Performance Work Statement Naval Special Warfare Command

NSW Preparatory Course Training and Support Services Contract

1. BACKGROUND

1.1 Overseas Contingency Operations prompted a Chief of Naval Operations (CNO) directive to grow the

Naval Special Warfare (NSW) Force. Consequently, NSW targeted an increase in the Sea, Air, and Land (SEAL) and Special Warfare Combatant-Craft Crewman (SWCC) forces. As part of the effort to support and sustain this requirement, the Naval Special Warfare Center (NSWCEN) has developed the NSW Preparatory Course.

2. OBJECTIVES

2.1 The objective of this requirement is to obtain contractor personnel support in order to properly physically train and mentally prepare SEAL and SWCC candidates for successful completion of their respective selection programs.

3. SCOPE

3.1 The Contractor shall provide all personnel and management necessary to provide the support services and perform to the standards and the specifications contained in this Performance Work Statement.

3.2 This requirement includes support in the areas of strength and conditioning, running, swimming and water skills, administrative and statistical support, logistical support and inventory management, and medical support.

4. REQUIREMENTS

4.1 General Requirements

4.1.1 Possess a working knowledge of basic computer programs, email, voicemail and technical support functions (Navy/Marine Corps Intranet (NMCI) help desk, security, fire, and ambulance).

4.1.2 All Contractors having knowledge of training, facilities, budget, transportation, and procurement functions shall sign a non-discloser statement.

4.1.3 All contracted personnel shall maintain the cleanliness of all respective assigned spaces.

All facilities and equipment issues shall be brought to the Program Manager to inform the Officer in Charge (OIC).

4.1.4 All contracted personnel shall be able to operate government vehicles. Driving vehicles is considered incidental to the performance of duties required under this contract and is not considered primary to the function of the job. The contractor shall provide to the COR:

4.1.4.1 Copy of current driver’s licenses for all contract personnel.

4.1.4.2 Copy of insurance covering all contract personnel, in accordance with federal and state laws.

4.1.5 Course Manager, Physical Training Instructors / Coaches, Emergency Medical Technician, Athletic Trainer, Physical Therapist, Transportation Specialists, Logistics Management Specialist shall conform to a dress code consisting of NSW approved training attire, consisting of a blue embroidered shirt and pants or appropriate physical training attire. An example will be provided upon award of contract. The contractor shall outfit all contract personnel.

4.1.6 Contract personnel shall maintain a standard of grooming and personal appearance that reflects a high degree of pride in themselves and are in keeping with their positions as training professionals; grooming standards shall be commensurate with those which closely mimic grooming standards employed by active duty Navy SEAL instructors.

4.2 Specific Requirements

4.2.1 Course Manager (1 FTE).

4.2.1.1 Maintain a direct working relationship with the NSW Preparatory Course COR and active duty staff, to include collaboration on all aspects of the course curriculum. Maintain accurate records of student information that includes travel activity, PST testing and results. Course Manager shall be familiar with all aspects of the job, test sites, and Centers of Influence (i.e. Recruit Training Center (RTC), Naval Training Center (NTC), Training Support Center, NSWCEN, other supporting entities) in their relationship to the operation of NSW Preparatory Course

4.2.1.2 The Course Manager shall perform the following functions in addition to all items listed as responsibilities for the Lead Physical Training Instructors:

4.2.1.2.1 Directly supervise administrative and medical contract personnel.

Supervise Physical Training Instructors in conjunction with Lead Physical Training Instructors.

4.2.1.2.2 Manage the Physical Training Instructor's training activities. The Course Manager is not required to be at every evolution but shall maintain strict oversight of each instructor’s performance through the Lead Physical Training Instructors.

4.2.1.2.3 Ensure all instruction is being carried out in accordance with established curriculum, to include safety aspects of the evolution and fulfillment of curriculum guidelines.

4.2.1.2.4 Oversee the implementation of the established academic curriculum.

4.2.1.2.5 Ensure physical and classroom evolutions are properly staffed, to include ensuring that required instructor/student ratios are maintained. Additionally, ensure that medical coverage for students is available at each physical evolution.

4.2.1.2.6 Evaluate Physical Training Instructors to ensure physical evolutions are being conducted in accordance with approved curriculum to minimize injuries and maximize candidate success.

4.2.1.2.7 Manage cycles of students arriving and departing based on convening class capacity, student flow, and completion of course requirements.

4.2.1.2.8 Implement and execute curriculum, to include control documents;

test plan; lesson plan; trainee guide; high-risk evolution documents; administrator guides; and evolution brief sheets and attached matrixes.

4.2.1.2.9 Submit course improvement and innovation change proposals through the OIC for review and approval prior to implementation.

4.2.1.2.10 Review exit critiques and provide recommendations in a per class report to the OIC.

4.2.1.2.11 Provide an as-needed report to the OIC on contractor issues and command climate.

4.2.1.2.12 Communicate observations and trends of testing results, bi-annually, to the OIC to provide feedback focused on better preparation of applicants in training.

4.2.1.2.13 Mentor candidates in the NSW selection pipeline and career path.

As such, preference shall be given to those with experience as NSW operators.

4.2.1.2.14 Possess the ability to demonstrate and explain all points of performance of exercises included in the Physical Standards Test and exit test.

4.2.1.3 Naval Special Warfare Preparatory Course Manager shall possess a business degree in Management, Administration, Finance, Operations Management, or Human Resource Management. However, a Bachelor of Science (B.S.) or Bachelor of Administration (B.A.) in Health and Exercise Science, Kinesiology or five (5) years of equivalent experience managing a similar workplace/ team environment to include, but not limited to, training, managing logistics, administration, and transportation functions may suffice.

4.2.1.4 The Contractor shall ensure that training management is conducted in accordance with NSWCEN instructional directives and policies. All policies are held electronically and distributed by the military staff. (i.e. Drop/roll policy, drug/substance abuse, workplace violence and their application to students).

4.2.1.5 Program Manager shall be required to meet minimum PST standards within 30 days of reporting IAW current MILPERS MAN 1220-410 SWCC candidate standards. Program Manager shall maintain a fitness level and be prepared to pass same standards on a yearly basis.

4.2.2 Physical Training Instructors (18 FTE estimate).

4.2.2.1 The Contractor shall provide Physical Training Instructors–two (2) shall be designated as Lead Physical Training Instructors, six (6) as Water / Swim Coaches, five (5) as Run Coaches, four (4) as Strength and Conditioning Coaches and one (1) as a Rehab Strength and Conditioning Coach. Of the Physical Training Instructors, one (1) for each of the three (3) modalities (Running; Water / Swimming; Strength and Conditioning) shall be designated as a Head Coach. The Physical Training Instructors shall provide instruction and coaching to students in the Naval Special Warfare Preparatory Course. The persons for these positions shall have daily contact with junior sailors. As such, they must adhere to the highest standards of conduct in their interaction with these sailors; and understand the student/instructor relationship, the duties of the Physical Training Instructors, and provide the experienced, professional, administrative, and technical support required to achieve the desired degree of student preparation to accomplish program goals. All Physical Training Instructors shall perform specific duties to include, but are not limited to:

4.2.2.1.1 Perform and supervise physical training modules with students.

4.2.2.1.2 Demonstrate the points of performance for the exercises associated with the PST, as well as ensure exercises are being performed to the established standards. Perform physical testing IAW with established guidelines set forth in OPNAVINST 6110.1H (Physical Readiness Program).

4.2.2.1.3 Prepare students for success in SEAL, and SWCC selection and training pipelines by working with applicants to maximize their potential in aquatics and physical training modules. This shall include guidance and application of physical preparedness and training techniques for the PST to include, but not limited to, swim stroke development with and without fins, water confidence, running, and lower and upper body development.

4.2.2.1.4 Use the NSWCEN Detachment Great Lakes OIC and subordinate active duty members assigned to the Preparatory Course as the source of information for SEAL and SWCC training in order to train, brief, and inform students of changes in these programs.

4.2.2.1.5 Recommend solutions to establish and maintain

database/spreadsheet records of NSWCEN students and their status in the Naval Special Warfare Preparatory Course, specifically in regard to students’ performance on the PST.

4.2.2.1.6 Implement the established academic curriculum provided by the

NSWCEN.

4.2.2.1.7 Mentor NSWCEN students to increase awareness of physical standards for NSWCEN programs.

4.2.2.1.8 Provide medical attention to include, but not limited to, Cardiopulmonary Resuscitation (CPR) or Automated External Defibrillator (AED) devices while awaiting EMT Paramedics on scene.

4.2.2.1.9 Facilitate training modules in front of candidates in various forums to include, but not limited, to pool decks, classrooms, workout facilities, and podium lectures.

4.2.2.1.10 Plan and execute exit critiques. Collate results into a per class report, along with providing recommendations for curriculum changes based on critique results. Exit critique results shall be gathered from students exiting the Preparatory Course. Report will be generated and sent to the OIC.

4.2.2.1.11 Lead Physical Training Instructor: Liaison with military staff, create daily/ weekly schedule for students, supervise all instructors in conjunction with oversight from the Course Manager, and observe safety at each training evolution. Provide guidance and counseling for instructor staff and send information to the Course Manager regarding instructor climate.

4.2.2.1.12 Lead Physical Training Instructors mentor candidates in the NSW selection pipeline and career path. As such, preference shall be given to those with experience as NSW operators.

4.2.2.2 Physical Training Instructors shall have a Bachelor of Science (B.S). or

Bachelor of Arts (B.A.) in Health and Exercise Science, Kinesiology, or related field or 4 years equivalent experience working as an instructor or physical fitness leader in a similar field and environment. It is a requirement for the Physical Training Instructors, including the Leads, to successfully complete the High Risk Training Course (HRTC), or an executive level HRTC in accordance with NSWCEN policy. Successful completion shall be within 30 days of contract award and/or employment under the contract; or when first offered by NSWCEN, whichever is later, as a term of employment. NSWCEN is responsible to teach this course and for determining all qualifications for course completion. Instructors are required to pass the course.

4.2.2.3 Physical Training Instructors shall be required to meet minimum PST standards within 30 days of reporting IAW current MILPERS MAN 1220-410 SWCC candidate standards. Physical Training Instructors shall maintain a fitness level and be prepared to pass same standards on a yearly basis.

4.2.2.4 All Physical Training Instructors must be CPR/AED certified.

4.2.2.5 All Physical Training Instructors must be qualified Life Guards (American Red Cross Certification).

4.2.2.6 Four Physical Training Instructors must have Swim Coaching experience at a competitive level (club, collegiate, or Olympic).

4.2.2.7 Four (4) coaches shall possess at a minimum Level 3 Swim Coach as recognized by the American Swim Coach Association.

4.2.2.8 One (1) shall be certified as a Registered Strength and Conditioning Coach with Distinction (RSCC/D) and five (5) as Certified Strength and Conditioning Specialist (CSCS), as recognized by The National Strength and Conditioning Association.

4.2.2.9 Five (5) coaches shall be certified run coaches by the USA Track and Field Association.

4.2.3 Administrative Assistants (3 FTE). The Contractor shall perform specific duties to include, but are not limited to:

4.2.3.1 Shall have appropriate level(s) of education to perform the required function – at a minimum, shall possess a High School Diploma, or equivalent.

4.2.3.2 Provide data input to OIC, NSWCEN Student Control, Personnel Support Detachment (PSD) Great Lakes, and other Navy Administrative Departments to facilitate the timely execution of all student transfers and orders.

4.2.3.3 Contractor shall coordinate travel and travel orders for qualified recruits in NSWCEN training program.

4.2.3.4 Provide general office support to facilitate contract performance to include, but not limited to, completing data calls, answering phone calls, drafting business memos, providing timely correspondence, and requesting office materials.

4.2.3.5 Provide clerical and administrative support to facilitate daily coordination and activity with other administrative assistants.

4.2.3.6 Update presentations intended to train, brief, and inform students of changes in these programs derived from information provided by the OIC or NSW policy guidance.

4.2.3.7 Track student records and documents exchanged between the Contractor and Naval Special Warfare Center and Basic Training Command administrative personnel.

4.2.3.8 Track daily student time in training and progress. Produce accurate reports and briefs for the OIC.

4.2.3.9 Enter course related information into Naval Special Warfare Center databases.

4.2.4 Statistician (1 FTE). The Contractor shall perform specific duties to include, but are not limited to:

4.2.4.1 Shall have appropriate level(s) of education to perform the required function – at a minimum, shall possess a Bachelor’s Degree in Statistics or Computer Science, or equivalent plus have three (3) years’ work experience.

4.2.4.2 Execute responsibilities that require professional knowledge of statistics to include, but not limited to, collecting and interpreting data, data analysis, forecasting, trends, and predictions.

4.2.4.3 Apply statistical theories, techniques, and methods to program results and data.

Prepare data for tracking. Experience with ggplot and language R preferred.

Practical experience with data cleaning and geospatial datasets.

4.2.4.4 Gather and interpret quantified information to include, but not limited to, run, swim, and academic and physical test results.

4.2.4.5 Provide analysis through mathematical modeling.

4.2.4.6 Communicate with the OIC through point papers or power point presentations about any changes, strengths, or weaknesses derived through statistical findings. Coordinate guidance, feedback, and program evaluation with the OIC prior to implementation.

4.2.4.7 Submit statistical reports, determined to be necessary by the OIC, in order to document program effectiveness.

4.2.4.8 Enter course related information into Naval Special Warfare Center databases.

4.2.4.9 Monitor trends in attrition and performance and communicate these trends through electronic media to the OIC.

4.2.4.10 Provide a statistical analysis of student success / failure rates and PST trends in a per class report.

4.2.4.11 Attend annual required training in accordance with guiding instructions at necessary conferences or courses to complete continuing education units required to maintain certification.

4.2.5 Emergency Medical Technician (EMT) Paramedics (2 FTE).

4.2.5.1 The Contractor shall perform specific duties to include, but are not limited to:

4.2.5.1.1 Shall have appropriate level(s) of education to perform the required function – at a minimum, shall possess a High School Diploma, or equivalent.

4.2.5.1.2 Maintain registration by the National Registry of Emergency

Medical Technicians (NREMT-P). May hold a State of Illinois EMT Registration in lieu of NREMT.

4.2.5.1.3 Maintain registration as an American Red Cross CPR/FIRST AID

Instructor.

4.2.5.1.4 Maintain an Advanced Cardiac Life Support Certification (ACLS).

4.2.5.1.5 Have two (2) years of paramedic experience within last five (5) years.

4.2.5.1.6 Provide medical coverage for all physical training evolutions.

4.2.5.1.7 Streamline medical screening/clearing process by assisting the Independent Duty Corpsman (IDC) with the review of student medical records.

4.2.5.1.8 Assist the IDC with maintaining /managing medical chits and medical records.

4.2.5.1.9 Serve as a source of medical knowledge and instruction with candidates. Be prepared to discuss injury prevention, heat/ cold related injuries.

4.2.5.1.10 Be the first responders in case of emergencies at all training sites.

4.2.5.1.11 Perform any relevant medical duty in the course of physical and aquatic training modules.

4.2.5.1.12 Paramedics shall be able to pass Navy Physical Readiness

Standards, with regard to age and sex, with a minimum passing standard of SATISFACTORY MEDIUM.

4.2.5.1.13 Paramedic shall be able to lift, at a minimum,50 lbs aver head.

4.2.5.2 Contractor shall outfit both paramedics with necessary medical equipment, per

State of Illinois, Department of Public Health. At a minimum, each paramedic shall be supplied with the list below:

4.2.6 Physical Therapist (1 FTE).The contractor shall possess a doctoral degree in physical therapy and certification through the American Board of Physical Therapy Specialties (ABPTS) as either an OCS or SCS, or certification through the National Athletic Trainers Association (NATA) as a certified athletic trainer (ATC) is required. The contractor shall have no less than 3 years of experience as a Physical Therapist, preference with experience in sports based injuries is preferred. The contractor shall have a demonstrated history of performing manual therapy and experience in the sports medicine field working with elite athletes is recommended. Contractor may be required to receive and maintain clinical practice privileges. The contractor shall evaluate and treat patients with or without referrals. This shall include the referral of patients to other staff members who fall within their scope of care. The Contractor shall perform specific duties to include but are not limited to:

4.2.6.1 Provide evaluation, treatment, and rehabilitation of musculoskeletal conditions.

Provide musculoskeletal injury care, utilizing approved supplemental clinical privileges including the ordering of imaging studies, laboratory tests, basic pharmaceuticals, and referrals to specialty providers.

4.2.6.2 Participate in periodic meetings to review the care provided to candidates and asses their progress. Identify opportunities for improved care.

4.2.6.3 Inform the Course Manager in matters related to injury prevention and rehabilitation and make recommendations.

4.2.6.4 Work cooperatively with Physical Therapy DIVO and medical staff at

NSWCEN for appropriate patient care turnover and coordination.

4.2.6.5 Work with the Active Duty IDC for administrative matters, purchasing of supplies and equipment, and supplemental fiscal requests.

4.2.6.6 Conduct equipment, product, and literature reviews to ensure the provider stays current with the provision of care.

4.2.6.7 Ensure proper return to training environment to minimize injuries.

4.2.6.8 Provide input for the development and utilization of relevant databases.

4.2.6.9 Conduct peer record reviews for the athletic trainer as directed

4.2.6.10 Ensure safe and effective operation of equipment used for patient care and contribute to a safe working environment.

4.2.6.11 Attend annual required training in accordance with guiding instructions at necessary conferences or courses to complete continuing education units required to maintain certification.

4.2.6.12 Document care in the Military’s Electronic Health Record, AHLTA.

4.2.7 Athletic Trainer (1 FTE). The Contractor shall perform specific duties to include but are not limited to: supervising and conducting physical training programs with consideration to individual injuries.

4.2.7.1 Shall have appropriate level(s) of education to perform the required function – at a minimum, shall possess a Bachelor’s Degree. Master’s Degree is preferred.

4.2.7.2 Hold a certification by the National Athletic Trainer’s Association (NATA).

4.2.7.3 Hold a cardiopulmonary resuscitation (CPR) certification.

4.2.7.4 Maintain a license as an Athletic Trainer by the Illinois Department of

Financial and Professional Regulation.

4.2.7.5 Have minimum of four (4) years as a Licensed Athletic Trainer. Collegiate experience is preferred.

4.2.7.6 Treat student medical issues on a daily basis and coordinate with appropriate military personnel along with the Paramedic, Course Manager, and other contractor personnel as determined necessary for the situation.

4.2.7.7 Work in conjunction with the Physical Therapist, within their scope of practice, in order to ensure best outcomes for injured students.

4.2.7.8 Maintain cleanliness and general upkeep of training facility to include, but not limited to medical and fitness equipment.

4.2.7.9 Recommend any changes to the OIC in regards to all athletic training supplies and equipment used at the NSWCEN Preparatory Course.

4.2.7.10 Keep accurate records of all injuries, method of treatment, rehabilitation, and medical releases. Provide this as a Weekly Report to the Program Manager /

OIC.

4.2.7.11 The Athletic Trainer shall be hired and supervised in accordance with OPNAVINST/MCO 6400.2, to include supervision by a physician for the first 30 days of clinical practice.

4.2.8 Logistics Management Specialist (1 FTE). The Contractor shall perform specific duties to include but are not limited to:

4.2.8.1 Shall have appropriate level(s) of education to perform the required function –

4.2.8.2 Manage all logistics involved with this program.

4.2.8.3 Distribute and appropriately handle and maintain inventories necessary to training (e.g. medical gear, training supplies, training equipment, gym equipment, instructor, and student gear issues).

4.2.8.4 Coordinate with the OIC to ensure that the students receive the necessary gear/equipment to train. Communicate with the OIC to maintain inventory levels for all required student gear at all times.

4.2.8.5 Direct, develop, and perform logistics management operations that involve planning, coordinating, and evaluating the logistical actions required to support the NSW Preparatory Course.

4.2.8.6 Track inventory of material purchased or furnished by NSWCEN to include but not limited to training equipment and gear issued to students.

4.2.8.7 Recommend the specific requirements for inventory levels and material, and correlate those requirements with program plans to ensure that the required materials are provided at the right time and place.

4.2.8.8 Possess working knowledge of agency program planning, funding, and management information systems (computer programs), as well as a broad knowledge of logistical support.

4.2.8.9 Possess specialized knowledge of logistics support activities involved including, but not limited to, maintaining inventory of all student and instructor equipment, as well as Government property. Organize and enter data into logistics information systems. Coordinate with OIC on facilities, budget, transportation, and procurement functions. Integrate the separate functions of planning and implementing them into a logistics management program.

4.2.8.10 Coordinate with the OIC to perform resource allocation requirements to include, but not limited to, effective programming, management, allocation, and execution of program resources. Submit Unfunded Requirements (UFR's) to OIC for both facility upgrades and appropriated fund requests enhancing student equipment for Naval Special Warfare Preparatory Course.

4.2.9 Transportation Specialists (3 FTE). The Contractor shall perform specific duties to include, but are not limited to:

4.2.9.1 Shall have appropriate level(s) of education to perform the required function –

4.2.9.2 Possess a military or civilian equivalent bus license (CDL-commercial driver’s license). Drive/ Transport students in support of training evolutions etc.

Transportation Specialists shall be required to drive contractor personnel as well as students. Contractors designated as Transportation Specialists who carry the necessary licenses shall be allowed to use Government vehicles for transportation of students and personnel to and from training evolutions.

4.2.9.3 Coordinate with OIC, through the Logistics Management Specialist, on management of material including initial planning, provisioning and requirements determination, and process inventory from central stocks including distribution, accountability, and ultimate issue for consumption, retention or disposal.

4.2.9.4 Possess knowledge of acquisition processes, automated records and control systems, material substitution criteria, and storage, issue, and disposal processes.

4.2.9.5 Perform analytical work to manage, regulate, coordinate, or otherwise exercise control over supplies, equipment, or other material.

4.2.9.6 Control all inventory issues to include but not limited to issuing of necessary training gear, organizing inventory, requesting inventory purchases, etc.

5. Confirmation of Certifications and Licensing of Contractor Employees

5.1 Documentation providing proof of licensing/certification is required to be provided to the Contracting Officer (KO) and Contracting Officer's Representative (COR) within 10 days of contract award, new hire, or update/refresh/requalification as applicable.

6. Transition: The Contractor shall be responsible for ensuring fully qualified personnel are in place on day one of performance. It is essential that attention be given to minimize interruptions to training in progress during the transition period. The Contractor must plan for the transfer of work and shall ensure the Government COR is fully informed of the transition status and any issues that may be identified.

7. Physical Security: The Contractor shall safeguard all Government equipment, information, and property provided for Contractor use. At the close of each day, shift, or work period, Government facilities, equipment, and materials shall be secured.

8. Work Hours/Holidays

8.1 Work may occur only Monday – Friday, excluding all federal holidays. No services or deliveries shall be performed on Saturdays, Sundays or Federal legal holidays. Deliverables due on a Saturday, Sunday, or Federal holiday shall be due on the following business day.

8.2 Observance of Federal Holidays:

8.3 If the date falls on a Saturday, the Government holiday is the preceding Friday. If the date falls on a Sunday, the Government holiday is the following Monday.

8.4 In addition to the days designated as holidays, the Government observes the following days:

Any other day designated by Federal Statute Any other day designated by Executive Order Presidential Inauguration Day Any other day designated by the President’s Proclamation

8.5 It is understood and agreed between the government and the contractor that observance of such days by government personnel shall not otherwise be a reason for an additional period of performance, or entitlement of compensation except as set forth within the contract. In the event the contractor’s personnel work during the holiday, they may be reimbursed. This provision does not preclude reimbursement for authorized overtime work if applicable to this contract.

8.6 When the Federal, State, Local or other Government entity grants excused absence to its employees, assigned contractor personnel may also be dismissed. The contractor agrees to continue to provide sufficient personnel to perform critical tasks already in operation or scheduled, and must be guided by the instructions issued by the Contracting Officer or Contracting Officer Representative (COR).

8.7 If government personnel are unavailable due to furlough or any other reason, the contractor must contact the Contracting Officer or the Contracting Officer Representative (COR) to receive direction.

It is the government’s decision as to whether the contract price will be affected. Generally, the following situations apply:

8.7.1 Contractor personnel who are able to continue contract performance must continue to work and the contract price shall not be reduced or increased.

8.7.2 Contractor personnel who are not able to continue contract performance (e.g., support functions) may be asked to cease their work effort. This may result in a reduction to the contract price.

9. Rights in Data

9.1 The contractor will be prohibited from copyrighting, publishing or disseminating information resulting from work performed under this contract, and/or, using data produced or obtained under this contract, and/or any other information or products provided by the Government, or which the contractor develops, for any purpose other than performance under this contract without prior written approval from the Contracting Officer.

9.2 Ownership of Documents, Materials and Records: All documents, materials (including any computer code) or records provided to the contractor, developed or maintained by the contractor in the performance of this contract are deemed to be property of the Government.

10. Limited Use of Data

10.1 Performance of this effort may require the contractor to access and use data and information proprietary to a government agency or government contractor, which is of such a nature that its dissemination or use, other than in performance of this effort, would be adverse to the interests of the government and/or others.

10.2 Contractor and/or contractor personnel shall not divulge or release data or information developed or obtained in performance of this effort, until made public by the government, except to authorized government personnel or upon written approval of the Contracting Officer. The contractor shall not use, disclose, or reproduce proprietary data that bears a restrictive legend, other than as required in the performance of this effort. Nothing herein shall preclude the use of any data independently acquired by the contractor without such limitations or prohibit an agreement at no cost to the government between the contractor and the data owner which provides for greater rights to the contractor.

11. Disclosure of Information

11.1 Information made available to the contractor by the government for the performance or administration of this effort shall be used only for those purposes and shall not be used in any other way without the written agreement of the Contracting Officer.

11.2 The contractor agrees to assume responsibility for protecting the confidentiality of government records, which are not public information. Each contractor or employee of the contractor to whom information may be made available or disclosed shall be notified in writing by the contractor that such information may be disclosed only for a purpose and to the extent authorized herein.

13. CONTRACTOR MANPOWER REPORTING

13.1 The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the Name of your component/office via a secure data collection site. The contractor is required to completely fill in all required data fields using the following web address: http://www.ecmra.mil/. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year, beginning with 2013. 14. CONTRACTOR TRAVEL

14.1 Contractor personnel shall anticipate travel to participate in appropriate training or events as listed in the table below. This table is by no means all-inclusive of potential travel but is based solely on http://www.ecmra.mil/ http://www.ecmra.mil/ historical data and should be used for planning purposes only. Specific locations and dates will be determined during the period of performance.

14.3 All travel shall be in accordance with FAR 31.205-46 and applicable travel regulations (Joint, Federal or Standardized). Contractor payment claims shall include applicable documentation to support actual costs incurred (e.g. airfare and hotel/lodging receipts) as well as any receipts valued at or above $75.00. Failure to provide appropriate documentation may result in loss of reimbursement of travel expenses.

15. SECURITY

15.1 Contractor must be able to obtain personnel and vehicle access to military installations. Contractor is responsible for coordinating all necessary access through the local Military Pass and Decal Office.

15.2 All contract personnel shall undergo a National Agency Check with Local Agency and Credit Checks (NACLC) background check prior to employment by the contractor, at the cost of the contractor.

Negative results may result in disqualification of an individual but shall be evaluated on a case-by-case basis. All resulting information gained from a NACLC shall be forwarded to the NSWCEN Security Officer.

16. SAFETY

16.1 Contractor Responsibility

16.1.1 Nothing in the Performance Work Statement, nor any Government action or failure to act in performance of the contract shall relieve the contractor of its responsibility for the safety of the contractor's personnel and property, the Government's personnel and property, and the general public. Furthermore, nothing in this PWS shall relieve the contractor of its responsibility for complying with applicable Federal, State, and Local laws, ordinances, codes and regulations (including those requiring applicable licenses and permits) in connection with the performance of this contract.

16.1.2 If applicable: All employees must adhere to FAR 252.223-7004, Drug Free Workforce.

However, additional drug testing is required for those employees performing sensitive requirements. The following additional guidance is applicable for all employees supporting this contract:

16.1.2.1 Employees performing sensitive requirements must be able to pass a drug test as a condition of employment, and submit to random drug testing throughout the Period of Performance.

16.1.2.2 Drug testing must be performed by a Substance Abuse and Mental Health Services Administration (SAMHSA) certified lab with a Chain of Custody Form being completed.

16.1.2.3 Pre-employment drug screenings shall be at the Contractor's expense.

16.1.2.4 The Contractor should send each employee for random drug testing at least twice annually.

16.1.2.5 If an employee's performance is deemed questionable or unsafe and/or an employee is suspected to be under the influence of any controlled substance, the COR will notify the Contractor and request that employee be sent for drug testing. The Contractor may propose one "contingency" drug test per FTE for this purpose.

16.1.2.6 Drug testing results will be provided to the COR within 24 hours of PoP start, new hire, or random drug test occurrence, as applicable.

16.1.2.7 In addition, Contractor employees may be asked to submit to random drug testing in conjunction with unit drug testing, at the Government's expense.

16.1.2.8 Employees performing sensitive requirements must NOT use any controlled substance, as defined by Class I, II, III, IV or V of the Controlled Substances Act, while employed by this Contract. This requirement stands, regardless of any state laws which may become effective during the performance of this effort. Prescription medications must be cleared by unit Independent Duty Corpsman.

17. Mishaps

17.1 The Government process must be in place that will ensure any mishaps are reported, investigated and recorded. This information will be input into the Web Enabled Safety System (WESS) by the Government.

17.2 Safety related problems or mishaps involving or observed by the contractor shall be addressed immediately to the designated COR. A formal written report shall be prepared and submitted to the Safety Officer within 2 working days of the incident

18. GOVERNMENT FURNISHED PROPERTY/EQUIPMENT/INFORMATION (GFP/GFE/GFI)

18.1 All support equipment including work space, computers, telephones, access to printer/copier/fax, bus and other vehicles, and other reasonably necessary supplies, as determined by the OIC, shall be provided by the Government as required. The Contractor is responsible for the safe and secure storage of Government-furnished equipment; all Government property shall be returned at the conclusion of this effort.

18.2 Each contractor employee providing services under this contract is required to obtain a Department of Defense Common Access Card (DoD CAC). Additionally, depending on the level of computer/network access, the contract employee will require a successful investigation as detailed by the NSWCEN Security Manager.

19. QUALITY CONTROL

19.1 The contractor shall implement and maintain a Quality Control Plan (QCP) to ensure work performed conforms to the scope of work and meets the requirements under this PWS. The QCP shall, at a minimum provide a method for performing inspections; identifying, correcting and preventing problems/defective service; addressing customer complaints, and improving the quality of services over the life of the contract.

20. QUALITY ASSURANCE

20.1 The Government reserves the right to perform inspections and surveillance to evaluate the Contractor’s compliance to the contract terms and performance of the requirements in the PWS. The Government will assign a Contracting Officer’s Representative (COR) who will be responsible for monitoring performance in accordance with the requirements of the PWS. The COR will make every effort to ensure that the surveillance methods used are conducted in an objective, fair, and consistent manner.

20.2 Contract Discrepancy Report (CDR). In the event of unsatisfactory contractor performance, the CO will issue a CDR that will explain the circumstances and findings concerning the incomplete or unsatisfactory service. The contractor shall acknowledge receipt of the CDR and respond in writing as to how he/she shall correct the unacceptable performance and avoid a recurrence. The Government will review the contractor's corrective action response to determine acceptability and will use any completed CDR as part of an overall evaluation of Contractor performance when determining present or future contractual actions.

4. REQUIREMENTS
4.1 General Requirements
4.1.1 Possess a working knowledge of basic computer programs, email, voicemail and technical support functions (Navy/Marine Corps Intranet (NMCI) help desk, security, fire, and ambulance).
4.1.2 All Contractors having knowledge of training, facilities, budget, transportation, and procurement functions shall sign a non-discloser statement.
4.1.3 All contracted personnel shall maintain the cleanliness of all respective assigned spaces. All facilities and equipment issues shall be brought to the Program Manager to inform the Officer in Charge (OIC).
4.1.4 All contracted personnel shall be able to operate government vehicles. Driving vehicles is considered incidental to the performance of duties required under this contract and is not considered primary to the function of the job. The contractor s...
