SECTION SF 30 BLOCK 14 CONTINUATION PAGE

The following items are applicable to this modification:

REVISE ADDENDUM/TDS/ITEMS

The purpose of this amendment is to change the specifications of the beef items and remove the requirement for blocked cut beef products from the solicitation in its entirety. This change represents a significant change to the solicitation affecting several areas within the document. The following applies:

1. Solicitation Point of Contact (POC):

2. The following are additions to the CLINS:

a. Group 13 has been added to include the following 11 MW stores: Corpus Christi, Dyess, Fort Hood 1, Fort Hood II, Fort Sam Houston, Goodfellow, Kingsville, Lackland, Laughlin, Randolph and Fort Worth.

b.

Group 14 has been added to include the following 11 MW stores: Altus, Cannon, Fort Bliss, Fort Sill, Holloman, Kirtland, McConnell, Sheppard, Tinker, Vance and White Sands.

c.

Group 15 has been added to include the following 11 MW stores: Buckley AFB, Ellsworth, F.E. Warren, Fort Carson, Fort Leavenworth, Offutt AFB, Minot AFB, Fort Riley, Peterson AFB, Grand Forks, and USAF Academy.

3. The following are changes to Addendum to FAR 52.212-1, Instructions to Offerors – Commercial

Items:

a. On page 63 of 167, Questions Relating To This Solicitation: the last sentence has been changed to read: The contract specialist will accept written questions from prospective offerors by facsimile at (804) 734-8009 pp 78922 (pp=enter pause key symbol twice) or by E-mail to diane.moore@deca.mil.

b. On page 63 of 167, Business References, section a, the date has been changed to read: This information is requested by 4:00 p.m. EST/LOCAL Time (Fort Lee, VA), November 13, 2009.

c. On page 63 of 167, Business References, section b, the date has been changed to read:

The completed survey is requested by 4:00 p.m. EST/Local Time (Fort Lee, VA)/EST, November 20, 2009.

d. On page 67 of 167, Pricing Line Items, change the 3rd paragraph, first sentence to read the following: An offeror must submit a price (Special Factor or Unit Price, as appropriate on all line items, including all beef and pork items, within a Group in order to be considered for contract award, except Special Buy line items. For further details on special buys, see Addedum to FAR 52.212-4, paragraph 18).

e. On page 68, of 167, second paragraph, change the first sentench to read the following:

The Base Prices have been filled in for you on the spreadsheet and are based on the weighted-average prices from the USDA Weekly National Carlot Report for the week ending October 24, 2009.

The following are changes to Addendum to FAR 52.212-4, Contract Terms and Conditions –

Commercial Items:

a.

On page 76 of 167, Scope, paragraph 1, sentence 7, change to read the following: Product must conform to the Technical Data Sheet (TDS) for DeCA’s Beef Products dated September 2009 and DeCA’s CONUS Fresh Cut Pork and OCONUS Fresh Cut Pork Products, dated June 2009.

b.

On page 76, Period of Performance, CLINS have changed from 12 to 15 to reflect the following: Base Period includes CLINS 0001-00015, Option Year One includes CLINS 1001-1015, Option Year Two includes CLINS 2001-2015, Option Year Three includes CLINS 3001-3015.

c.

On page 76, Web Pricing the first sentence. The line items for Groups 6 through 12 has been changed to read the line items for Groups 6 through 15.

d.

On page 78, Order/Delivery Lead Time has been changed to read the following: the preferred order lead time for order placement for product to CONUS locations is 7 days prior to delivery. The preferred order lead time for AK and HI is not more than 14 days prior to delivery. The preferred order lead time for OCONUS locations is determined by the DRD (Demand Receipt Date), however delivery to the POE shall not be any earlier than 3 days prior to the sail date.

e.

On page 79, Delivery Schedule for Groups 6 through 12 has been changed to read Groups 6 through 15.

f. On page 80, Delivery Requirements for Groups 6 through 12 has been changed to read through 15. (c) Delivery of beef products will be made in the manner prescribed within the Technical Data Sheet (TDS) for DeCA’s Beef Products dated September 2009 and DeCA’s Pork Products, dated June 2009, Attachment E.

g. On page 85 of 167, (d) Mandatory Requirement to Provide Backup Suppliers has been added to read the following: The contractor is required to provide all ordered products to all commisary locations without shortages when ordered. Contractors are required to maintain backup sources of supply that are prepared to provide comparable products in the event that their procesing plant production or stock assortment at their distributor fails to provide any product that may be shorted. The contractor shall notify the affected commissary location (s) prior to delivery of any product (s) that will be provided by a backup supplier ensuring compliance with appropriate appointments and security requirements. The contractor shall identify the backup source and ensure the delivery is made to the affected commissary location not later than 24 hours from the original delivery date. Products provided by backup sources of supply will be at no additional cost to the government.

h. On page 87 of 167, The Delivery Method has been changed to read the following: the delivery method for Groups 6 through 15 will be Direct Store Delivery – single (DSD-S) and billing will be on a per call and delivery basis.

i. On page 87 of 167, Special Buys, paragraph 19, sentence 2, change “GW” to “GE”.

j. On page 91 of 167, ATTACHMENTS, change Attachment E to read the following: Technical Data Sheet (TDS) for DeCA’s Beef Products dated September 2009 and DeCA’s CONUS Fresh Cut Pork Products and OCONUS Fresh Cut Pork Products, dated June 2009.

The following are changes to the Attachments:

a.

Attachment A –Sample Business Reference Letter and Past Performance Survey has been changed to read the following: Any questions regarding the survey should be directed to Diane Moore (804) 734-8000, ext. 48922. Return the completed survey to DeCA no later than 4:00 p.m. EDT/EST, November 20, 2009 via facsimile, email or regular mail to the address that follows:

Attachment B has been replaced with a new Delivery Schedule to include the additions of Group 13, Group 14 and Group 15.

c.

Replace Attachment D with the revised version to Shelf Life to delete the Block Cut Beef items.

d.

Replace Attachment E with the updated version Technical Data Sheet (TDS) for DeCA’s Beef Products dated September 2009 and DeCA’s CONUS Fresh Cut Pork Products and OCONUS Fresh Cut Pork Products, dated June 2009. In addition, statement has been added to include: All tray ready items will have soaker-pads properly added to eliminate normal purge.

e.

Replace Attachment G with the revised version entitled Amendment 0002. Please note: the spreadsheet has been completely revised. Offerors are required to submit the revised version of the Schedule of Supplies/Pricing Spreadsheet entitled Attachment G – Amendment 0002 with their proposal.

The following are changes to the CLAUSES INCORPORATED BY FULL TEXT:

a.

On page 92 of 167, an IMPORTANT NOTICE has been added to read the following: Upon award of this contract, the Agency intends to make public the total contract award amount, as well as any awarded individual contract line item pricing (CLIN and Sub-CLIN), within the Agency’s electronic reading room located @ www.commissaries.com. Unexercised Option year prices will not be published. This action is being taken to ensure contract award information is available to the general public, as it was in the past, pursuant to the President’s January 21, 2009 memorandum regarding the Freedon of Information Act (FOIA).

b.

On page 123 of 167, Clause 52.216-18 ORDERING (OCT 1995) reads as follows: (a)

Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from April 4, 2010 through September 27, 2015.

c.

On page 125 of 167, Clause 52.216-21 REQUIREMENTS (OCT 1995) reads as follows:

(f) Any order issued during the effective period of this contract and not completed within the period shall be completed by the contractor within the time specified in the order. The contractor shall govern the Contractor’s and Government’s rights and obligations with respect to that order to the same extent as if the order were completed during the contract’s effective period; provided, that the Contrctor shall not be required to make any deliveries under this contract after September 27, 2015.

d.

On page 125 of 167, Clause 52.216-4504 BASE PRICE & SPECIAL(MEAT ITEMS)

(2) The base prices to be used in the evaluation of offers will be the weighted average prices for the week of October 24, 2009 or the most recent weekly weighted average report at the time of evaluation if later.

7.

The date and time for receipt of offers (Block 8 of the SF 1449) will be extended to November 30, 2009, 4:00 p.m., Local Time (Fort Lee), EST.

All other terms and conditions remain unchanged.
