PERFORMANCE WORK STATEMENT (PWS)
Kentucky District Transportation Contract
1.0. INTRODUCTION: To fulfill its mission, the Department of Defense Education Activity (DODEA) Domestic Dependent Elementary and Secondary Schools (DDESS) must provide safe, responsive, efficient transportation for eligible dependent students residing on Fort Campbell and Fort Knox military installations.
2.0. DEFINITIONS.
2.1. “Contract Managers (Primary and Alternate).” The individuals appointed by the contractor to act as his/her representative as responsible for all services performed under this contract.
2.2. “DoDEA Accommodation Plan.” A plan developed for students with special needs in accordance with Department of Defense Regulation (DoDR) 2500.14.
2.3. “Extended School Year (ESY).” A summer education program for students conducted during the months of June and July that is approximately twenty (20) days in length at Fort Knox and twenty (20) days in length at Fort Campbell.
2.4. “Individual Education Program (IEP).” A program developed for special education students in accordance with Department of Defense Instruction (DoDI) 1342.12 designating which services a student shall receive.
2.5. “Other authorized individuals.” U.S. Military Police and those persons authorized in writing by the Contracting Officer (CO) or the Contracting Officer’s Representative (COR) or Alternate COR.
2.6. “Safety Attendant.” Attendant authorized on vehicles transporting students to/from school. Normally only one Safety Attendant is assigned to a vehicle. Safety Attendants are specially trained adults whose primary responsibility is to oversee on-board student safety during the daily commute to/from school.
2.7. “Safety Attendant for Special Education (SPED).” Attendants authorized to accompany students with disabilities if the student’s IEP specifies the need for one-on-one adult supervision or that special needs assistance is required when the student is being transported to/from school. Safety Attendants (SPED) are adults with special training that equips them to supervise or assist students with disabilities/special needs identified in their IEP.
2.8. “Walking area.” 1.5 miles for secondary students and 1.0 miles for elementary students to the assigned school, unless a major thoroughfare presents a safety hazard. In accordance with DoD 4500.36-R, exceptions may be made.
2.9. “Ridership.” Uses student numbers to determine cost; daily transportation costs would be determined by a contracted cost per student. “Ridership” is also a monthly report requirement for the contractor to perform to verify the number of students riding the buses.
2.10. “Curricular Transportation.” Authorized transportation services in direct support of the school curriculum and events within the normal school day. Normally the activity is scheduled for an entire class and participation is mandatory and considered in determining a student’s grade.
2.11. “Co-curricular Transportation.” Authorized transportation for students and school sponsors to participate in interscholastic sports, music, forensics, science, humanities, performing arts, and so on. These school-sponsored activities are designed to provide opportunities for students to participate on an individual or group basis in events for enjoyment, motivation, and improvement of skills. Student participation is on a voluntary basis and credit is not given. Most activities occur outside regular school hours.
2.12. “SPED Secondary Transition Program.” In accordance with DoDEA 2500.13G authorized transportation services for Individual Transition Plan (ITP) will be provided to various job, training sites as established with IEP/ITP by CSC.
3.0. SCOPE OF WORK. The contractor shall provide all personnel including drivers and safety attendant, supervision, services, supplies and equipment necessary to perform school bus transportation services to 7 schools for approximately 3481 students with an estimated ridership of 2300 students residing on Fort Campbell military installation and to 4 schools for approximately 1600 students with an estimated ridership of 1300 students residing on Fort Knox military installation. Additionally, there are approximately 30 SPED students attending ESY on Fort Campbell and 20 SPED studenst attending ESY on Fort Knox. The Pre-K population is an unknown variable beginning each school year. This service may require specialized equipment including, special or adapted buses, lifts and ramps to provide transportation for a student with a disability. Contracted services must be in compliance with Kentucky Department of Education requirements for pupil transportation. Students ridership cost will remain at a fixed number unless ridership increases or decreases by 150 students. Bilateral contract modifications will be issued to incoprorate these changes into this contract. The Government will furnish information, as well as updates, related to school attendance areas, housing zones for each school and breakdown of students by grade level in each housing zone to assist the contractor with determining the most efficient/best routes in order to meet the school schedules. See Appendix 1 and 2.
3.1 Contract Administration and Management
3.1.1. Customer Service.
3.1.1.1. The contractor shall provide customer service to include: answering phone calls and responding to customer comments/inquiries related to transportation, answer questions and provided direction. The contractor shall, document customer comments/problems in a daily call log created by the contractor. The call log shall accurately records customer interactions, details of inquiries and comments, and details and actions taken to resolve issues.
The contractor shall provide a written copy of the call log to Contracting Officer Representative (COR) weekly and notify the COR immediately to resolve issues that are time sensitive.
3.1.1.2. The contractor shall provide supervision of the delivery of the transportation services, coordination with local principals, and fielding additional requests for athletics/activities.
3.1.2. Contract Management. The contractor shall designate primary and alternate Contract Managers (CM). The name and contact information for the CM shall be provided in writing to the Contracting Officer (CO) and COR prior to commencement of work.
3.2. Scheduled Services.
3.2.1. The contractor shall transport students and other authorized individuals to and from their designated schools and assigned bus stops before the start of, and at the completion of, the students’ school day during the regular school year (SY) and the extended school year (ESY).
3.2.2. Scheduled services shall include special education (SPED) services students who qualify for special transportation based on their individual education program (IEP) or DoDEA Accommodation Plan.
3.2.3. Operational days for scheduled services shall be in accordance with (SY) calendars. Operational hours are approximately 6:30 a.m. to 4:30 p.m. daily. The ridership information is subject to changes in student numbers plus or minus 150 students.
3.2.3.1. The contractor shall provide bus transportation services to those students living outside the established walking area. Contractor shall prepare bus schedules; routes and stops based on enrollment information (housing area address, school assignment, grade, and handicap) furnished by the COR. The elapsed time between first pick up and school drop off shall not exceed 60 minutes.
3.2.3.2. The contractor shall schedule bus transportation to arrive at all schools not earlier than staff arrival time and not later than 8 minutes prior to scheduled school starting time. Buses shall be in place and ready to load students 5 minutes before scheduled school dismissal.
3.2.3.3. The service day schedule is subject to SY calendar adjustment; such as inclement weather early release by Garrison Command, Emergency Dismissal for AT event, and total building heat failure in extreme cold weather.
The Government will provide the contractor with notification of an event adjustment at the earliest possible dictated event timing. The contractor shall comply with an adjustment to the schedule at no additional cost to the Government.
3.2.3.4. The contractor shall implement route schedule changes within 48 hours of receipt of a route change request from the COR.
3.3. Service Days and Schedule Adjustment Requirements
3.3.1. Contractor transportation services shall incorporate the below listed service days and schedule adjustment requirements.
3.3.1.1. In the event that the contractor is unable to furnish transportation as scheduled, the government reserves the right to hire emergency substitute buses for such time as deemed necessary. The Government shall deduct from the contractor's invoices or at its discretion, may bill the contractor for any differences i n costs for the emergency substitute service, including any cost incurred in obtaining said services, and any other damages incurred by the Government as a result of the contractor's failure to provide services.
3.3.2. Scheduled Early Release Days. The contractor shall charge for early release day transportation at the same run rate as regular daily bus services.
3.3.3. Severe Weather and other Emergencies. In the event of severe weather or other emergencies, the COR shall notify the CM if school will be canceled or delayed. The standard per day rate shall apply for all delayed openings and emergencies. Contractor transportation services costs shall be postponed and applied to a later day (makeup day) if school is cancelled due to severe weather and other emergencies.
3.3.3. Other Early Dismissals: When schools are dismissed earlier than normally scheduled due to an emergency dismissal, the contractor shall have vehicles at the school(s) and ready for services within 1 hour af ter not if icat ion from the COR.
3.3.4. Delays. The CM shall notify the COR anytime that completion of a run is expected to be delayed by 30 minutes or longer.
3.3.5. Emergency Bus Evacuation Drills. Once each school year, as directed by the COR, all students shall participate in emergency bus evacuation drills. During bus evacuation drills, the contractor shall have two
(2) buses remain on the school site during school hours for 5 school days.
3.4. Safety Attendants and Safety Attendants (SPED). The contractor shall provide safety attendant and safety attendant (SPED) assistance to students and oversight on buses for scheduled services and ESY runs when required by a student’s IEP or DoDEA Accommodation Plan. Provide a minimum of one (1) safety attendant on each bus exclusively transporting Pre-K students. Additionally, a safety attendant (SPED) shall be on each bus to provide assistance to students when required by a student’s IEP.
3.5. Unscheduled Curricular and Co-Curricular Activity Services. The contractor shall transport regular education and SPED students and other authorized individuals between schools and to and from their designated schools and off-base sites for authorized school activities during and after normal school hours. The COR will request service a minimum of 48 hours in advance of unscheduled activities. The length of these trips may not allow a driver to return in time to drive a scheduled route. In the event of a cancelled trip, the Government will provide a minimum 4-hour cancellation notice. If less than a 4 hour cancellation notice, a minimum trip fee maybe assessed by the contractor to the Government, not to exceed the cost for two (2) unit hours. Transportation requests may require additional storage for band, sporting equipment, or activity supplies; this will be noted on the request 48 hours prior to the scheduled activity.
3.5.1. Activity Bus Transportation. Authorized transportation services for after school students attending studies, clubs, practices, etc. After school transportation consist of one run (one-way) to transport students from school to predetermined drop-off points. This service requires a signed Activity Bus Pass. See Appendix 3. This requirement will be paid in accordance with Daily Transportation.
3.5.2. Bus Driver Down-time. In the event of “curricular/co-curricular” authorized transportation that exceeds 10 hours of driving time, Federal DOT Hours of Service Requirements-Passenger Carrying Vehicles states that drivers must be provided a place of rest, after 15 hours of duty time drivers are provided meals and lodging. Contractor will make lodging/meal arrangements with driver and invoice against “Driver down-time” CLIN. Contractor shall make lodging and meal arrangement in conjunction with Event/Trip sponsor so driver, students and staff are co-located at the same facility.
The contractor shall coordinate all travel requirements with the COR and obtain written approval from the COR prior to beginning such travel. The contractor shall comply with FAR 31.205-46 Travel Costs. Travel costs shall not exceed the maximum per diem rates set forth in the Federal Travel Regulations (FTR) unless approval is obtained from the contracting officer before incurring travel costs in accordance with FAR 31.205-46 procedures.

Travel will be cost reimbursable (i.e., actual costs, no profit). Accordingly, the contractor shall submit receipts for lodging and other incidental expenses as applicable when submitting invoices which include travel costs.
4.0. TRANSPORTATION REQUIREMENTS.
4.1. General.
4.1.1. Passenger Safety. The contractor shall perform all services in a safe, prudent and professional manner accepting full and sole responsibility for the prompt and proper delivery of services and maintain good order of passengers at all times.
4.1.2. Communication/Contractor Delays.
4.1.2.1. The contractor shall maintain two way communications with all bus drivers during transportation of students to include Scheduled Services and Unscheduled Services.
4.1.2.2. The contractor shall notify the COR immediately and provide replacement vehicles and/or personnel, as necessary to minimize the impact of a service delay. However, such notification does not preclude the Government from applying additional remedies resulting from a service delay.
4.1.2.3. The contractor shall complete the run(s) within sixty minutes after notification of the service interruption such as an en-route vehicle failure, disabling accident, or contractor personnel illness, or other incident that causes a delay of thirty minutes or more.
4.1.3. The contract manager or designated alternate shall:
4.1.3.1. Be available telephonically a minimum of three (3) hours before and after the normal school day regarding emergencies, severe weather notification, or other similar urgent non-routine matters.
4.1.3.2. Be immediately available to go to the scene of an accident or other emergency.
4.2. Vehicles. The contractor shall:
4.2.1. Have within its fleet a number of school buses capable of navigating all military installation housing areas.
Contractor shall inspect, service, and have buses operational no later than 1 August of each school year.
4.2.2. Comply with school bus requirements for Kentucky Department of Education requirements for pupil transportation. Contractor shall have appropriate vehicles for wheelchair bound students requiring special transportation. Motor vehicles used to transport special education students shall be equipped with a seat belt for each passenger.
4.2.3. Ensure all vehicle interiors are clean and the exterior presents a clean appearance at the start of the operational day.
4.2.4. Ensure all vehicles used for special needs routes are equipped with functional climate control (air conditioning and heaters).
4.2.5. Perform vehicle safety inspections and documented procedured to conduct vehicle safety inspections prior to performing services under this contract. The contractor’s Quality Control Plan shall contain a daily vehicle inspection checklist. This checklist shall, as a minimum, ensure compliance with all applicable Federal and state laws and regulations. The contractor shall maintain a file of the results of all inspections during the entire life of the contract.
4.2.6. Provide buses to permit seating (maximum of three (3) students per seat for grades Pre-K-6 and maximum of two (2) students per seat grades 7-12) for all passengers.
4.3. The contractor shall:
4.3.1. Provide daily curb-to-curb service on normal school days for special needs children whenever required by student’s IEP or DoDEA Accommodation Plan.
4.3.2. Provide a SPED safety attendant whenever required by a student’s IEP or DoDEA Accommodation Plan. The SPED safety attendant shall:
4.3.2.1. Have the primary responsibility for the student assigned, with secondary responsibility for the remainder of the bus passengers.
4.3.2.2. Be Cardiopulmonary Resuscitation (CPR) and Automated External Defibrillator (AED) and First Aid Certified for the age group of the students they are transporting.
4.3.3. Contractor buses shall not depart any bus stop before the route sheet departure time and shall arrive at each school before the schools’ start and end time.
4.3.4. Contractor shall ensure passengers are picked-up and discharged at their designated stop locations. In NO EVENT shall a passenger be allowed to exit a vehicle except at their authorized bus stop unless otherwise authorized in writing by the CO or COR.
4.3.5. Contractor shall assist passengers requiring assistance in boarding and disembarking of vehicles.
4.3.6. Contractor shall adhere to the procedures for passenger boarding, use of safety belts, special passenger seating, and safe vehicle operation. Install and/or secure the Child Safety Restraint System (CSRS) and wheelchairs in accordance with the manufacturer’s stipulated procedures on buses transporting Pre-K and/or students requiring special transportation. (Note: CSRS includes car/booster seats and harnesses). DoDEA requires seat belts on all Special Needs buses. The contractor shall provide CSRS for all Special Needs students as well as Pre-kindergarten students utilizing the Special Needs buses.
4.3.7. The contractor shall report serious discipline problems to school administration. Contractor shall enforce discipline standards based on Kentucky Department of education-Division of Pupil Transportation code.
4.3.8. The contractor shall ensure all drivers and safety attendants are knowledgeable of:
4.3.8.1. Emergency and evacuation procedures by conducting four (4) emergency evacuation drills pursuant to state regulation. Drills are per quarter upon acceptance of the COR.
4.3.8.2. The requirements for students who qualify for special transportation based on their IEP or DoDEA Accommodation Plan.
4.3.8.3. School bus routes, including the location of health care facilities on or near the route and have copies of their route schedules in their possession while performing contracted services.
4.3.9. Contractor shall ensure drivers and safety attendants, if assigned, work as a team.
4.3.10. Contractor shall inspect all bus passenger compartments at the last stop of each run or after each unscheduled service to ensure no passengers remain in the vehicles. If there is a passenger remaining on a bus, the driver shall immediately notify the Contract Manager who shall contact the COR. The passenger(s) shall be safely transported to the location specified by the COR as quickly as possible.
4.3.11. The contractor shall provide immediate assistance in locating a lost/missing child.
4.3.11.1. If the bus rider fails to arrive at school or home within thirty (30) minutes of their expected arrival time, the student is considered to be lost or missing and the contractor, COR and school officials must be prepared to respond immediately. Communication between the contract manager, school bus officials and parents is vital to successfully finding the lost child. All parties will communicate at a minimum of every fifteen (15) minutes and once the child is located, the COR will promptly contact the contractor.
The COR may contact the CM to report and ask for assistance in locating a child that is considered lost or missing. The contractor shall obtain a re-inspection of the passenger compartment. If the child is not on board, the contractor shall ask the driver and/or bus aide if they remember seeing the missing child on that run and at which stop the student exited. The COR may also require that the contractor drive the route in reverse direction in an attempt to locate the child. The contractor shall immediately provide any/all information obtained to the COR.
4.3.11.2. The contractor shall remain available until the child is located and coordination made with the parents or child care providers.
4.3.12. Contractor shall tag articles left behind by passengers to identify the vehicle route, run and date found. All tag articles shall be delivered to the COR the next business day.
4.3.13. District Opening Day/Week Transportation Procedures. The contractor shall:
4.3.13.1. Implement procedures to visually identify elementary bus riders to observe if students are on the right bus.
4.3.13.2. Attend the elementary school Open Houses and provide identification items and instructions to parents/guardians.
4. 3.13.3. Enter the appropriate transportation data into SIS student database based on the information provided on the Student Bus Transportation Request and Agreement. See Reference List.
4.3.14. On runs to schools the contractor shall:
4.3.14.1. Use the passenger lists generated in SIS or alternate to verify that students and authorized passengers are boarding their assigned buses.
4.3.14.2. Record the names of any students not included on the passenger list and allow them to board the bus going to a school. Provide the record of such students to the COR upon completion of the run.
4.3.14.3. Upon arrival at the school, ensure drivers remain on the bus with passengers until a member of the school staff is available to take charge of the passengers. The driver shall immediately notify the Contract Manager if no staff member is present within five minutes of the vehicle's arrival.
4.3.15. On runs at dismissal the contractor shall:
4.3.15.1. Allow only those students on the passenger list or those with a written authorization from the COR or school administration to board the bus. Report any incident of a student without proper authorization that attempts to board the bus to the COR through the Contract Manager.
4.3.15.2. When curb-to-curb service is authorized, release these passengers only when a parent or designated person is present. In the event this person is not present within five minutes of the vehicle's arrival (or scheduled arrival, whichever is later) at the designated stop, the driver shall immediately notify the Contract Manager. The Contract Manager shall then contact the student’s designated school for information, if arrangements have not been made the driver will return the student to the designated school and release student to school staff. In the rare event school staff is not present, Contract Manager will contact the COR who will provide specified location for student release.
4.4. Additional Requirements:
4.4.1. The contractor shall participate in the DODEA’s “One-Call” system to provide parents specific information concerning unseen changes to daily transportation. Contractor will update as needed data on bus ridership, bus numbers and contact information for parents via the One-Call system.
4.4.2. The contractor shall participate in Force Protection/Anti-Terrorism/Crisis Management/Safety and Security requirements. These requirements are during the normal duty day.
4.4.3. The contractor shall designate and provide an Environmental Compliance Officer to attend a 4-hours annual training.
4.4.4. The contractor shall maintain liability insurance coverage pursuant to 702 KAR 5:030, Section 22. Reference may be located at: http://www.lrc.ky.gov/kar/702/005/030.htm.
4.4.5. The contractor shall ensure that all buses meet the KY Department of Education Division of Pupil Transportation standards. The age for school bus fleet shall not exceed ten (10) years and the mileage shall not exceed 150,000 miles on chassis.
4.4.6. Fort Campbell has a contractor entry system described as Rapid Gate. Participation in this system is solely with the contractor and all costs incurred will be with the contractor.
5.0. PERSONNEL REQUIREMENTS.
5.1. Standards of Conduct. All contractor personnel performing under this requirement shall:
5.1.1. Limit physical contact with passengers to those actions necessary for the safety of the passengers (e.g., to assist passengers in getting on or getting off the bus, to assist in fastening seat belts [where required], to break up fights, to administer first aid [if applicable], to keep a passenger from falling or tripping).
5.1.2. Be properly attired and present a neat and clean appearance. Transportation drivers and safety attendants shall wear nametags.
5.1.3. Communicate to a school administrator immedia te ly any observation of, or student or parent complaint alleging sexual abuse, sexual harassment, or inappropriate conduct.
5.2. Contractor personnel shall NOT:
5.2.1. Use verbal assault, foul language, personal or racial insults, physical contact, and /or threats of physical violence to obtain a student's name or to enforce discipline during the performance of contracted services.
5.2.2. Engage i n any conduct of a sexual nature (verbal or physical) with students.
5.2.3. The CO may bar a contractor employee from providing service under this contract if the contractor employee solicits, coerces, or engages or attempts to engage in any sexual conduct to include sexual abuse, sexual harassment and/or inappropriate conduct with a student. The CO may take this action regardless of the student's age, regardless of whether the student may have consented, and/or whether the conduct may be a crime under state or Federal law. The following definitions are provided:
5.2.3.1. Sexual Abuse: Any act of a sexual nature committed with the intent to arouse, appeal to or gratify the lust, passions or sexual desire of the employee/volunteer and/or student, i ncluding but not limited to criminal sexual conduct as defined by state or Federal law. Such acts include, but are not limited to: rape; carnal knowledge;
sexual assault or battery; indecent exposure, indecent acts with another; or producing, viewing or trafficking in child pornography.
5.2.3.2. Sexual Harassment: Any acts, criminal in nature or otherwise, used to i nfluence or threaten the rights or privileges of a student, in exchange for sexual favors, and/or deliberate and/or repeated comments or gestures of a sexual nature.
5.2.3.3. Inappropriate Conduct: Any behavior of a contractor toward a student that would reasonably cause the student to feel uncomfortable or that would reasonably give the appearance of impropriety regardless of whether such behavior is complained of by the student, regardless of whether the behavior is overtly sexual, and/or regardless of whether such behavior would constitute a crime.
5.2.4. Be under the influence of intoxicants, drugs or medications that impair the senses during the performance of contracted services.
5.2.5. Use tobacco, eat, or drink at any time while performing contracted services. This i ncludes in and around contractor-operated vehicles, on school grounds, and on the installation. This further includes conduct that would result in the presence/scent of residual smoke on or around the transportation vehicle at the time of contracted services.
5.2.6. Give or sell beverages, food, tobacco products, or merchandise to passengers.
5.3. Contract Manager(s).
5.3.1. The contractor shall appoint a Primary and an Alternate Contract Manager who shall be responsible for the performance of work at each location. The contractor shall notify the COR in writing of the appointments within five (5) calendar days of contract award or prior to any replacement personnel assuming these duties.
5.3.2. The contract manager or alternate(s) shall have full authority to act for the contractor on all matters relating to daily operations of this contract.
5.4. Transportation vehicle Drivers and Safety Attendants.
5.4.1. All contractor drivers shall possess current, valid professional certifications and commercial driver’s licenses in accordance with Federal and state laws for the vehicle(s) driven.
5.4.2. The contractor shall provide all drivers and safety attendants with training on emergency evacuation procedures, safety of students, and student behavior management prior to the commencement of work under this contract. Proof of this training shall be provided to the COR prior to the commencement of work or upon request.
5.4.3. Contractor drivers and safety attendants shall be certified in a basic course in First Aid, including CPR.
5.5. Fort Campbell has a contractor entry system described as Rapid Gate. Participation in this system is solely with the contractor and all costs incurred will be with the contractor.
6.0. CONTRACTOR REPORT REQUIREMENTS.
6.1. The contractor shall submit and maintain the following reports to the COR:
6.1.1. Transportation Personnel List: Prior to the commencement of work, the contractor shall identify in writing, all personnel performing the transportation duties under this contract by name and position title/function and proof of required certifications. Updated lists shall be submitted upon change in staff prior to the commencement of work or as requested by the COR.
6.1.2. Actual Ridership Counts: The contractor shall count the total number of riders on each route each day for a three (3) day consecutive period consisting of a Tuesday, Wednesday and Thursday for each month. The contractor shall submit the ridership report to the COR not later than the 20th of the month after the ridership count is taken (e.g., October ridership count shall be due not later than Nov 20th). See Appendix 4.
6.1.3. Incident Report and Traffic Collision Report: The contractor shall report all incidents, injuries and accidents to the COR. Within one hour (1) of any/all such events, drivers shall make an oral report to the COR which shall be followed by a written report. Written reports shall be submitted to the COR within two working days of the incident, injury and/or an accident as follows:
6.1.3.1. For injuries and/or incidents (which includes damage to the bus caused by a student), complete and submit the School Bus Incident Report form. See Appendix 5.
6.1.3.2. For vehicular accidents, submit a copy of the state’s Traffic Collision Report.
7.0. GOVERNMENT FURNISHED FACILITIES. The Government will provide for official use only, bus storage space with adequate employee parking, a maintenance facility, and office space. The Government will provide the contractor electricity, water, trash disposal and sewage disposal. The contractor shall not make any alterations to the office space without specific written permission from the COR as coordinated and approved via the Civil Engineer work order. The contractor shall return office space to the Government in the same condition as received, fair wear and tear and approved modification excepted. The contractor shall only use the facility in the performance of the contract. The facilities are not guaranteed for the life of the contract and is subject to change depending on the Governments mission or space availability.
7.0.1. The Government will provide necessary keys and locks to safeguard government property.
7.0.2. Contractor shall store and dispose of hazardous waste/contaminated oil pursuant to local installation regulations. The contractor shall be responsible for all cleaning and decontaminating all fluid leaks.
7.0.3. Contractor shall properly clean and maintain government furnished property, equipment, and grounds.
7.0.4. Contractor shall provide connectivity access (Internet/cable), office equipment required for operations.
7.0.5 Contractor shall provide break room equipment such refrigerators, microwave, appropriate break room furnishings. All equipment must be Energy-Star rated if applicable.
8.0. CONTRACTOR QUALITY CONTROL. The contractor shall develop and maintain a quality control program/plan to ensure bus transportation services are performed in accordance with commonly-accepted commercial practices and services identified in this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-performance and continual repeat of defective service do not occur. The contractor shall make the plan available for review upon Government request to provide any updated plans to the CO and COR prior to implementationm of changes. The plan may be in any format that is appropriate for the contractor’s operations. The plan will follow established quality control standards recognized by the transportation industry. The plan shall include a description of the inspection system to cover all services required under this contract.
9.0. GOVERNMENT QUALITY ASSURANCE.
9.1. Meetings. The contractor, the Contracting Officer and the COR shall meet as often as necessary to exchange quality control information or to discuss opportunities to improve the contract, any modifications required of the contract, unsatisfactory inspections and valid customer complaints against each performance objective observed and steps taken by the contractor to prevent occurrences in the future. The contractor shall provide a summation of unsatisfactory inspections and customer complaints and provide insight into any identified trends. The COR will take the minutes of these meetings, put them in writing, signed by the attendees as deemed appropriate, and distribute to signers. Should the contractor not concur with the minutes, the contractor shall provide written notification to the CO, identifying areas of non-concurrence for resolution. Meetings shall include but are not limited to a post-award conference and any necessary transitional meetings.
9.2. Inspections/Surveillance. The Government reserves the right to perform inspections and surveillance to evaluate the contractor’s compliance to the contract terms and performance of the requirements in the PWS. The Government will make every effort to conduct the surveillance methods described below in an objective, fair, and consistent manner. The COR will use the contractor’s work schedule or a COR-approved contractor-modified version thereof to record validation results.
9.2.1. Incidental Observation. This action occurs when the COR or other Government official observes a deficiency.
Examples include evidence from accidents, incidents, or delays. Regardless of where in the line-of-duty the COR observes contractual procedures not being followed, the COR will document and report the deficiency to the Contracting Officer. The Government will issue a contract discrepancy report to the Contractor when services do not conform to contract standards, or exceed the maximum allowable defects for any service identified in the PRS.
Additionally, the Government will also issue a CDR in the event of any safety violation or hazardous situation endangering the facilities or health of individuals.
9.2.2. Customer Complaint. This action is instituted when the COR receives a complaint from a stakeholder (which includes parents, school staff, passengers or other concerned community members) regarding the bus service. The COR will obtain the complaint in writing and then conduct an investigation to determine its validity. If the complaint is deemed valid, the COR will immediately notify the Contracting Officer for action. The COR will notify both the Contract Manager and the complainant of the Government’s response to their complaint.
9.3. Government Remedies.
9.3.1. Emergency Substitution. In the event the contractor is unable to furnish transportation as scheduled, the Government reserves the right to hire emergency substitute bus services for such time as deemed necessary. The Government shall deduct from the contractor’s invoices, or at its discretion, may bill the contractor for any differences in costs for the emergency service, including any cost incurred in obtaining said services, and any other damages incurred by the Government as a result of the contractor’s failure to provide services.
9.3.2. Notification of Service Deficiency. For unsatisfactory or incomplete services, an Contract Discrepancy Report (CDR) will be issued within five (5) working days of knowledge of deficiency. The CDR will explain the circumstances and findings concerning the incomplete or unsatisfactory service, and will state the amount of any applicable deduction.
9.3.2.1. The contractor shall respond to, and return the CDR within two working days after receipt of the report.
Failure by the contractor to timely respond shall result in a final determination by the Contracting Officer without contractor input.
9.3.2.2. The Contracting Officer will make a final determination based upon the contractor’s timely response and, as needed, apply the appropriate deduction (see Attachment 2) and provide a copy to the contractor within seven working days of the contractor’s response submission or nine working days after CDR report date if no timely response is provided by the contractor.
9.3.2.3. The Government will use any completed CDR as part of an overall evaluation of contractor performance when determining present or future contractual actions.
9.3.3. Deductions. The contractor shall be subject to deductions for incomplete or unsatisfactory bus transportation services in addition to any other remedies authorized by the Government under the terms and conditions of this contract.
9.3.3.1. Deduction calculation.
9.3.3.1.1. Contractor shall be subject to deductions made on a per run basis. Should the contractor received multiple deficiencies recorded against all runs in the same day, the total deduction incurred shall not exceed 100% of the value of the affected day.
9.3.3.1.2. Example: Assume a deficiency occurs on a regular SY scheduled run on one day in the Base Year (CLIN 0001) and with a cost per day of $3000.
$3000/20 runs per day = $150 per run/day.
Under this assumption, an SD with a 20% rate of deduction would be $30.00. An SD with a 100% rate of deduction would be $150.00.
9.3.3.2. Schedule of Deductions. Failure by the contractor to perform critical performance elements in accordance with the PWS requirements are subject to the Schedule of Deductions stated in the Performance Requirement Summary (PRS) at Attachment 2.

PERFORMANCE WORK STATEMENT (PWS)
Kentucky District Transportation Contract
1.0. INTRODUCTION: To fulfill its mission, the Department of Defense Education Activity (DODEA) Domestic Dependent Elementary and Secondary Schools (DDESS) must provide safe, responsive, efficient transportation for eligible dependent students residing on Fort Campbell and Fort Knox military installations.
2.0. DEFINITIONS.
2.1. “Contract Managers (Primary and Alternate).” The individuals appointed by the contractor to act as his/her representative as responsible for all services performed under this contract.
2.2. “DoDEA Accommodation Plan.” A plan developed for students with special needs in accordance with Department of Defense Regulation (DoDR) 2500.14.
2.3. “Extended School Year (ESY).” A summer education program for students conducted during the months of June and July that is approximately twenty (20) days in length at Fort Knox and twenty (20) days in length at Fort Campbell.
2.4. “Individual Education Program (IEP).” A program developed for special education students in accordance with Department of Defense Instruction (DoDI) 1342.12 designating which services a student shall receive.
2.5. “Other authorized individuals.” U.S. Military Police and those persons authorized in writing by the Contracting Officer (CO) or the Contracting Officer’s Representative (COR) or Alternate COR.
2.6. “Safety Attendant.” Attendant authorized on vehicles transporting students to/from school. Normally only one Safety Attendant is assigned to a vehicle. Safety Attendants are specially trained adults whose primary responsibility is to oversee on-board student safety during the daily commute to/from school.
2.7. “Safety Attendant for Special Education (SPED).” Attendants authorized to accompany students with disabilities if the student’s IEP specifies the need for one-on-one adult supervision or that special needs assistance is required when the student is being transported to/from school. Safety Attendants (SPED) are adults with special training that equips them to supervise or assist students with disabilities/special needs identified in their IEP.
2.8. “Walking area.” 1.5 miles for secondary students and 1.0 miles for elementary students to the assigned school, unless a major thoroughfare presents a safety hazard.
