The overall purpose of the SOF Mission Network is to enhance collaboration and situational awareness. The SOF Mission Network is intended to improve targeting and reduce fratricide among SOF aircrews, on-aircraft forces, SOF ground forces, SOF Command and Control (C2) nodes, and, as needed, other Joint and Coalition forces.

The ViaSat equipment and services that will be included in this contract provide vital pieces of the SOF Mission Network. The Hatch-Mount KuSS Antenna is an airborne satellite antenna which delivers high-speed Internet Protocol (IP) communications-on the-move. The KuSS Arclight2 Ground hubs provide the required infrastructure to support that capability and transmit the data back to other ground users. The HAI PE devices provide National Security Agency (NSA) certified Top Secret (TS) Type 1 in line Communications Security (COMSEC) for use with tactical Command, Control, Communications, and Computers (C4) Intelligence, Surveillance, and Reconnaissance (ISR, C41SR) applications. The DACASG-S system and HHL-16 radio together offer SOF an unprecedented ability to execute Digitally Aided Close Air Support (DACAS) greatly reducing the kill-chain timeline and reducing the potential for blue and green force fratricide.

This equipment and associated services will enable and sustain operationally relevant communications to. from, and within an aircraft, the presentation of information used for threat avoidance. as well as the identification and location of airborne and friendly ground forces. The equipment will be integrated across all mission elements of the SOF enterprise enabling full C2 interoperability and critical data transfer. All of these functions are vital to the SOF Mission Network enabling full interoperability across the SOF tactical enterprise.

The estimated value of all procurements and sustainmenUsupport services over five ears is $350M.

10 U.S.C 2304(c)(1) , Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. as implemented by FAR 6.302-1

FOR OFFICIAL USE ONLY - J&A No. 16-1125 phillip.sabo Cross-Out

5.

FAR 6.302-1(a)(2)(ii) states; Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in -

(A) Substantial duplication of cost to the Government that is not expected to be recovered through competition, or (B) Unacceptable delays in fulfilling the agency's requirements.

I All of the equipment to be included in this contract result from previous contracts

I (H92222-12-D-0022, H92222-13-D-0012. H92222-14-D-0062, NR0000-14-C-0339.

N65236-12-D-4136 DO 0115, N65236-12-D-4136 DO 0271, N65236-11-D-4103 DO

0179, N65236-12-D-4138 DO 0329) for the development and integration of and/or the production and sustainment of each product. This represents an investment to date of over- in the development and procurement of these products in addition to the subsequent sustainment services. Additionally, the requirements associated w ith interoperability testing, various NSA and JITC certifications, training, etc. for replacing these capabilities represents a minimum of a one to two year (product dependent) delay in providing these capabilities.

Due to the proprietary nature of this equipment ViaSat is the only company authorized to provide sustainment support (installation, integration, repair, maintenance, or training) for this equipment. In order to preserve the intellectual property of ViaSat products, ViaSat does not authorize or subcontract these services to third party vendors since these services require access to proprietary intellectual property. In some cases, other vendors are permitted to remove and replace components to be sent out for repair, but may not service components or subcomponents of these products. There are spare parts that may be removed and replaced by units, such as an antenna on a radio, but ViaSat support is required for installation, integration, repair, maintenance, or training activities therefore there is no other company (large or small business) outside of this Original Equipment Manufacturer (OEM) that can meet these requirements.

Interoperability is the primary objective of the SOF Mission Network. This equipment is currently fielded and therefore, must be sustained and remain operational until SOC OM can establish an alternate SATCOM architecture that meets all operational requirements. Due to the substantial cost duplications and operational impacts, it is not in the best interest of the Government to pursue an immediate replacement of these capabilities.

In addition, even if no substantial cost duplications or unreasonable schedule delays were associated with replacing these capabilities at th is time . some of these products are the only products capable of meeting all of our required technical capabil ities as outlined individually below ..

FOR OFFICIAL USE ONLY - J&A No. 16-1125 phillip.sabo Cross-Out

HHL-16 and DACASG-S

There are no other known products that have the extensive level of integration and testing with the DACASG-S and HHL-16 radio supporting SOF missions. Market research indicates V iaSat is currently the only manufacturer of a bi-directional radio gateway (The DACASG-S) that supports forwarding of K<->CoT, K<->K, J<->CoT, J< >J, CoT to KML message translations, Extended CoT and VMF messages on the tactical objective in support of irregular warfare operations. Additionally, ViaSat is the only manufacturer to build a Link-16 terminal in the hand held form factor for use by the Joint Tactical A ir Controller (JTAC) supporting SOF missions.

Im The STT is currently fielded on multiple Rotary Wing platforms. Due to aircraft size, weight, and power (SWAP) constraints and other existing requirements, the material solution for this capability was previously determined to be the ViaSat STT. The SIT is the only NSA certified dual band radio with Link-16 capability. Rotary Wing has the requirement to add Link-16 capability, while maintaining all current radio capabilities within the same SWAP. In addition, JITC and NSA certifications are required.

USSOCOM has already invested - in the design, procurement of, and/or integration of the ViaSat STT over the last two years. To test a new terminal, allow a schedule delay for certfication, and n integrate the new terminal with these specific platforms would cost an estimated lllland cause the program to delay by over a year.

Ku ss Arcligbt2 Ground Hub and Hatch-Mount Antenna

USSOCOM has invested over - to establish the current ViaSat SATCOM architecture, which includes procurement of the KuSS Arclight2 Ground Hub that has been fielded to meet SOCOM Mission Networking requirements. Additionally, within the ViaSat SATCOM architecture, ViaSat uses a specific waveform on their modems wh ich is proprietary and unique to ViaSat only. This technology has not been shared with any other companies with similar SATCOM capabilities thus, these companies are unable to build a comparable Ground Hub that is interoperable with ViaSat's network.

Therefore, in order to replace the KuSS Arclight2 Ground Hubs, the entire ViaSat global network would need to be replaced in order to still meet operational requirements and be completely interoperable. Which is also why the ViaSat KuSS Hatch-Mount antenna used by AFSOC on air platforms is included under this requirement since it is the only antenna compatible with the KuSS ArcUght2 Ground Hub.

FOR OFFICIAL USE ONLY - J&A No. 16-1125

KG-250X, KG-255, KG-250XS HAIPE Devices

These ViaSat HAIPE devices are the only NSA Type 1 certified encryption devices with embedded IP acceleration capability that fit our current satellite systems. Various SOF Deployable Node (SON) and Product Distribution Systems (PDS) satellite systems currently use these ViaSat encryptors.

Additionally, USSOCOM requires an in-line network encryptor capable of being body

I worn or installed in a tactical space where SWAP are critical attributes. Our use-case for the KG250XS is to wear it on the body, carry it in a tactical assault pack, or use it on our smaller SON systems where form factor and weight are considerations in mission planning. The ViaSat KG250XS is the only certified cryptographic device that can process IP traffic are 20 Mbps in a form factor of ~ x D) 1.5 x 1. 9 x O. 35 in.

Moreover, since 2014, USSOCOM has invested over-in the procurement of and/or integration of these devices.

EBEM & ESEM

The EBEM/ ESEM are currently supporting the Shipboard Carry-On SA TCOM System (SCOSS). The ViaSat EBEM/ESEM incorporate the latest technology in advanced modulation and coding and preserve link margin while combating rain-fades or other channel impairments. The ESEM enables a new logical data channel, which carries encapsulated Ethernet framed packets over the satellite link. The EBEM/ESEM is the modem that allows interoperability with systems already installed on the ship and is the only modem approved for use on Navy ships. USSOCOM must be interoperable with these ships and therefore must also use the Navy required EBEM/ESEM modem in order to maintain interoperability and performance of our various existing fielded USSOCOM systems.

A pre-solicitation notice was rx\ or was not n publicized as required by FAR 5.2.

A pre-solicitation Notice was posted to the Federal Business Opportunities (FBO) website from 5-20 October 2016 as a Notice of Intent to Sole Source to ViaSat. One vendor, responded with an email requesting an opportunity to review the requirements in more detail. USSOCOM responded with the previous RFI (reference Section 7) requesting that - determined that this sole source contract was not justified because they have a product(s) which met all of the capabilities outlined in the draft J&A for a particular product, to please provide a detailed Capability Statement specifically describing the product(s), how that product(s) met the listed a abilities, and provide backup information (i.e. proof of certifications. etc). However, chose not to provide this information after reviewing the draft J&A. I

FOR OFFICIAL USE ONLY-J&A No. 16-1125 phillip.sabo Cross-Out

We understand that the SOF Mission Network architecture will change over time to intentionally become more product agnostic which will enable greater interoperability , cost efficiencies, and increase competition. Therefore. as new requirements emerge, each platform will evaluate all technical opportunities and material solutions from industry to best meet the requirement. However. until such technologies are developed and the architecture is designed to enable a transition from the ViaSat SATCOM architecture, we must continue to ensure the current SATCOM architecture is sustained and remains operational. The program office will make every attempt to ensure current configuration management remains stable while an interoperabil ity anal sis is accom lished to determine future a sand re uirements.

A Request for Information (RFI) was posted to the FBO website from 15-30 September 2016 which included a draft copy of this J&Aand requested all companies that felt they had a product(s) which met any of the capabilities outlined in the draft J&A, to please provide a detailed Capability Statement.

The TRAX software is purchased and maintained under contract H92222-14-0-0062. After receiving this clarification . • took no further exceptions to the draft J&A and verified that they do not have an a ernative hardware solution for any of the listed equipment. The other response was from ........ in regards to their product which is a L~t could potentially compe e w1 1a s The primary difference between the TIR and the STI is that only the STI is a dual band radio. USSOCOM clarified to ........ that this contract will only include the continued procurement and su~ Rotary Wing platforms that have the STI because they have specific SWAP requirements as well as the need for multiple waveforms in that same form factor. Therefore, ........ also concurred after the additional discussion that they could~uirements.

Market research was conducted for each product as well as validating the SOF mission networking requirements over the next five years to ensure there was no viable alternatives to meeting these requirements. The market research report is located in the contract file, Tab A-17.
