About this file

Helena Boat Chute Portage Trail Improvements

This file contains bid drawings, technical specifications, and permit documentation for the Helena Diversion Portage Trail Improvements project administered by Colorado Parks and Wildlife (CPW) at the Arkansas Headwaters Recreation Area near Buena Vista, Colorado. The project scope includes constructing a portage trail with boulder retaining walls, replacing and repairing pedestrian aggregate trails, installing in-channel boulders for eddy assistance, protecting riverbanks, and relocating rock stairs. The work encompasses site access and staging, portage trail surface construction with options for aggregate or flat boulder surfaces, trail entrance enhancements with multi-boulder retaining walls, channel boulder placement at two locations, and bank protection measures. The pre-bid conference was scheduled for Tuesday, February 28, 2017, at 10:30 a.m., with bid opening on Thursday, March 9, 2017, at 1:30 p.m. The contract includes base bid items such as mobilization, earthwork, aggregate and rock placement, geotextile fabric installation, and seeding and mulching, with alternate bid items for flat boulder trail surface replacement. The project site involves work on Colorado Parks and Wildlife property and adjacent private property (Lot 7), requiring coordination with the property owner and CPW representatives.

The project is funded through Colorado Parks and Wildlife Fund 1720, Appropriation Code PC002INFP, Project ID AR-501. No Section 404 permit from the U.S. Army Corps of Engineers is required, as the work qualifies as exempt agricultural repair and maintenance work under the Clean Water Act exemption, confirmed by correspondence dated June 25, 2015. The contractor is responsible for obtaining all necessary permits, insurance, and bonds as part of mobilization costs. Key requirements include compliance with Colorado Water Quality Control Act standards, erosion and sediment control measures, equipment cleaning for aquatic concerns, and the submission of as-constructed and record documents. Specific material specifications require dense, sound rock with bulk specific gravity not less than 2.5, and geotextile fabric meeting AASHTO standards. The contractor must maintain temporary pollution control measures, avoid disturbance to designated existing trees and embankments, and coordinate all work through the CPW Project Manager or authorized representative, with strict prohibitions on using private property resources or accepting direction from property owners.

Hi Van, Thanks for speaking with me again this afternoon regarding this project.

Again, I am basically just looking for an email from you stating roughly that we can go ahead and perform the work needed to the subject area under the same agricultural exemption that was provided for the first phase of this project. The work that we are proposing now is really maintenance and some improvements to the recently constructed portage trail and diversion ditch because certain areas aren't performing as well as originally anticipated. We are planning to remedy the issues observed.

I believe this work should still fall under the same 404 exemption because it really is just repair work, but if you could I'd really appreciate your review and perhaps an email that I can have for my file indicating that the original exemption still applies.

I have the original letter referencing Action No. SPA‐2013‐00113‐SCO. If you would like that forwarded for review, please let me know.

Thanks for helping out on this, Tony

Truan, Van A SPA <Van.A.Truan@usace.army.mil> Thu, Jun 25, 2015 at 7:25 AM To: "Brindisi - DNR, Tony" <tony.brindisi@state.co.us>

Tony, As we discussed, the repair work on the agricultural intake structure on the Arkansas River near Buena Vista is exempt from our regulations, thus a Section 404 permit is not required from the Corps of Engineers.

If you need anything else, let me know.

Van
