(1) Mark the title page with the following legend:
This proposal includes data that shall not be disclosed outside the Government and shall not be duplicated, used, or disclosed -- in whole or in part -- for any purpose other than to evaluate this proposal. If, however, a contract is awarded to this offeror as a result of -- or in connection with -- the submission of this data, the Government shall have the right to duplicate, use, or disclose the data to the extent provided in the resulting contract. This restriction does not limit the Government’s right to use information contained in this data if it is obtained from another source without restriction. (End of provision)
52.212-2 Evaluation -- Commercial Items (JAN 1999):
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
The following factors shall be used to evaluate quotes are in descending order of importance:
Technical Capability: The quote will be evaluated to ensure the Quoter is able (if applicable per manufacturer distribution agreement) and capable of distributing/supplying ALL items under the Exhibit Line Item Number (ELIN) schedule to the Government. Any alternate item will be evaluated to determine if it is equal in form, fit, and function to the listed item. The submitted delivery lead-times will be evaluated to determine ability to meet short requirement lead times. Preference may be given to shorter delivery lead times.
Corporate Experience: Offerors are expected to have at least two years of experience in providing the same or similar types of supplies, in a kitted manner, to either a Government or Commercial entity, and will be evaluated on how well the information provided demonstrates its experience in providing the same or similar supplies and kitting service.
Price: The evaluated price will be determined using the estimated quantities in Attachment 1.
Technical Capability and Corporate Experience, when combined, are significantly more important than price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options, to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
