EXHIBIT A – Scope of Work
1. BACKGROUND AND PURPOSE
The Department of Developmental Services (DDS) is responsible for overseeing the coordination and delivery of services and supports to over 400,000 Californians with developmental disabilities, including cerebral palsy, intellectual disability, autism, epilepsy, and related conditions.
DDS is required to provide equal access to its programs, services, and activities to all people that have limited-English proficiency in accordance with the Dymally-Alatorre Bilingual Services Act (Government Code Section 7290-7299.8), Title VI of the Civil Rights Act of 1964, Executive Order 13166 (“Improving Access to Services for Persons with Limited English Proficiency”), and Section 1557 of the Patient Protection and Affordable Care Act (including its implementing regulations in Title 45 of the Code of Federal Regulations, Part 92). DDS is also required under Title ll of the Americans with Disabilities Act of 1990 and Section 504 of the Rehabilitation Act of 1973 to ensure equal access to its programs, services, and activities for people with disabilities, including providing auxiliary aids and services to assist in effective communication.
It is DDS’ policy to provide equal employment opportunity to all employees and job applicants, including providing reasonable accommodation to qualified individuals with disabilities to enable them to perform the essential functions of their position and participate in all aspects of the employment process.
2. SCOPE OF WORK
A. Contractor shall provide written translation, oral interpretation, telephonic interpretation, captioning, and transcription services for DDS on an as-needed basis.
B. Contractor shall provide services to individuals and groups of varying size either on-site, at various locations and venues throughout California, or virtually, as specified by DDS.
C. Contractor and all assigned service providers (translators, interpreters, captioners, transcribers, etc.) shall provide services in a manner consistent with Attachment A to Exhibit A, “Code of Ethics, Professional Conduct, and Confidentiality.”
3. SERVICE REQUESTS
A. Contractor shall provide DDS with an itemized price quotation for review via e-mail within 24 hours of receiving a service request from DDS.
B. Contractor shall not begin work on a service request without prior written approval from DDS.
C. Contractor shall be required to accommodate service requests that may require an expedited turnaround.
4. WRITTEN TRANSLATION SERVICES
A. Contractor’s written translation services shall include, but not be limited to, the following languages:
Arabic Armenian Cambodian, Mon-Khmer Chinese (Simplified/Traditional) Hmong Korean Lao Persian Russian Spanish Tagalog Vietnamese
B. Contractor shall provide written translation of various materials including, but not limited to, applications, brochures, correspondence, directives, forms, guidelines, manuals, presentations, publications, reports, surveys, and web content.
C. Contractor shall ensure, at the time of translation, that assigned translators possess a current and valid certification through the American Translators Association (ATA) or a documented equivalent, or that a Bachelor’s Degree in Translation and Interpretation has been conferred from an ATA-approved school. In the event written translations are completed by uncertified or non-degree holding translators, Contractor shall ensure that the final written translation has been reviewed and approved by an appropriately qualified translator before submitting it to DDS. Contractor shall furnish proof of a translator’s certification or degree to DDS with the delivery of each written translation.
D. Contractor’s translations shall reflect the content, format, layout, and numbering of the original source material, where applicable, and shall be consistent with applicable DDS templates, style manuals, correspondence guidelines, and any other direction provided as part of a service request.
E. When more than one possible translation exists, Contractor shall emphasize
“meaning for meaning” rather than “word for word,” unless otherwise directed by DDS. Contractor’s translations shall reflect the use of words, terms, and phrases that most closely approximate plain language—writing that is easy to read, understand, and use. Whenever possible, DDS shall attempt to provide the Contractor with an electronic file of the source document(s) that can be edited using word processing software, such as Microsoft Word. However, DDS may not be able to furnish editable, electronic files of all source documents every time it receives a translation request. In these situations, DDS may transmit materials to Contractor for processing in the format in which they were originally presented to DDS or as scanned portable document format (PDF) files. Contractor shall be required to navigate and convert various file formats, where applicable.
F. Contractor shall ensure that all written translations intended for posting on DDS’ web site or that are otherwise intended for mass public distribution are accessible to all people. Contractor shall incorporate into its final written translations applicable accessibility features described in the Web Content Accessibility Guidelines (WCAG) 2.2 (https://www.w3.org/TR/WCAG22/), such as the use of alternative text for images, proper tagging for screen readers, and appropriate color contrast. Contractor shall ensure that its written translations are evaluated for accessibility using accessibility checkers included in software products.
G. Contractor shall ensure that any information it translates for DDS that may be confidential under federal or state law including, but not limited to, the Health Insurance Portability and Accountability Act (HIPAA), HIPAA regulations, Health Information Technology for Economic and Clinical Health Act (HITECH), and Welfare and Institutions Code Sections 4514 and 5328, et seq., will remain confidential and be appropriately safeguarded in accordance with DDS’ business associate agreement the Contractor is required to sign.
H. Machine generated translations are not allowed.
https://www.w3.org/TR/WCAG22/
I. Contractor shall deliver written translations to DDS within 5 business days of receiving approval to proceed, unless otherwise directed. If, after reviewing a service request, Contractor anticipates a written translation will require more than 5 business days to complete based on its size and/or scope, Contractor shall propose a reasonable turnaround time on a case-by-case basis, subject to approval by DDS.
J. Failure to complete written translations in a timely manner, or as specified, may be grounds for terminating this agreement.
5. ORAL INTERPRETATION SERVICES
A. Contractor’s interpretation services shall include, but not be limited to, the following languages:
American Sign Language
Armenian Cambodian, Mon-Khmer Chinese (Mandarin/Cantonese) Hmong Korean Lao Persian Russian Spanish
B. Contractor shall provide interpretation services in-person or virtually, as specified by DDS, for activities, events, interviews, meetings, trainings, and other exchanges involving both internal and external stakeholders.
C. Contractor shall ensure, at the time of interpretation, that assigned non-English language interpreters are ATA-recognized Credentialed Interpreters who either hold a current and valid certification from an ATA-recognized entity or who hold a translation and interpreter degree from an ATA-approved school. Contractor shall furnish proof of each assigned non-English language interpreter’s valid certification or degree to DDS prior to the start of an interpretation assignment.
D. Contractor shall ensure, at the time of interpretation, that assigned American
Sign Language interpreters possess a current and valid certification from the Registry of Interpreters for the Deaf (RID) at the level of Certificate of Interpretation (CI), Certificate of Transliteration (CT), or CI and CT; or a current and valid membership with the National Association of the Deaf at the level of Generalist (III), Advanced (Level IV), or Master (Level V). Contractor shall furnish proof of each assigned American Sign Language interpreter’s valid certification or membership to DDS prior to the start of an interpretation assignment.
E. Contractor shall provide interpreters who hold a valid Certified Deaf Interpreter
(CDI) certification issued by the RID and/or the RID’s Center for the Assessment of Sign Language Interpretation, who may work in partnership with American Sign Language interpreters. CDIs are deaf or hard of hearing, possess native or near-native fluency in American Sign Language, and have demonstrated knowledge and understanding of interpreting, deafness, the Deaf community, and Deaf culture. CDIs provide interpreting, translation, and transliteration services using American Sign Language and other visual and tactual communication forms used by individuals who are deaf, hard of hearing, or deaf-blind. Contractor shall furnish proof of each assigned CDI’s valid certification to DDS prior to the start of an interpretation assignment.
F. Contractor’s interpretation services shall encompass the following modalities:
Service Description Consecutive Waiting for a person communicating to pause and then interpreting each section immediately afterward Simultaneous Interpreting simultaneously as a person is communicating Summarization Providing a summary of a person’s remarks Sight Translation Reading aloud English documents in other languages, or reading aloud non-English documents in English
G. Contractor shall assign interpreters who have demonstrated proficiency expressing ideas instantly, accurately, completely, and with the original intent of the person communicating. Contractor’s assigned interpreters shall be limited to facilitating the exchange of information only between DDS and its clients, customers, employees, job applicants, and contractors. Contractor’s assigned interpreters shall not supplement DDS’ communications by providing direction, instruction, or any other information without prior authorization from DDS.
H. In evaluating the suitability of interpreters to perform work on behalf of DDS, Contractor shall consider the extent to which an interpreter has previously demonstrated familiarity with DDS and California’s developmental disabilities service system, including familiarity with relevant terminology. In addition, Contractor shall assign interpreters who have demonstrated professional-level vocabularies and professional behavior/conduct.
I. Contractor shall demonstrate a good faith effort to accommodate clients’ interpreter preferences, if known, to help ensure that a client has somebody they trust working with them. Contractor shall be required to contact and negotiate, if applicable, with preferred interpreters to confirm their availability and interest in performing an assignment, which may necessitate partnering with local or regional providers to secure a preferred interpreter. Where possible, DDS prefers continuity and/or use of the same qualified interpreters from one assignment to the next.
J. For virtual assignments, Contractor shall assign interpreters with reliable internet connections and equipment who have demonstrated proficiency using virtual meeting platforms. Prior to a virtual assignment, Contractor shall confirm an interpreter’s ability to access menus and enable features, navigate multiple language channels and breakout rooms, and perform simultaneous interpretation during virtual question-and-answer sessions.
K. Contractor’s assigned interpreters shall wear appropriate clothing and footwear for the job, which do not display any wording or symbols that are offensive or insulting to any group or individuals. Assigned American Sign Language interpreters and CDIs shall exercise care when choosing clothing and appear in an “unobtrusive manner,” including wearing articles of clothing that contrast with skin tone, avoiding fabrics that may increase eye strain in a bright room (e.g., silk, satin, or polyester), and avoiding printed and woven patterns that may contribute to eye fatigue.
