Services CLIN.

d. Prohibition of Co-mingling: The Contractor must not package RCRA-regulated or

State-regulated waste together in the same outer container with non-regulated waste.

e. Industry Standard Special Packaging: Special packaging required by Generators will be only for those waste stream items where such packaging is required per DOT regulations, and/or the packaging requirement is considered an industry standard practice as determined by DLA Disposition Services. Some examples of Generator special packaging considered industry standards include:

• Applying clear electrical tape to battery terminals prior to packaging.

• Packaging of air/water reactive (D003) metal powders, dusts, fines, and debris under food grade mineral oil in combustible (poly/plastic) containers not to exceed five (5) gallons in size and 100 pounds in gross weight.

• Packaging of road flares and other authorized incendiary items under water.

• Packing individual Damaged, Defective, or Recalled (DDR) lithium batteries in separate containers IAW 49 CFR 173.185(f) requirement.

f. Dispute of Packaging Requirements: If the Contractor asserts a special packaging requirement is an industry standard and the Government disputes this, the KO will make the final determination. The Contractor may be required to provide KO with documentation supporting its reason for the special packaging requirement.

g. Provision of Containers: The Government will purchase and provide most outer containers. The Contractor is only required to provide the outer containers for services where it is explicitly stated, such as for Lab Packing Services.

2.1.14 ADDING WASTE TO ISSUED TASK ORDER (TO)

a. Containerized Waste: The Government reserves the right to add limited containerized wastes to an already issued TO up to five (5) business days prior to the scheduled removal date.

SP4500-27-D-XXXX Page 19 of 54

The addition of such containers is strictly limited to waste streams that have been fully profiled and have an established CLIN in the Price Schedule.

b. Manifest Updates: If the Contractor has already provided a pre-removal copy of the manifest, the Contractor is responsible for editing the manifest to include the added items on or before the time of removal.

c. Bulk Waste: The addition of bulk waste to an already issued TO is prohibited unless mutually agreed upon in writing by both the Contractor and the KO.

2.1.15 TO ADJUSTMENT

All TO weights and/or volumes are estimated. The Contractor should expect that TO weights and/or volumes will require adjustment upward or downward as removals take place and the actual weights/volumes being removed are determined. Therefore, the Government has the unilateral right to increase or decrease the TO weight/volume in those cases where the Government has underestimated or overestimated the weight/volume ordered for removal, allowing the Contractor to complete the performance. In cases of adjustments resulting in a decreased weight/volume, these decreases are not subject to the “termination for Government’s convenience” language contained in contract clause FAR 52.212-4. In addition, the Contractor agrees to accept Government-issued unilateral TO modifications for quantity changes, noun description changes, CLIN changes, adding/deleting lines, extending TO end dates, etc. The Contractor is only paid for the actual items and quantities removed per the awarded contract price schedule. If upon receipt of a unilateral TO modification, the Contractor does not agree with the Government’s change(s), the Contractor may seek resolution through the KO. These modifications pertain only to issued TOs, and no changes will be made to the terms and conditions of the contract.

2.2 WASTE COLLECTION AND TRANSPORT

2.2.1 SPILL RESPONSIBILITY

a. Spill Contingency Plan: The Contractor must provide a comprehensive Spill Contingency Plan to the KO and COR prior to the first waste removal performed under this contract. This plan must, at a minimum, demonstrate the Contractor's capability to contain a small liquid spill (up to five gallons) and to overpack a leaking container. The driver must have a copy of this plan in his or her possession during all removals.

b. Spill Kit Requirement: The Contractor must maintain a serviceable, waste-compatible, fully stocked, and versatile spill kit on all removal vehicles. The Government reserves the right to visually inspect the spill kit at any time. Failure to have an adequate spill kit available may result in cancellation of the removal and will be considered a performance failure.

c. Cleanup Responsibility: The Contractor is solely responsible for the proper cleanup and disposal of all spills or leaks attributed to the Contractor, at no additional cost to the

SP4500-27-D-XXXX Page 20 of 54

Government. Cleanup must be to the satisfaction of the Government, and all resulting wastes must be removed off-site within 72 hours of the cleanup's completion.

d. Reporting Requirements: The Contractor must report all spills, regardless of quantity, to the COR, KO and Generator immediately upon discovery. A written follow-up report must be submitted to the KO within 24 hours. This report must include, at a minimum: a description of the material spilled, the estimated quantity, the manifest number, the time and location, containment procedures initiated, a summary of external communications, and a description of the cleanup procedures utilized.

2.2.2 LOADING AND EQUIPMENT

a. Timeliness: The Contractor’s representative must arrive at the pickup location no more than 30 minutes after the scheduled removal time. If the Contractor anticipates a late arrival, it must notify the Government representative before the scheduled appointment time.

b. Contractor Responsibility for Loading: The Contractor is responsible for furnishing all equipment (e.g., lift gate, forklift, pallet jack) appropriate for the safe and efficient loading of all containers. The Contractor is solely responsible for the final loading and securing of all cargo on the conveyance vehicle. The Government will not block, chock, brace, lash, band, or in any other manner secure the cargo.

c. Government Staging and Assistance: Prior to the scheduled removal, the Government will ensure that all waste containers are staged at an accessible ground or loading-dock level location. For the purposes of this contract, "accessible" is defined as being unobstructed and not requiring the movement of other containers or objects to gain access.

d. Tailgating: The Government may, at its sole discretion, offer to assist the Contractor by "tailgating" items. Tailgating is defined as the Government using its own equipment to move a waste container(s) from its staging area(s) to the rear of the Contractor's conveyance vehicle for final loading by the Contractor. The Contractor's acceptance of such assistance does not relieve its responsibility for the final, secure loading of the cargo.

2.2.3 WEIGHING AND MEASURING OF ITEMS

a. General Requirement: All items must be weighed prior to removal. Government scales will be used when available and authorized. All scales used for the purposes of this contract, whether Government or Contractor-provided, must be calibrated IAW applicable laws and regulations.

b. Procedure for Bulk Waste: For bulk waste shipments, the Contractor must weigh the conveyance vehicle to establish the empty (tare) weight and reweigh the loaded vehicle to establish the gross weight. The Contractor must provide certified tare and gross weight tickets to the COR. The calculated net weight (gross minus tare) is the basis for payment.

SP4500-27-D-XXXX Page 21 of 54

c. Certified Weight Tickets: In lieu of a printed, certified weight ticket from a commercial scale, a manual weight ticket that is signed or stamped by a witnessing Government representative at a certified Government scale will be accepted as a certified weight ticket.

d. Measuring Liquids: Gallons are measured by metering, tank strapping, or calculating the density of the waste. Volumes are rounded to the nearest whole gallon using conventional (non-scientific) rounding rules. This rule requires that if the digit to the right of the decimal place is 0, 1, 2, 3, or 4, leave the whole number alone; if the digit to the right of the decimal place is 5, 6, 7, 8, or 9, add 1 to the whole number.

2.2.4 TREATMENT OF HAZARDOUS WASTE ON GOVERNMENT FACILITIES

a. General Prohibition: Treatment of hazardous waste on any Government facility is strictly prohibited except when treatment is authorized by a local regulatory official to ensure safe storage and transport, in which case no EPA Waste Code(s) will be removed as a result of such provisional treatment. Examples of such exceptions may include packing water-reactive wastes under oil or stabilizing organic peroxides. For the purposes of this contract, "treatment" is defined as any process that meets the definition in 40 CFR § 260.10 or the receiving facility's permit.

b. Specific Prohibition for PCBs: The Contractor must not drain and/or flush items containing PCBs at any Government facility. An exception is made only for the minimal draining necessary to prevent a leak during transport and to meet immediate DOT shipping requirements.

c. Specific Prohibition for Gases: The treatment, disposal, or release of any gas to the atmosphere on Government premises is strictly prohibited, with the sole exception of inert gases as specified in Section 3.3.4. The Contractor may, however, perform gas extraction using a self-contained apparatus that purges the entire cylinder contents into a closed receiver for transport, with zero emissions to the atmosphere.

2.2.5 WASTE SEGREGATION

a. All items collected under this contract must be segregated according to applicable hazardous materials compatibility requirements and must be kept physically separate from any containers or wastes not associated with this contract until the initial TSDF is reached.

b. The Contractor may transport previously loaded waste from one Government site to another while conducting "milk runs" to pick up waste at multiple locations, provided all waste on the conveyance is from this contract and is properly manifested. The items must be so marked that they are readily linked to this contract.

2.2.6 BULK LIQUID REMOVALS

a. When bulk, pumpable liquids are ordered for removal, the Contractor is required to pump or vacuum waste from tanks, drums, totes, sumps, surface, storm, and groundwater sources. All associated labor and equipment costs for these activities are included in the unit

SP4500-27-D-XXXX Page 22 of 54 price of the disposal CLIN designated with a “B5” suffix. The Contractor is responsible for furnishing all equipment and personnel necessary to complete this task, including, but not limited to, a collection vehicle equipped with a mechanical pump or vacuum device, hoses, filters, and fittings. All pumps, vacuums, and hoses must possess the capacity and chemical resistance required to safely handle the specific waste types collected, ensuring the removal of all pumpable liquids from tanks, drums, or totes without the need for agitation or the introduction of additional materials.

b. A 1,500-gallon minimum charge applies to the pumping, vacuuming, and removal of bulk liquid waste on a single TO. However, this minimum charge does not apply—and will not be ordered—if the tank or vat from which the waste was removed was also cleaned under an Industrial Cleaning Service (ICS) CLIN on the same TO. Additionally, the charge is waived if the Contractor elects to pump, vacuum, or sting containers for its own convenience at no additional cost to the Government.

c. Where removal from more than one tank or container is performed using a single vacuum or tanker truck, only compatible wastes of the same Base CLIN can be pumped and commingled into the same vehicle for transport.
