SUMMARY OF CHANGES

SECTION SF 30 - BLOCK 14 CONTINUATION PAGE

The following have been added by full text:

QUESTIONS & ANSWERS #0001

The following questions were submitted in reference to solicitation HDEC05-15-R-0003:

1. What is unit of issue and case pack for CLIN 6425 and CLIN 9219 for cluster J?

Item information has been corrected on the Solicitation Pricing Sheet. NOTE: Offerors must use the corrected Solicitation Pricing Sheet attached to this amendment for submission. (Amendment #1)

2. Confirm all items marked deli/bakery will stop being ordered from the commissary at some point during the 5 year contract?

Not all items marked deli/bakery will stop being ordered from all commissaries during the 5 year contract period. If all four (4) option years are exercised, then the contract will expire on August 31, 2020. According to the solicitation (See “DELI-BAKERY CHANGES”) some stores will not convert to new deli-bakery contracts until after the expiration date of August 31, 2020. Please note that among those stores listed to convert prior to August 31, 2020, some conversions may be delayed until after August 31, 2020 due to unforeseen issues.

3. Does "country of origin" refer to where the company is located or where the product is manufactured?

“Country of Origin” refers to the country where the product is manufactured.

4. Must product components also meet "country of origin" standard?

In requesting “Country of Origin” on the Solicitation Pricing Guide, it is DeCA’s intention to determine whether or not supplies purchased under any ensuing contract will comply with DFARS 252.225-7021, “Trade Agreements—Basic.” The awardee has the obligation to comply with all terms and conditions of the contract, including DFARS 252.225-7021, which provides the answer to this question based on the source country.

5. Is it ever permissible to substitute product? If a commissary orders a product off of the order guide and due to internal inventory issues, we are short product. Is it then permissible for the vendor to provide a substitute product?

All items provided by the contractor must meet the specifications as outlined in the contract. Substitutions that do not meet the specifications as outlined in the contract are not allowable.

6. Since payment by government credit card causes the vendor to incur an additional transaction fee of approximately 2.5%. Can the vendor choose a different form of payment from the government? Or is it absolute that the government will be paying by government credit card for all purchases associated with this solicitation?

All payments will be made by Store or CDC level Government Purchase Card (GPC Credit Card). No other form of payment will be authorized.

7. The solicitation identifies that throughout this solicitation, service contracts will be awarded to Deli Bakery contractors servicing commissary clusters causing 141 items to fall off of the contract. Whereby, reducing the product volume and cube for freight, will additional items be added to the solicitation award making up for this volume/cube shortfall?

No items will be added for stores converting to new Deli-Bakery contracts solely to make up any changes in freight volume.

Note that other changes to the supply list may be made by bilateral modification for additions, or by unilateral modification (with at least 60 day notice) for deletions. Also, designation as deli-bakery only or non-deli-bakery only items may change throughout the term of the contract.

8. Page 85, sub paragraph d) product samples. Will DeCA also be requesting unopened boxes of samples in original packages to ensure Trade Agreement Act, “Country of Origin” compliance?

Initially, single item samples will be checked for adherence to specifications. If there is an indication that a contractor is supplying items from unallowable source countries, DeCA reserves the right to require whatever is necessary from the contractor in order to verify that the item(s) provided is/are from allowable source countries, including but not limited to, providing whole, unopened case packs as samples.

9. Since Far 52.225-13 and 252.225-7021 are listed on pages 79 and 80 of the solicitation and “Country of Origin” is now also required to be listed for all manufactured product. Due to the potential for both civil and criminal penalties, does the “False Claims Act” also apply for non-compliance?

The False Claims Act (FCA) applies to all contracts with the federal government.
