| Section5Text: (Describe how this action requires the use of the authority cited. If applicable, identify the proposed or potential contractor(s), and include a discussion of the proposed contractors’ unique qualifications for fulfilling the contract requirements. Note, only the one authority cited above may be addressed here, if more than one authority applies, cite and discuss the basis for use of them in Section 8, Other Facts.) |
(NOTE: Agencies shall request offers from as many potential sources as is practicable under the circumstances, otherwise FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, must be cited and justified in Section 8, Other Facts.)
(For guidance, the three authorities used most often are cited in the following general order of precedence: (1) FAR 6.302-6 - National Security; (2) FAR 6.302-2 - Unusual and Compelling Urgency; and (3) FAR 6.302-1 - Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. For example, if all three were to apply to a given procurement, FAR 6.302-6 - National Security would be cited here and the remaining two would be cited in order or precedence in Section 8, Other Facts.)
Section5Text: Sandboxx is the sole provider of this advertising opportunity to penetrate USMC Boot Camp in this fashion. Due to MARSOCs urgent manning requirements, the target demographic is the Marine Corps. Advertising through Sandboxx allows for an exclusive access to all future Marines allowing R&A to reach and educate the maximum number of qualified candidates. All Marines attend one of two Recruit Depots, making it an extremely valuable advertising and education tool to the most advantageous procurement method for the MARSOC recruiting program/effort, all factors considered (FAR 5.5).
Section5Text: (a) Address why the proposed acquisition MUST be accomplished through a sole source solution, and why the authority in paragraph 4 applies. Provide a well-reasoned, detailed discussion of the rationale that will make it crystal clear to someone who has never heard of your organization or your requirement to substantiate why full and open competition cannot be used for this procurement. If applicable, identify the proposed or potential contractor(s) and include a discussion of the proposed contractor's unique qualifications for fulfilling the contract requirements.
| • | Describe how this action requires the use of the authority cited. |
| • | Describe the circumstances and considerations that result in the determination to utilize a sole source Contractor and discuss the unique qualifications of the proposed Contractor to provide the required supply or service. |
| • | Discuss why no other Contractor has or can be made to have the essential qualifications to meet the government’s requirements or specified delivery date. |
| • | If brand name, describe in detail why a particular brand name product or feature of a product peculiar to one manufacturer must be used and describe why another brand name cannot meet or cannot be modified to meet the requirement. |
| • | Explain why technical data packages, specifications, engineering descriptions, statements of work or purchase descriptions suitable for full and open competition have not been developed or are not available. Describe actions taken or planned to remedy this situation. |
| • | If applicable, include an estimate of the cost to the Government that would be duplicated and not recouped through competition (can include actual or estimated set-up costs, transition costs, etc.), how the estimate was derived, and whether the original contract was competitively awarded. NOTE: The purpose for detailing duplicative costs is to provide a traceable basis for drawing the conclusion that the cost is so high that it would not be recouped through competition. |
If urgency is the determined basis:
| • | Factually establish the urgent need. What were the circumstances leading to the emergency? |
| • | Provide the required performance/delivery schedule, when the requirement was first known and address the lead-time involved; i.e. what is the time difference between using this authority as opposed sole source. |
| • | Explain the serious injury to the Government which would result if not permitted to limit to a sole source. |
| • | Address why other Contractors are unable to meet the Government’s requirements in a timely manner. |
| • | Address any other considerations |

(If the authority FAR 6.302-6, National Security, is cited, outline how disclosure of the Government’s needs would compromise the national security; the explanation should result in the J&A document being classified. When FAR 6.302-6, National Security, is cited, requiring activities should address program protection requirements as it relates to the Acquisition Strategy; relationship with the vendor, Procurement Vehicle (to include logistics tail); and Finance (payments/systems used, etc.). At a minimum, address the following elements related to the aforementioned areas:
What needs to be protected, Why it needs to be protected, At what level, and How will the information be protected)
