Justification and Approval
For Other Than Full and Open Competition
1. Contracting Agency: Defense Human Resource Activity- Procurement Support Office 4040 N Fairfax Dr Suite 120 Arlington, VA 22203
2. Authority Cited: 10 U.S.C.2304(c)(1), FAR 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
3. Description of Supplies and Services: The Uniform Law Commission (ULC) has drafted the Uniform Military and Overseas Voters Act (UMOVA) and is finalizing its work on a new act to address the voting difficulties facing overseas and military voters. The ULC Drafting Committee consists of a chair, several ULC commissioners from various states, and a reporter (a law professor with expertise in the subject matter). Every ULC drafting committee is also assigned an American Bar Association (ABA) advisor, who represents the ABA as a whole, and frequently one or more ABA section advisors, who represent particular ABA entities. The UMOVA is scheduled for final approval by the ULC during its annual meeting, July 9-16, 2010, in Chicago, Illinois. Upon approval, the ULC, through uniform law commissioners from each of the states, will submit the Act to their legislatures for consideration and enactment. ULC legislative staff will work to support these enactment efforts.
The contractor shall:
• Conduct education and outreach for States’ enactment of the Uniform Military and Overseas Voters Act (UMOVA) at the following events:
National Association of State Election Directors (NASED) and National Association of Secretaries of State (NASS) Annual Meetings, July 17-20, 2010, Providence, Rhode Island
Southern Legislative Conference Annual Meeting, July 31‐August 4, 2010, Charleston, South Carolina
National Conference of State Legislatures (NCSL) Legislative Summit 2010, July 25‐28, 2010, Louisville, Kentucky
Council of State Governments (CSG) Western Legislative Conference, September 11‐14, 2010, Sun Valley, Idaho
CSG Annual Meeting, December 4‐7, 2010, Providence, Rhode Island
National Conference of State Legislatures (NCSL) 2010 Fall Forum, December 8‐11, 2010, Phoenix, Arizona
• Conduct State specific education and outreach for two of the following States:
California, New York, Florida, Pennsylvania, Illinois, and Texas. Activities will include conducting half-day long stakeholder meetings at a location in the state capitol of each state. The Chair and/or the Reporter of the UMOVA drafting committee will attend all stakeholder meetings, along with a ULC staff member who is knowledgeable about the Act. During the meetings, ULC representatives will provide detailed information about the Act’s provisions and the problems that the Act addresses, and answer questions about the Act and its implications.
• Create and maintain a separate website with pertinent information regarding
UMOVA.
• Develop and, as necessary, revise press kit materials, including copies of UMOVA, maps, articles and press clippings related to the Act. Distribute these materials at all outreach meetings and make them available through the Act’s website.
4. Description of Action: A Firm-Fixed price contract is planned with a total estimated value of $60,750. The period of performance will be 1 July 2010 through 31 March 2011. Fiscal Year 2010 Operations and Maintenance (O&M) funds will be used.
5. Reason for Authority Cited: The Uniform Law Commission (ULC) is the only one responsible source and no other supplies or services will satisfy the Federal Voting Assistance Program (FVAP) requirements for State education and outreach in support of the FVAP’s mission. The ULC is a not for profit organization.
6. Effort to Obtain Competition: The FVAP has conducted market research, described in paragraph 8 below, in an attempt to find another entity that could provide the necessary services. This requirement will be synopsized on Federal Business Opportunities (FedBizOpps.gov).
7. Effort to remove barriers to/increase competition: Due to the Uniform Law Commission’s (ULC) unique constitution and role in crafting State laws, there will never be a competitive market for its services. The ULC is a not-for-profit organization.
8. Market Research: Internet research using search engines and review of vendor sites and subject matter experts in state voting law and absentee voting laws determined there is no viable commercial market for the required services.
9. Interested Sources: None. This requirement will be synopsized in Federal Business Opportunities (FBO).
