Q&A Consolidation J41 Materiel Management

21R0001 Q&A

Number Document Reference Paragraph /Section

Questions/Comments

1) RFP Section H.1 H.1 – Organizational Conflict of Interest

Q: 1. In reading the language in Section H-1, Subsection 5(b), in light of the SOW, what activities might a Contractor be performing, for which the “engagement in contract activities” may impair an entity’s ability to “render unbiased advice and recommendations”?

Government Response: The nature of this contract lends itself to potential OCI in terms of providing system engineering and technical direction, and having access to proprietary information. If the contractor is involved in any of the above actions for a future requirement at USSOCOM, and now has an unfair advantage/impaired ability to render unbiased advice, this may be an OCI issues.

2) RFP Section H.1 H.1 – Organizational Conflict of Interest

Q: In reading the language in Section H-1, Subsection 5(b), is the intent of this clause to inform bidders that in performing the work as laid out in the SOW, they would then be precluded from bidding any other efforts with USSOCOM for which the performance of said efforts might be related to “…any products, systems, components and/or services which is the subject of the work to be performed under this contract”? If not, can clarification as to the intent be received or an amendment to the clause made?

Government Response: This clause is to inform bidders that there’s a potential that work under this contract may give the contractor an unfair competitive advantage as a result of the knowledge, information and experience gained during the performance of this contract.

If such situations present itself, the contractor will be unable to participating in those requirements because of OCI.

3) RFP Section H.1 H.1 – Organizational Conflict of Interest

Q: 3. The language in Section H-1, subsection 5(c), appears to be extremely restrictive in terms of its broadness of who it applies to. Is it intended to be this broad? And if so, can you explain why?

Government Response: Yes, if OCI arises from this contract, the restrictions help mitigate unfair advantages for other offerors.

4) Section L Pg 52, Para L.2.4.3:

Q: Sub- Contractors may submit their Total Evaluated Price (TEP) directly to the Contracting Officer.

Could government confirm do they need total evaluated price for the labor categories subcontract would be supporting or referring to professional employee compensation plan in the above para? Can prime and subcontractor together submit TEP instead of individually?

Government Response: Yes, all labor categories need to be supported in the compensation plan. The TEP can be submitted together or separate.
