Additional Questions and Answers
RFP Reference Industry Question Government Response
58 PWS 1.1 Do contract instructors fall under the JSOMTC Medical Director or does the contractor need to provide its own Medical Oversight?
Request clarification on which entity is required to provide Medical Direction.
Program oversight will be carried out by JSOMTC. The Contractor is responsible for supervising their own employees. The solicitation does not require a Medical Director. The solicitation requires a Contract Manager who will supervise all contractor employees.
59 PWS 1.4.1 PWS states “EMT-Paramedic certification (optional)”. Will the government please explain what is meant by the EMT-Paramedic Certification being optional? Is this all Instructors or is there a percentage that is being considered during evaluation
The scope of the contract does include training in order for the students to obtain their EMT-P certification. The EMT-P certification for the students is not optional.
The optional aspect pertains to the contractor employee certification. The EMT-P is optional if a contractor employee possesses the ATP certification, which is only available to uniformed personnel. Please see the response to Question 25 above for discussion of EMT-P and ATP certification requirements.
60 PWS 1.6.4.2 The current employees are SCA but not authorized overtime and the flexible schedule is referred to as “compensation time” in the FLSA and is not authorized for SCA employees. Are we required to bid the this workforce as SCA employees or if justified can we purpose exempt employees?
Currently, the Department of Labor (DOL) lists current employees as non-exempt. The Contractor is responsible for reviewing the solicitation and all qualifications for each employee and proposing the appropriate labor category.
You may submit a request to the DOL for their category to be changed. However, the solicitation deadline will not be extended in order for the DOL to make a determination.
61 PWS 1.6.4.2 How many SCA employees are employed under the current contract? Please provide a sanitized (no names) list of all SCA employees and their existing SCA benefits, such as number of cumulative years employed under SCA, sick and vacation hours per employee, and other welfare stipends authorized to each SCA employee
The information that is being requested is similar to the Seniority List which is required to be given to the successor within 10 days of contract commencement IAW FAR 22.1020.
Please see solicitation clause 52.222-17 (Nondisplacement of Qualified Workers), which references Executive Order 13495 for additional information.
62 Section H.1 The PWS states “No Contractor employee will be directly supervised by the Government”.
Is the expectation for the contractor to provide their own medical director to provide direct supervision of medical instructors providing medical instruction?
If the Contractor is to provide all supervision, then the contractor will need to provide their own medical director and if they will fall under the oversight of a Medical Director then this statement needs to be revised. If the Government is providing the Medical Director, we recommend changing the statement to “No contractor will be directly supervised the government, with the exception of the Government’s Medical Director who will provide medical oversight to ensure proper medical protocols are adhered to” (or similar)
The Government will not provide contractor employee supervision but will provide contract surveillance to ensure that all contract terms and conditions are being met.
The solicitation does not require a Medical Director. The solicitation requires a Contract Manager who will provide direct supervision for all contractor employees.
