FATS AND BONES REMOVAL AND DISPOSAL

Contractor’s Responsibility General: The Contractor shall provide all personnel, supervision, equipment, transportation and services necessary to perform the removal/pickup/disposal of fats and bones from the Defense Commissary Agency (DeCA) Commissary location(s) identified in the solicitation and resulting contract.

Personnel: This is a service contract and shall require contractor employees to identify themselves as contractor personnel by introducing themselves, or being introduced as contractor personnel and displaying distinguishing badges or other visible identification for meeting with Government personnel. The contract requires contractor personnel to appropriately identify themselves as contractor employees in telephone conversations and in formal and informal written correspondence.

Compliance with Environmental Protection Agency (EPA), state and local regulations: Contractor is required to comply with all local, state and federal regulations applicable to the removal, transportation, and disposal of the fats and bones. The contractor shall, without additional effort by or cost to the Government, maintain and acquire all permits in accordance with local, state and federal regulations. All charges, fees or permits pertaining to providing, maintaining, emptying, transporting and dumping such containers shall be included in the Contractor’s price for the service.

Sanitation and Maintenance: All equipment, including trucks, and containers will be kept in a clean and well-maintained condition. The contractor shall be responsible for the cleaning of any spillage that occurs during the transport of fats and bones, in and around all facility(s), roads and highways while in route to the final destination for the materials.

Deteriorated containers (i.e., excessive rust, lids not operating correctly, exterior damage, etc.), or containers damaged by the Government, will be replaced by the contractor at a reasonable cost (approximately $30.00 per container). Containers damaged by the contractor shall be replaced at no cost to the Government. In addition the contractor shall furnish replacement containers for each one that is removed for maintenance or repair.

Prior to departing the commissary, the contractor will return the work area to the condition it was in prior to start of work, removing any material or debris which resulted from performing the work.

Use of Materials: Use of the materials must be in a manner that is legal within the laws and ordinances of the local, state and federal government of the final destination where the material is to be processed. The objective of this program is to reduce the amount of material going to the commercial landfill. The contractor is expected to make all reasonable efforts to dispose of these products in an environmentally sound manner while being in compliance with the laws and ordinances of the local, state and federal government for disposal of the material.

Contractor Provided Equipment: The contractor shall provide all necessary equipment required for the performance of this contract. All container(s) shall meet industry standards and shall be leak proof and free from rust. The lids shall be odor sealing, easy to open and close and in good operating condition. The contractor will provide and maintain in good working condition, the fats and bones containers/equipment and will pickup and empty said equipment. The contractor shall provide containers that prevent wild animals from being able to gain access to the container(s).

Containers shall be clearly marked with at least one (1) inch lettering indicating the type of material that is to be placed in the container(s) for example Fats and Bones only.

The contractor is responsible for providing a sufficient number of containers for fats and bones collection at each of the stores identified in the solicitation and resulting contract.

Vehicles: The contractor shall provide all vehicles required to fulfill the requirement. All vehicles shall be in operable condition and meet all local, state, and federal safety requirements. The contractor shall obtain all necessary permits for base access in accordance with the Installation Access Requirements found at 52.204-4500 of this contract.

Containers shall be secured to the truck to prevent them from overturning or falling off the truck. Trucks shall be conspicuously marked indicating the contractor’s name and phone number.

Pickup Requirements: The contractor shall pickup from the facilities based on a per pickup basis with the overall frequency schedule identified for each location not to exceed the frequency of pickups identified on the Annual Estimated Volume Requirements Attachment 1, and in the resultant contract, with the exception of any Federal holidays when the commissary is closed. In this case pickup must be done on the next business day. The exception to the established pick up schedule is in the case of acts of God, natural disaster or power failures. During the time of a natural disaster (if the commissary is functioning) the contractor is to make every reasonable effort to pickup material from the commissaries at the frequency stated in the schedule. A normal pickup schedule should be resumed when normal operations resume for that installation.

The contractor is required to provide either a sequentially numbered and/or dated pickup ticket at the time of every pickup which indicates, at a minimum, the number of containers that were picked up. The contractor is also responsible for signing a DeCA Form 70-61 at the time of each pickup. The 70-61 will indicate the number of containers of fats and bones that were picked up. The contractor shall retain one copy of the DeCA 70-61 for his records and the store will retain the original.

Missed or Additional Pickups: The contractor shall be required to collect the fats and bones within 48 hours after a missed pickup. A missed pickup may occur if the installation is closed for inclement weather or security lock down. Additional pickups may be required at the discretion of the Store Director, in no situation however shall the number of pickups during any given work week exceed one.

Contaminated Material: If the contractor determines that material that is picked up from one of the commissaries is contaminated he is to immediately notify the commissary store director of the contamination. He is to identify the material that caused the contamination. The contractor is required to dispose of the contaminated material in accordance with local laws and ordinances. If the there are more than three incidents within a 30 day period then the contracting officer is to be notified. Notification shall include pictures indicating the type of contamination and a recommendation to prevent it from happening in the future.

Reporting Requirements: The contractor shall provide a monthly report for the prior month to the Evironmental Division (POC to be provided at time of award) by the 15th of each month indicating the number of pounds of material picked up from each commissary. The monthly report shall also identify the following:

a) The total number of pounds picked up and the commissary location

b) Any material picked up that was considered to be contaminated and why

c) The amount of material that was not diverted and was sent to the landfill

ADDENDUM TO FAR 52.212-1

INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS

I. SUBMISSION OF QUOTES: Reference 52.212-1 Paragraph (b)

North American Industry Classification System (NAICS) Code applicable for this solicitation is 311613 and the Size Standard is 500 employees.

If the size determination is based on the number of employees, the method for determining business size status is based on the average number of employees of the concern (including part-time and full-time employees of its domestic and foreign affiliates), which is based upon the number of employees for each of the pay periods for the preceding completed 12 calendar months. [Additional definition is available by searching 13CFR121 at http://www.gpoaccess.gov/cfr/index.html] (13 CFR 121.106) Quoters shall submit an original copy of the following documents:

(1) Standard Form 1449, Solicitation/Contract/Order for Commercial items, Page 1, Blocks 17a, 17b (if applicable), 30a, 30b, 30c completed and signed by an authorized representative on behalf of the quoter. Discount terms, if any, in Block 12.

(2) Schedule of Supplies/Services at Attachment 1, to include price per pickup, for each location on which you are submitting an offer to include the base year and all option periods. Complete the excel spreadsheet electronically and submit a pdf copy via email with your offer. (Formulas are contained in the spreadsheet to calculate totals)

(3) Prospective contractors shall complete the annual representations and certifications electronically at the System for Award Management (SAM) website available at https://www.acquisition.gov and must indicate their business size for the applicable NAICS code.

(4) Complete and return the following clauses:

--FAR clause 52.209-7 Information Regarding Responsibility Matters (FEB 2012) Pages 149-150.

--DFARS clause 252.209-7999 Representation by Corporations Regarding an Unpaid Delinquent Tax Liability or a Felony Conviction Under Any Federal Law (DEV JAN 2012) Pages 162-163.

--DFARS Clause 252.212-7000 Offeror Representations and Certifications-Commercial Items (JUN 2005) Pages 163-164.

(5) Submit the following information:

a. Technical – The offeror is required to provide the information below in a written statement to explain their technical capability. A written response is required for each item.

i. Ability to provide pickups of fats and bones for the locations in your offer in accordance with regulations.

1) Submit a written statement to explain the intended use of the material removed from our facility.

2) Submit a statement to explain how your firm will utilize pickup methods that are in keeping with the local, state, and federal laws and regulations governing the disposal of fats and bones for which you are submitting a proposal.

3) Explain methods that you will employ for taking care of additional or missed pickups as required?

ii. Ability to provide proper containers and equipment and maintain the same in accordance with the Statement of Work

1) Submit a picture or drawing/schematic of the type of sealed container that you will be providing to the store for the pickup of the fats & bones in accordance with the Statement of Work.

iii. Reporting Requirement

1) Provide an example of the monthly report that your company will submit in accordance with the Statement of Work reporting requirement.

b.

Past Performance References: Three (3) past performance references must be submitted that are most similar to the work of this solicitation that you have performed in the past three years. The past performance references will be used to determine whether an offeror has relevant past performance, by similarity of work, complesity, dollar value, contract type, and degree of subcontracting. Performance will be evaluated based on timeliness, customer satisfaction, and business relations with your customers.

1) The attached past performance survey (Attachment 2) must be completed and submitted directly, from your reference, to the contracting office via email to lois.malone@deca.mil or by fax to 804-734-8009 pp 76062 (pp=pause pause).

2) Past performance references must be submitted by the closing date of the solicitation. Surveys provided directly by the offeror will not be considered.

DeCA reserves the right to consider any other past performance information available to the Government such as PPIRS or other databases.

II. PERIOD FOR ACCEPTANCE OF OFFERS: Reference 52.212-1 Paragraph(c)

The Government requires a minimum acceptance period of 90 calendar days in lieu of the 30 calendar days as specified in FAR 52.212-1(c), Period of Acceptance of Offers. The Government will not award a contract to an offeror allowing less than the Government’s minimum acceptance period.

III. SITE VISIT:

A site visit to access the facilities may be scheduled by calling the point(s) of contact listed in the Item No description located at the commissary. [(Reference 52.237-1 Site Visit (April 1984)]

IV. NOTICE OF AWARD:

A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful quoter within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quoter's specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

IMPORTANT NOTICE

Upon award of this contract, the Agency intends to make available to the public the total contract award amount, as well as any awarded individual contract line item pricing (CLIN and Sub-CLIN) either by posting within the Agency's electronic reading room located @ www.commissaries.com or upon request.

Unexercised Option year prices will not be published.

This action is being taken to ensure contract award information is available to the general public, as it was in the past, pursuant to the President’s January 21, 2009 memorandum regarding the Freedom of Information Act (FOIA).
