PURPOSE OF SOLICITATION AMENDMENT

The purpose of Amendment Eleven is to:

I) Provide responses to questions received regarding the solicitation.

The responses are offered for information only and do not modify or become part of this solicitation.

Additional amendments may be provided as needed to address further questions and their related responses. All potential offerors are advised to refer back to all previous amendments for additional questions and clarification.

I) The Government’s responses to questions received regarding this solicitation are as follows:

GENERAL QUESTIONS

Question 1: Does NIH Late Application Policy Notice Number NOT-OD-20-091 apply to this BAA? Do I have until May 1, 2020 to submit a proposal?

Response: This BAA is a contract solicitation; it is not a grant. The above notice applies to grant applications. The proposal due dates for Research Areas 001, 003, 004, and 005 remain unchanged at mailto:teosl@niaid.nih.gov mailto:brian.madgey@nih.gov https://grants.nih.gov/grants/guide/notice-files/NOT-OD-20-091.html

Question 2: 1) Are patent prosecution expenses allowed?

2) What are the guidelines for fees, and can a university applicant request them?

3) Can proceeds from fees be used to pay for patent prosecution expenses ?

Responses: 1) In accordance with FAR 31.205-30, patent costs are allowable to the extent that they are incurred as requirements of a Government contract. This BAA does not require offerors to file patents;

therefore, patent costs are not allowed to be charged as direct cost to the contract.

2) In accordance with FAR 15.404-4, for experimental, developmental, or research work performed under a cost-plus-fixed fee contract, the fee shall not exceed 15 percent of the contract’s estimated cost, excluding fee. If it is the offeror’s standard business practice to consistently charge fee to federal awards, the offeror may propose fixed-fee.

3) A contractor has the discretion to expend its fee as they deem appropriate.

Question 3: Regarding Section 7. – Attachment No. 12 “Disclosure of Lobbying Activities, OMB Form SF- LLL form”, would the following statement in the Business Proposal be satisfactory for the proposal?

“We acknowledge the requirements and restrictions on funds being used for lobbying activities and assures that it is compliant is all respects to the law and HHS regulations.”

Response: If your institution has lobbying activities, you must complete, sign, and submit the Disclosure of Lobbying Activities. If your institution does not have lobbying activities, you can enter N/A in any field, such as item 10, sign, and submit the form.

PLEASE NOTE: In the questions/responses above, specific organizational names have been removed or replaced where possible as well as other minor adjustments.
