Estimated Value:
Statutory Authority: 10 U.S.C.2304(c)(1)
JUSTIFICATION FOR OTFAOC BRAND NAME ONLY
Justification for OTFAOC Number: JA15-106
Upon the basis of the following Brand Name justification, I, as the Procuring Activity
Competition Advocate (PACA), hereby approve this limited source justification in accordance with 10 U.S.C.2304(c)(1).
JUSTIFICATION
1. REQUIRING AGENCY AND CONTRACTING OFFICE:
Requiring Activity:
DISA Workforce Management Directorate (WMD)
6910 Cooper Ave
Fort Meade, MD 20755
Contracting Office:
DISA/ DITCO- PL8324
2300 East Drive, Building 3600
Scott AFB, IL 62225
2. NATURE/DESCRIPTION OF ACTION(S): This requirement is in support of the BAS maintenance and associated services, original contract HC1047-10-C-4021 was a 100% set aside for veteran Owned Small Business. This is a partial follow-on contract (existing effort coupled with new effort) which requires brand name training support for part of the work. This contract will be a Firm Fixed Price (FFP) award utilizing 2015 Operations and Maintenance (O&M) funds. The period of performance will start at award and will consist of a 1-year base period with four 1-year option periods.
3. DESCRIPTION OF SUPPLIES/SERVICES: The contractor shall provide fulltime on-site maintenance, repair, and associated support services to the BAS so that all monitored equipment
Building Automation System Maintenance and Associated Services Contract for the Defense
Information Systems Agency (DISA) Headquarters, Fort Meade, Maryland-JA15-106
Page 2 of 6 Pages functions properly. The DISA Headquarters BAS is a distributed computer system that monitors and controls all of the building’s systems, to include:
1. Boiler plant
2. Chilled water plant with associated cooling towers
3. Constant and variable speed fans and pumps
4. Variable frequency drives
5. Air and water economizers
6. Air distribution and ventilation systems, including, but not limited to, air handlers, computer room air conditioning units, and terminal devices
7. Exhaust fan systems
8. Fan coils with heating and/or cooling
9. Gas fired unit heaters
10. Lighting systems and controls
11. Power systems, including power conditioners
12. Emergency power systems, including transfer devices, backup generators, fuel delivery system, and uninterruptable power supply system
13. Operating schedules
14. Utility metering
The BAS also includes robust fault detection capability and leak detection. The purpose of this
BAS maintenance and associated services contract is to sustain the DISA headquarters BAS by maintaining, testing, calibrating, and repairing the system components; adjusting device programming; and maintaining the software which monitors all critical facilities systems within
DISA’s headquarters complex.
Building automation system maintenance and services are available in the market place. The requirement for full time on-site technicians is not common but needed for the DISA headquarters complex. The nature of DISA’s 24 hours a day, seven days a week, critical mission capability and the number of components to be checked and calibrated that are connected to the
BAS system requires an effort in excess of two full time workers.
4. IDENTIFICATION OF STATUTORY AUTHORITY: Only one responsible source and no other supplies or services will satisfy agency requirements, 10 U.S.C.2304(c)(1). (FAR 6.302-1/
Defense Federal Acquisition Regulation Supplement 206.302-1).
5. DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS:
(a) Description of events.
A design-build contractor, Hensel Phelps Construction Company, was awarded contract number W912DR-08-C-0012 to design and build the DISA headquarters, complete with a
BAS. The BAS has thousands of components, most of which are non-proprietary;
however, the heating, ventilation, and air conditioning controllers are the most complex and are proprietary to Schneider Electric Company, and are common in all complex BAS installations. In DISA headquarters, there are approximately 2,040 Schneider-Electric
TAC I/A Series® MicroNet controllers installed at a component cost of approximately
. These controllers are connected to a variety of input sensors which send signals
Page 3 of 6 Pages to actuators, valves, dampers, panels, and other controllers and devices. Each controller must be programmed for a specific function using Schneider-Electric TAC I/A Series®
Workplace Tech Tool 5.7 software. This software was provided to DISA during building turnover.
Replacement of all the MicroNet controllers in the current BAS system would cost an estimated , would also result in the purchase of another proprietary system, and the Government would encounter the same barriers to competition as with the current brand name requirement.
(b) Justification.
(1) Minimum Government requirements.
The BAS performance work statement (PWS) requires that technicians be certified in the use of TAC I/A Series® Workplace Tech Tool 5.7 software because the proper operation of the BAS is critical to the DISA Headquarters mission. Proper programming of the MicroNet controllers enables efficient operation of all connected equipment, functional diagnostics, equipment failure reporting, leak detection, and the complex’s Leadership in Energy and Environmental Design green building status.
(2) Demonstration of unique source.
A performance-based PWS has been developed for the BAS maintenance and associated services contract. The PWS requires the BAS technicians to be trained and certified in the use of TAC I/A Series® Workplace Tech Tool 5.7 software.
Based on internet searches, training and certification in the use of this software is only available through Schneider-Electric and their regional partners. An individual must successfully complete a training program through Schneider- Electric prior to becoming certified.
(3) Procurement discussion.
Programming of the MicroNet controllers is included in the BAS Maintenance and
Associated Services Contract. This service was previously acquired through the Base
Operating Support (BOS) contract; however, the determination was made to remove this work from the ongoing BOS solicitation and award as a separate contract. The brand name restriction is the main requirement of the PWS. Improper programming of the MicroNet controllers would have an adverse impact on the BAS system, including improper system function and/or system failure which would result in additional costs to the government for repairs or replacement of the system.
(4) Impact.
Trained technicians are critical to the operation of the BAS. Proper programming of the MicroNet controllers enables efficient operation of all connected equipment to minimize utilities costs while supporting proper environmental conditions for DISA operated network equipment in the Headquarters’ building.
6. FEDERAL BUSINESS OPPORTUNITIES (FBO) ANNOUNCEMENT/POTENTIAL
SOURCES: No request for information (RFI) was issued, in compliance with DISA Acquisition
Page 4 of 6 Pages
Regulations Supplement 6.302-1(d). The waiver from using a RFI or Sources Sought was signed and approved by the Head of the Contracting Activity on July 30, 2015. This is a commercial requirement a combined synopsis/solicitation will be posted to FedBizOpps for maximum competition. This J&A will be posted with the solicitation IAW FAR 5.102(a)(6).
7. DETERMINATION OF FAIR AND REASONABLE COST: The market research report indicates there will be adequate competition for the BAS maintenance and repair requirement with the associated limited sources justification. In addition, a detailed government estimate will be used to ensure a fair and reasonable price for the overall contract; and all pricing will be verified as fair and reasonable prior to contract award.
8. MARKET RESEARCH: Market research identified twenty-three small businesses capable of providing the brand name BAS maintenance, associated services, and WorkPlace Tech Tool certification required to meet PWS requirements. It is expected that the BAS requirement will have adequate competition within the small business arena, and Schneider Electric’s regional small business partners may also propose.
Internet searches revealed that training and certification in the use TAC I/A Series® Workplace
Tech Tool 5.7 software is only available through Schneider-Electric and their regional partners.
Based upon the above, adequate sources of supply for small business concerns are available to provide these brand name services; and after reviewing the agency goals for small business concerns, this data supports a total small business set-aside. This market research information is not more than 12 months old.
9. ANY OTHER SUPPORTING FACTS: A PWS has been developed for the BAS maintenance and associated services contract. The PWS requires the BAS technicians be trained and certified in the use of the TAC I/A Series® Workplace Tech Tool 5.7 software.
Replacement costs of the current BAS system components that rely upon the TAC I/A Series®
Workplace Tech Tool 5.7 software are prohibitive at an estimated . Market research provides evidence that removing the current BAS system and replacing with another make/model would result in the purchase of another proprietary system, encountering the same barriers to competition in the future as the current brand name source.
10. LISTING OF INTERESTED SOURCES: As a result of the market research performed, a
Sources Sought (SS) or a RFI was not posted; therefore, there are no sources that have expressed an interest in this procurement in writing. There was no need to post an RFI as the services to be procured have already been determined and the market research revealed twenty-three small businesses capable of performing this brand name requirement. As a result, there would be no added value in posting an RFI or SS. A D&F waiving the posting of an SS or RFI was executed by both the Contracting Officer and the Head of Contracting Activity on July 30, 2015.
11. ACTIONS THE AGENCY MAY TAKE TO REMOVE OR OVERCOME BARRIERS
THAT LED TO THE EXCEPTION TO FULL AND OPEN COMPETITION: BAS controllers are available through various companies, including Honeywell, Johnson Controls, and Circon;
however, once the system is installed, the replacement and/or maintenance of the controllers
Page 5 of 6 Pages becomes proprietary. Based on this, there is currently no opportunity to issue a contract without the use of a brand name justification.
12. REFERENCE TO THE APPROVED ACQUISITION PLAN (AP): This requirement is below regulatory thresholds required for an AP.
