BRIDGE JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

Upon the basis of the following bridge justification, I, as Contracting Officer, hereby recommend the use of other than full and open competition for the proposed contractual action pursuant to the authority of Federal Acquisition Regulation (FAR) Subpart 6.302-1 “Only one responsible Source”.

l. Agency and Contracting Activity:

Contracting Office:

United States Environmental Protection Agency (EPA) Information Technology Acquisition Division (ITAD) 109 T.W Alexander Drive Mail Code: AA005 Research Triangle Park, NC 27711

Project Office:

Office of the Chief Financial Officer (OCFO) Office of Technology Solutions (OTS) Ronald Reagan Building Washington, DC 20460

2. Nature/Description of Action(s):

This bridge justification for other than full and open competition (JOFOC) supports an additional sixteen (16) day extension of services under the current contract, EP-G15H-01089 to provide EPA OCFO Operations and Maintenance Support Services as described in the Performance Work Statement (PWS). This contract was initially extended for a period of six (6) months in accordance with Federal Acquisition Regulation (FAR) 52.217-8 from March 16, 2020 to September 15, 2020, for another six (6) months in accordance with FAR Subpart 6.302-1 from September 16, 2020 to March 15, 2021, for sixty (60) days in accordance with FAR Subpart 6.302-1 from March 16, 2021 to May 15, 2021, for thirty (30) days in accordance with FAR Subpart 6.302-1 from May 16, 2021 to June 15, 2021, and for fourteen (14) days in accordance with FAR Subpart 6.302-1 from June 16, 2021 to June 29, 2021. The current period of performance expires June 29, 2021, at which time a sixteen (16) day extension is needed to extend the expiration date to July 15, 2021. This contract action will result in a modification to contract EP-G15H-01089 for the sixteen (16) day extension in services on a sole source basis.

The purpose of this document is to justify the need to extend the period of performance an additional sixteen (16) days to prevent a lapse in services of essential tasks while the new contract is negotiated and awarded. The follow on award is currently being drafted and reviewed. This extension will allow for the follow on contract to be awarded.

3. Description of Supplies/Services:

During this extension, Blue Canopy Group, LLC, shall continue to provide Operations and Maintenance Support Services to the EPA’s OCFO Office of Technology Solutions located in Washington, DC, in accordance with the current contract PWS and associated attachments.

Proposed Contractor:

Blue Canopy Group, LLC 11091 Sunset Hills Road Suite 777 Reston, VA 201905377

4. Identification of Statutory Authority:

The basis for this recommendation is FAR Subpart 6.302-1 only one responsible source and no other supplies or services will satisfy agency requirements. This document contains sufficient facts and rationale to justify the use of FAR 6.302-1 as the authority for this action.

5. Demonstration of Contractor's Unique Qualifications:

No other contractor has access to the information about each task that Blue Canopy Group, LLC has performed during Option Period 3 and subsequent extensions of this contract.

Awarding this contract to any other contractor would lead to unacceptable delays and duplication of costs. No other contractor is in the position to begin performance in a timely manner to provide adequate services for this short period of performance. It is in the best interest of the government to put this contract extension in place and approve the bridge JOFOC to avoid a lapse of these critical services until a follow-on contract can be negotiated and awarded. Specifically, Blue Canopy Group, LLC has the following unique qualifications:

The Operations and Maintenance Support Services that Blue Canopy Group, LLC provides are mission critical. Work performed under this contract involves support for critical Agency financial systems, such as the Compass Data Warehouse (CDW) Reports, SCORPIOS, PeoplePlus and Payment Tracking System and General System Support (GSS). A lapse of database administrators support and server administrator support systems will prevent the Agency from obtaining necessary financial data, thus hindering day to day financial activities.

Additionally, the Contractor provides Integrated Helpdesk (IHD) Support for agency financial systems and supports the infrastructure of the Agency financial systems. Without the IHD support OCFO can no longer provide HelpDesk support to Agency employees for HR, Payroll, PeoplePlus issues which will tremendously affect the Agency’s ability to assist employees in turning in Time & Attendance (T&A). In addition, OCFO will not be able to support users of OCFO’s financial systems.

Without the Contractor support, most of the OCFO systems Mixed-Financial and T&A will not be operational, which will prevent employees to enter/approve T&A, payments will not be posted into COMPASS and therefore, employee and contractors will not be paid.

6. Government-wide Point of Entry (GPE)/FedBizOps Announcement/Potential Sources:

A notice of intent to issue a sole source award was publicized to the Government point of entry (GPE) on June 2, 2021 as required by FAR Subpart 5.2. This JOFOC will be posted to the GPE within 14 days of modification award for a minimum of 30 days as required by FAR 6.305.

7. Determination of Fair and Reasonable Cost:

The anticipated cost to the Government is determined to be fair and reasonable by the Contracting Officer for this sixteen (16) day extension. The proposed not to exceed value for the new extension is $165,151.25. The labor rates are the same as the previous extensions. The rates and cost estimates for the first six (six) month extension were the same as those for Option Period 3 of contract number EP-G15H-01089, which were deemed fair and reasonable during the award phase of the current contract.

8. Description of Market Research:

No additional market research was conducted for this sixteen (16) day bridge JOFOC/extension request for the reasons of mission critical work as stated in item 5 in this justification. Based on the information found in item 5 of this document, it is not reasonable to believe that a contractor could take over and provide Operations and Maintenance Support Services required in the sixteen

(16) day extension. Therefore, a sole source extension to the current contract is the only responsible way to meet this critical EPA requirement.

9. Any Other Supporting Facts:

None at this time.

10. Listing of Interested Sources:

No additional sources known.

11. Actions Taken to Remove Barriers to Competition:

A RFP with a closing date of March 15, 2021 was issued by the Office Acquisition Solutions (OAS) Information Technology Acquisition Division (ITAD) division on the National Institute of Health Information Technology Acquisition and Assessment Center (NITAAC) Chief Information Officer Solution and Partners 3 Small Business (CIO SP3 SB) Government Wide Acquisition Contract (GWAC) for the follow requirement. The resulting award is currently being drafted and reviewed. This sixteen (16) day extension of services under the current contract, EP-G15H-01089, which provides Operations and Maintenance Support Services to EPA’s OCFO Office of Technology Solutions in Washington, DC, as described in the contract PWS, should allow ITAD sufficient time to award a follow-on contract in accordance with the

FAR.

12. Statement of Delivery Requirements:

This sixteen (16) day extension will extend the contract out from June 29, 2021 to July 15, 2021.

13. Total Estimated Dollar Value of the Acquisition Covered by this J&A:

The total Time and Materials (T&M) not to exceed value of the current contract is $24,136,208.59. The total estimated value of this thirty (30) day extension to the current contract from June 16, 2021 to July 15, 2021 is $315,039.46. The total value of the contract will increase by $165,151.25 from $24,136,208.59 to $24,301,359.84.
