PERFORMANCE WORK STATEMENT

PERFORMANCE WORK STATEMENT (PWS)

Department of Defense Education Activity (DoDEA) - Domestic Dependents Elementary and Secondary Schools (DDESS)

1. GENERAL

1.1. INTRODUCTION: This is non-personal services Indefinite Delivery Indefinite Quantity (IDIQ) contract to provide Board Certified Behavior Analyst Services (BCBA) at the West Point Schools (WPS) in New York. For purposes of this PWS, services are to be rendered at the WPS and at specific residences of students needing BCBA intervention services if such need arises.

1.2. Scope/Description of Services: The Contractor shall fulfill all BCBA service requirements for the WPS. The Contractor shall provide all personnel, equipment, supplies, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform BCBA services as defined in this PWS except for those items specified as government furnished property and services. The contractor shall perform to the standards in this contract. For purposes of this contract, Board Certified Behavior Analyst (BCBA) services shall include services rendered by persons having already completed BCBA certification in its entirety.

1.2.1. BCBA Services: Services needed for specific, targeted interventions and support to students with varying identified impairments; including, but not limited to, Autism Spectrum Disorder, Emotional Impairments, and Developmental Disabilities. BCBAs shall be certified by the Behavior Analysis Certification Board and shall work under the supervision of a certified BCBA serving in an Administrative capacity within the Contractor’s employ and in correlation with and per instruction from the Special Education (SPED) Instructional Systems Specialist (ISS).

1.2.2 The BCBA under this contract shall not provide other ABA services to the same student outside the scope of this contract. Other ABA services outside the scope of this contract include ABA services for medical treatment, as opposed to ABA services for the educational needs under the student’s IEP.

1.3. Background: The provision of BCBA services is a new requirement and is not yet one of the services mandated under DoD Instruction 1342.12. “Provision of Early Intervention and Special Education Services to Eligible DoD Dependents.” April 11, 2005. BCBAs are experts in behavior analysis and interventions, and are certified by the Behavior Analysis Certification Board. The Case Study Committee (CSC) is responsible for determining if a student requires BCBA intervention services in accordance with required assessment components.

The required services must support the educational needs of the student rather than the medical needs of the student.

The CSC is made up of Government officials and possesses the final determination of a child’s needs.

1.4. Objectives:

1.4.1. BCBAs will provide technical assistance to teachers, related service providers, and paraprofessionals in order to guide:

1.5. IDIQ/Period of Performance: The IDIQ for these services will have a duration of five (5) years: from August 2013 to August 2018. Within the duration of the IDIQ, the Government will have the ability to procure the number of sessions needed to fulfill future requirements of BCBA services needed at either West Point School.

1.5.1. The number of sessions for a particular task order shall be specified in each task order. Services for a task order shall begin at the date specified in the particular task order. See Technical Exhibit (TE) 4 for historical session needs per week. See Technical Exhibit (TE) 5 for historical session needs per week. The Government recognizes this to be a rapidly expanding area for Special Education and therefore could experience growth in this requirement.

The actual weekly need within a task order may vary from the figures stated in the technical exhibit.

1.5.2. During the regular school year, the Contractor shall provide the number of sessions per week/per month specified on the specific task order. In a given day and/or week, the Contractor shall not provide services over the sessions stated in the task order in which those services are assigned.

1.5.3. Task Order Response time: The Contractor shall respond to submitted task orders against this IDIQ by providing the services within two (2) weeks from the date that the Contractor received the respective task order or the date specified in the task order, whichever is later.

It is the responsibility of the Contractor to maintain updated copies of the school calendars for the West Point Schools. Calendars may be obtained from the SPED ISS. 1.9. Case Study Committee (CSC): Pursuant to Department of Defense Instruction 1342.12, the CSC is the legally required team that determines and maintains specific written procedures which comprise the mandated Individual Education Program for all students that receive special education services. The CSC ensures that parents are cognizant of all procedural safeguards (e.g., confidentiality, protections in evaluation, due process, and least restrictive environment), and that school personnel follow the procedural safeguards in the process. While there may be additional members depending on the needs of the individual student, every CSC includes: the school administrator; a general education teacher who works with the child; the child’s special education case manager; and the child’s parent. The Government will not pay a price it considers to be disproportionate to the benefits associated with the proposed service. The Government may select for award the offer in which the total proposed cost is not necessarily the lowest, but whose overall proposal is deemed sufficiently more advantageous to the Government so as to justify the payment of a higher cost. Conversely, the Government may select for award the offeror whose total proposed cost is the lowest, when other proposals are not sufficiently more advantageous so as to justify the payment of a higher cost. The Government will not award to an offeror rated less than “acceptable” for technical or “limited confidence” and/or “somewhat relevant” for past performance. The following shall be used to evaluate offers:

Evaluation Factors:

1) Price

2) Technical

1. Experience: Offeror is able to provide BCBAs who:

ABA issues, including, but not limited to:

i. Development of Functional Behavior Assessment and Behavior Intervention Plans;

ii. Development of Individualized Education Plans

iv. Development and implementation of data collection procedures, including trend analysis, and progress monitoring;

v. Parent training if needed.

2. Supervision: BCBAs have obtained official certification from the Behavior Analyst Certification Board (BACB). The evaluation will include an examination of the offeror’s list of the BCBAs and the required copy of the certification for each BCBA listed to perform under this contract.

3) Past Performance: The overall evaluation will also take into account past performance information, including past contract actions, information on problems identified on contracts and offeror’s corrective actions. The past performance evaluation will result in an assessment of the offeror’s probability of meeting the solicitation requirements. The past performance evaluation considers each offeror’s demonstrated recent and relevant record of performance in supplying services that meet the contract’s requirements. In addition to the specific contracts provided by the Offeror, evaluation of past performance will also involve an examination of any information pertaining to the offeror on the Past Performance Information Retrieval System (PPIRS). One performance confidence assessment rating will be assigned for each offeror after evaluating the offeror’s recent past performance, focusing on performance that is relevant to the contract requirements. The relevancy rating will be based upon: similarity of service/support, complexity, and dollar value. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror will not be evaluated favorably or unfavorably on past performance.

The technical and past performance factors when combined are of equal significance when compared to price.

Within the Technical Factor, the sub factors are equal.
