About this file

This is a Limited Sources/Sole Source Rationale document for repair services of an aerial fiber optic cable at the Pacific Missile Range Facility (PMRF) in Hawaii. The document justifies awarding a sole source contract to Kauai Island Utility Cooperative (KIUC) under the simplified acquisition threshold.

The requirement is for repair of fiber optic cable that supports data transport between PMRF Barking Sands main base and remote instrumentation sites at Koke'e and Makaha Ridge. KIUC owns both the fiber optic cable and infrastructure, with PMRF having access to 60 of 72 fiber strands through an existing Memorandum of Agreement (MOA). The sole source justification is based on KIUC being the only entity with ownership and access rights to the poles, ducts, conduits, and rights-of-way. The document notes that using another source would require installing new fiber optic cable at significantly higher cost and would violate the existing MOA. The contracting activity is DISA/DITCO-Pacific at Pearl Harbor, with funding document number N0534A25MP3R039. KIUC's address is listed as 4463 Pahe'e St Ste 1, Lihue HI 96766-2000.

Limited Sources/Sole Source Rationale For all Requirements under SAT

Upon the basis of the following justification, I, as the Contracting Officer, hereby approve this sole source rationale for the proposed contract action pursuant to the authority cited above as the particular service is essential to the Government's requirements, and market research indicates other companies' products or services do not meet, or cannot be modified to meet, the agency's needs.

1. REQUIRING AGENCY AND CONTRACTING ACTIVITY:

Requiring Agency:

PACIFIC MISSILE RANGE FACILITY

P.O. BOX 128

KEKAHA HI 96752-0218

Contracting Activity:

DISA/DITCO-PACIFIC

BUILDING 77, ROOM 129

PEARL HARBOR HI 96860-5815

2. Procurement Title: Koke'e Aerial Fiber Repair

Funding Document Number: N0534A25MP3R039 Purchase Request Number: N0534A25MP3R039 Contract Number: To be determined.

Task/Delivery Order Number: N/A Estimated Value:

3. Regulatory Authority: Federal Acquisition Regulation (FAR) 13.106-1(b)(1), Soliciting from a single source. (1) For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).

4. Description of Action: The nature of this contractual action is to repair services of an aerial fiber optic cable required to support data transport capabilities between Pacific Missile Range Facility (PMRF) Barking Sands main base site and PMRF’s remote instrumentation sites at Koke'e and Makaha Ridge. The fiber optic cable is owned by the Kaua'i Island Utility Cooperative (KIUC) and provides PMRF

Page 2 of 3 Pages exclusive use of a portion of the fiber cable via an existing Memorandum Of Agreement (MOA).

Additionally, Per the MOA, the aerial fiber optic cable in the electrical space on KIUC transmission and distribution poles is solely owned and operated by KIUC.

While KIUC reserves 60 of 72 strands of fiber contained within the ADSS aerial cable for PMRF use, the MOA states that the Government does not have any access to any of the poles, ducts, conduits, rights-of-way, or any utility property including the installed aerial fiber optic cable owned by KIUC. KIUC retains exclusive use of the remaining 12 of 72 strains.

5. Proposed Sole Source Contractor:

KAUAI ISLAND UTILITY COOPERATIVE (KIUC)

4463 PAHE'E ST STE 1

LIHUE HI 96766-2000

6. Market Research: As the sole owner of the fiber optic cable, and the owner of the majority of the infrastructure that the fiber cable is installed on, KIUC is the only source available to conduct the repair. KIUC is the only company with ownership and access rights to the poles, ducts, conduits, rights-of-way, and any utility property including the installed aerial fiber optic cable. No other options exist to go to another source to repair the KIUC-owned fiber optic cable. Going to another source would require installation of a new fiber optic cable at an exponentially higher cost than maintaining the existing cable, not to mention violating the MOA.

Based on the information provided, it has been determined that only the aforementioned service provided by KUIC, can fully meet the Government’s need.

Based on the justification provided by Pacific Missile Range Facility, a determination has been made to issue a sole source solicitation from Kauai Island Utility Cooperative for the above-described requirement.

REQUIREMENTS CERTIFICATION: I certify that the supporting data under my cognizance, which are included in the sole source rationale, are accurate and complete, to the best of my knowledge and belief.
