2. Description of Action: (FAR 6.303-2(b)(2))
Naval Special Warfare (NSW) Special Boat Team Twenty (SBT-20) proposes to procure by means of other than full and open competition for MTU Specialty Tools to be used in the maintenance and repair of the CCM MTU 2000CR diesel engine.
Approval is requested for a Brand Name, firm-fixed priced contract in support of SBT-20.
FY18 O&M funding in the amount of $145,903.79.00 has been provided for the initial task order.

5. Reason for Authority Cited: (FAR 6.303-2(b)(5)) SBT-20 requires MTU specialty service tools for conducting preventive and corrective maintenance on craft with MTU engines locally and deployed. MTU distributors are the only vendors authorized to sell the MTU specialty tools and tool kits required for the maintenance and repair of vessels with the MTU proprietary 2000CR diesel engine.
6. Efforts/Actions to Increase Competition: (FAR 6.303-2(b)(6) & (11)) The Government conducted market research, and will conduct market research for future requirements, to determine the market's ability to competitively satisfy the Government's requirement for the proprietary MTU tool’s and tool kits. The Government will publicize intent to issue award on brand name basis.
7. Market Research: (FAR 6.303-2(b)(8)).
Market research was conducted and revealed that there are at least three (3) authorized distributors of the Brand Name MTU tools/kits with the ability to meet the Governments requirements: Western Brand Diesel, Inc (CAGE: 3D921), Stewart & Stevenson Power Products, LLC (CAGE: 76KR1) & Stewart & Stevenson FDDA LLC (CAGE: 1HZH6).

NOTICE 1
Prior to approval, J&As will be screened to identify proprietary data and information exempted from disclosure by 5 U.S.C. 552, Freedom of Information Act, so that the final J&A may be prepared for required posting to FedBizOpps IAW Section 844 of NDAA 2009 as implemented via DPAP Memo, Public Disclosure of Justification and Approval Documents for Noncompetitive Contracts, dated 13 February 2009. J&As shall be posted to FedBizOpps within 14 days unless 10 U.S.C 2304(c)(2), Unusual and Compelling Urgency is cited. In that particular case the J&A will be posted within 30 days. Information selected for removal will be highlighted in yellow much like this statement so that signature authorities will know what information will be removed after approval, before posting.

11. Fair and Reasonable Cost Determination: (FAR 6.303-2(b)(7))
I hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable. Based upon the foregoing justification, I hereby approve the procurement of (state equipment/services being procured) in the estimated amount of (identify estimated total value of the contract action including options). NOTICE 2
POST APPROVAL REQUIREMENT: IAW Section 844 of NDAA 2009 as implemented via DPAP Memo, Public Disclosure of Justification and Approval Documents for Noncompetitive Contracts, dated 13 February 2009, this J&A will be posted to FedBizOpps within 14 days unless 10 U.S.C 2304(c)(2), Unusual and Compelling Urgency is cited.
In that particular case the J&A will be posted within 30 days. Prior to posting, previously identified proprietary data and information exempted from disclosure by 5 U.S.C. 552, Freedom of Information Act, that has been identified IAW Notice 1 via yellow highlighting, will be removed in order to create a document that is no longer classified as “for official use only” and is thus, appropriate for public release. Follow the guidance found in the DCG for the redaction procees prior to public release.
16. HCA FAR 6.302-2 Approval: (Required when performance exceeds 12 months, regardless of contract amount )
Based upon the foregoing justification of exceptional circumstances, I hereby approve a cumulative period of performance to exceed one year, including all options, for the procurement of (state equipment/services being procured).
