SECTION M – EVALUATION FACTORS FOR AWARD
M-1 BASIS FOR AWARD
a. The government intends to conduct the acquisition in accordance with FAR Part 12 – Acquisition of Commercial Items, as supplemented by the Defense Federal Acquisition Regulation Supplement, and the DISA Acquisition Regulation Supplement. Award will be made to the offeror whose proposal is technically acceptable and offers the lowest price to the Government using LPTA evaluation process.
b. The government intends to award one IDIQ contract resulting from this solicitation; however, the government reserves the right to make no award at all.
M-2 EVALUATION OF PROPOSALS
Offerors are cautioned to ensure that their proposals are complete, address all requirements of Section L, are reflective of the evaluation criteria set forth in Section M, and are submitted on the most favorable terms to reflect their best potential.
M-3 EVALUATION FACTORS FOR AWARD
a. The Technical Subfactors will be evaluated and rated either Acceptable or Unacceptable. In order for a proposal to be rated overall Technically Acceptable, each of the following subfactors must be rated Acceptable. The following evaluation factors will be used to evaluate the proposal. It will not be acceptable for the offeror to state, “Have read, understand, and will comply.” This statement or similar statement will be cause to reject the proposal for noncompliance. The following factors will be rated:
(1) Technical Factor – Failure to be found technically acceptable will result in the offeror being ineligible for award.
(1) The offeror must be able to provide all aspects of SMARTnet support as described in the Terms and Conditions. To be deemed technically acceptable, the offeror must be able to provide all aspects of SMARTnet support at each level of the IB Pricing Tiers (CLINS X001 – X036).
(2) In order to be deemed technically acceptable, the offeror shall be the OEM or a certified Cisco Gold Partner/reseller of Cisco SMARTnet at the time of bid. If the offeror is not the OEM, the offeror shall submit with its proposal, a separate letter from Cisco, confirming that the offeror is a certified Cisco Gold Partner/reseller. This letter shall not be older than 30 days from the date proposals are due. In this letter Cisco shall confirm the offeror is a certified Cisco Gold Partner/reseller of Cisco SMARTnet who is capable of providing SMARTnet for all the agencies listed in the Terms and Conditions. To be deemed technically acceptable, the offeror shall submit a recent letter (within the past 30 days) from Cisco that the offeror is an authorized certified Cisco Gold Partner/reseller for Cisco SMARTnet at time of bid.
Only the OEM or authorized Gold Partners/resellers of Cisco SMARTnet are eligible for award. If not the OEM, the awardee shall maintain Gold Partner status from award through the entire contract period. The awardee shall notify the Government immediately if the awardee loses its gold partner status. The awardee must provide evidence of their Gold Partner status prior to the exercise each contract option period.
(2) Cost or Price Factor –
(1) The offeror’s price proposal will be evaluated for completeness, reasonableness, and unbalanced pricing. An offer may be rejected if the contracting officer determines that the lack of balance poses an unacceptable risk to the Government.
(2) Evaluation of options shall not obligate the Government to exercise such options.
(3) The offeror’s price proposal will be evaluated as defined in FAR 15.404.
(4) The Government will verify that all solicitation requirements have been priced, figures are correctly calculated, and prices are presented in a clear and useful format.
(5) For EVALUATION PURPOSES ONLY. The proposed prices per tier will be multiplied by the Government provided weightings to arrive at a total evaluated price per year. The Total Evaluated Price is the sum of the Base Year and all Option periods pricing as calculated in Attachment J-1.
(end of provision)
(End of Summary of Changes)
1. Cisco SMARTnet offering elements are not severable and are sold by annual subscription, which is also not severable. Cisco's standard commercial practice is payment in advance. The government stipulates that invoicing is to take place monthly in arrears on each delivery order. Is the government willing to amend the RFP to allow for payment in full in advance or amend to accept any other payment terms other than monthly payments in arrears?
No, because of Financial Regulations the Government will not accept any other payment terms.
