SUMMARY OF WORK

2/2013

PART 1 GENERAL

1.1 DESCRIPTION OF CRANEY ISLAND DREDGED MATERIALS MANAGEMENT AREA

The Craney Island Dredged Material Management Area (CIDMMA) is a 2,500 acre confined dredged material disposal site located at the north end of the town of Portsmouth near Norfolk, Virginia. CIDMMA serves as a long-term disposal site for material dredged from the rivers, channels and ports in the Norfolk Harbor area. By 2010, the site had received over 253 million cubic yards of dredged material. The heights of the dikes are being raised to increase the site’s storage capacity. The site is divided into three large storage cells that are contained by compacted soil dikes that average 30 to 40 feet high. The top of the dikes serve as roadways and are interconnected. The site is a peninsula that is approximately 2 miles wide times 2 miles long that extends into the Norfolk Harbor. The south end includes access roads, the USACE office, and the Contractor’s laydown yard. Access to the site is limited and must be approved by the site’s USACE office. A permanent crew of USACE personnel maintain the roads, dikes and associated structures. The island is a known nesting area for protected birds during the March 1 through August 31 period which may cause delays and relocation of work. Repair and/or rehabilitation of shoreline stabilization structures that are equal to or greater than 48 feet from the shoreline may require time of year restrictions subject to regulatory permits as determined by the Contracting Officer.

Dike slope grades and heights are continued as previously established by the Engineer Research and Development Center (ERDC). Slope stability for the project was last evaluated in 2017 and can be provided upon request.

1.2 WORK COVERED BY CONTRACT DOCUMENTS

1.2.1 General Task Order Requirements

The work included in this Indefinite Delivery/Indefinite Quantity (IDIQ) contract will be awarded using Task Orders that will cover earthwork projects, including dike raising and other miscellaneous earthwork. Task Orders may also include installation of riprap for shoreline protection, replacement of damaged corrugated pipes (36 inches in diameter), replacement of damaged timber weir boards and miscellaneous steel wotk at spillboxes. The unit prices listed in the awarded contract will be used to prepare the individual Task Orders to match available funding. Task orders will be issued by the Contracting Officer in the order and locations deemed necessary . Each task order will include required bid items at the unit prices awarded per the contract. The Period of Performance for each task order will be based on scope of work awarded.

The Government will work to award subsequent task orders in a timely manner such that the Contractor can work continuously from one Task Order to the next Task Order without demobilizing and then remobilizing to the site. If there is a major delay between task orders, as determined by the Contracting Officer, there is a bid item for a partial demobilization and then partial remobilization of the Contractor’s equipment and personnel that may have left the site. The total value of the Task Orders included

SECTION 01 11 00 Page 3 in the IDIQ contract are limited to $17,000,000 total for all three contract years. The Government guarantees an award amount of $10,000.00 to a succesfull offeror over the full term of the contract. A task order for the minimum guarantee will be issued concurrently with the award of the contract if the seed task order is not awarded. A minimum guarantee amount will be paid out to the Contractor if no Task Orders are awarded over the period of the contract. All work specified in this contract shall be performed in accordance with the contract documents, specifications and drawings applicable to the respective Task Order’s pay items indicated and as stated in this Summary of Work. The Contractor shall begin work within 10 days after receiving the Notice to Proceed (NTP) for each Task Order which is issued by the Contracting Officer. Each task order is considered a separate legal contract and requires its own full set of documentation, schedules, work plans and all other items required per the Bid Document’s specifications and the individual Task Order’s drawings.

1.2.2 Project Description

For dike raising earthwork, the bid schedule volumes and surface areas will be based on USACE surveys. After the Notice to Proceed (NTP) is issued, the Contractor will complete a Before Dike (BD) survey of the entire area included in the Task Order and determine Acceptance Areas and their quantities. The BD surveys and associated calculations shall then be submitted to USACE for review and approval.

There are two separate construction areas associated with dike raising activities: 1) excavation and hauling of material from the borrow site;

and 2) material placement at the task order specified earthwork area. See Section 31 00 00 EARTHWORK for information on Borrow Site work items. See Section 35 41 01 LEVEE CONSTRUCTION for informaton on dike construction.

Government furnished borrow areas will be used for dike construction.

Prior to delivering to work areas, fill material shall be tested in accordance with requirements of Section 31 00 00 EARTHWORK. Disapproved material shall be remixed and retested until it meets testing requirements. The Contractor shall maintain logs of all material quantities and their delivery locations by acceptance areas.

The dike surface area shall be cleared and grubbed prior to fill placement.

The Contractor shall excavate and haul approved soil materials from the borrow site to the earthwork area where it will be stockpiled. For dike raising task orders, the Contractor shall place fill material to grades and elevations as shown in the drawings.

In some areas, additioanl fill material will be needed for placement on top of soft dredged spoils near the toe of interior dike slopes to build an “initial working platform” which will subsequently support the material placed alog the slopes. As the volume of this material can not be calculated using BD and AD surveys, these quantities will be computed using truck load volume logs for each acceptance area.

The dike raising work covered under this contract covers both the exterior containment dikes as well as the interior division dikes that divide the facility into three containment cells.

As soon as the earthwork is completed in an acceptance area, the Contractor shall complete an After Dike (AD) Survey of that area and submit with quantity calculations to the Government in support of progress payment

SECTION 01 11 00 Page 4 requests. After Government acceptance, either partially or for the entire area included in the Task Order, the Contractor shall perform hydoseeding as soon as practicable and only during periods when beneficial results can be obtained. Refer to Section 32 92 19 SEEDING.

In addition to dike raising work, the contract will include minor and incidental earthwork or dike repairs. These work items are not to exceed 10,000 CY per task order and will be classified under their own line item on the bid schedule.

Shoreline protection repairs are to be completed on the west, north or east sides of the facility under this contract as necessary. Some areas along the shoreline will require placement of additional armor stone.

Spillbox outfalls are located on the west side and will become the areas of primary concern. These measures are to protect against erosion of containment dikes.

Partial replacement of 36-inch currugated metal pipes will consist of removal of damaged section(s) of a pipe and its in-kind replacement. There are currently three spilboxes that use twelve currugated metal pipes (four pipes per spillbox) to drain clarified water from containmnet cells. These pipes have been degrading due to corrosion and exposure to salt water environment. All earthwork (excavation and backfill) associated with pipe repairs will be paid for under miscellaneous earthwork line item at the appicable bid unit price as indicated in the contract. The average length of pipes from spillbox to outfall is 270 ft.

Miscelanneous steel work at spillbox structures will involve an installation of permanent metal plates in place of damaged or failed timber weir board(s) to prevent an inflow of sediments. Metal plates will be installed either outside or inside the spillbox structure depending on current conditions at and around the spillbox. Work shall be performed in accordance with contract plans and specifications. Some damaged weir boards will be replaced with in-kind timber boards. Type of repair (steel plate or in-kind replacement) will depend on the location and extent of damage to exisiting weir board(s). Any excavation around the spillbox structure that may be required to successfully and safely perform necessary repairs will be paid for under under CLIN 0010 (see Section 01 22 00.00 10 PRICE AND PAYMENT PROCEDURES) at the appicable bid unit price as indicated in the contract.

1.2.3 Location

The work is located at the Craney Island Dredged Material Management Area which is located at the north end of the town of Portsmouth, Virginia on a peninsula extending into the Norfolk Harbor. Craney Island is directly west of downtown Norfolk, VA. The exact location is shown on the plans.

The USACE office is at the south-east corner of the site at: 4599 River Shore Road, Portsmouth, VA 23703 and can be contacted at 757-201-7605.

Access to the site is limited by fencing and access gates and requires USACE approval.

1.9 CONSTRUCTION MANPOWER AND EQUIPMENT REPORT

The Contractor shall submit executed CENAO Form 987, Construction Manpower and Equipment Report daily. The report shall include manpower and equipment for the general and subcontractors. Forms are available from the Contracting Officer.

1.10 PROFIT

For modifications to this Craney Dike Construction contract, profit must be calculated using the Weighted Guidelines method.

SECTION 01 11 00 Page 9

1.10.1 Weighted Guidelines

Weighted guidelines method of determining profit shall be used on any equitable adjustment change order or modification issued under this contract. The profit factors shall be as follows:

Factor Rate Weight Value

Degree of Risk 20% Relative difficulty of work 15% Size of Job 15% Period of performance 15% Contractor's investment 05% Assistance by Government 05% Subcontracting 25% Total 100%

1.10.2 Weighted Values

Based on the circumstances of each procurement action, each of the above factors shall be weighted from .03 to .12 as indicated below. The value shall be obtained by multiplying the rate by the weight. The value column when totaled indicates the fair and reasonable profit percentage under the circumstances of the particular procurement.

1.10.2.1 Degree of Risk

Where the work involves no risk or the degree of risk is very small, the weighting should be .03; as the degree of risk increases, the weighting should be increased up to a maximum of .12. Lump sum items will have, generally, a higher weighted value than the unit price items for which quantities are provided. Other things to consider: the portion of the work to be done by subcontractors, nature of work, where work is to be performed, reasonableness of negotiated costs, the amount of labor included in costs, and whether the negotiation is before or after performance of work.

1.10.2.2 Relative Difficulty of Work

If the work is most difficult and complex, the weighting should be .12 and should be proportionately reduced to .03 on the simplest of jobs. This factor is tied in to some extent with the degree of risk. Some things to consider: the nature of the work, by whom it is to be done, where, and what is the time schedule.

1.10.2.3 Size of Job

All work not in excess of $100,000 shall be weighted at .12. Work estimated between $100,000 and $5,000,000 shall be proportionately weighted from .12 to .05.

1.10.2.4 Periods of Performance

Jobs in excess of 24 months are to be weighted at .12. Jobs of lesser duration are to be proportionately weighted to a minimum of .03 for jobs not to exceed 30 days. No weight where additional time not required.

SECTION 01 11 00 Page 10

1.10.2.5 Contractor's Investment

To be weighted from .03 to .12 on the basis of below average, average, and above average. Things to consider: amount of subcontracting, mobilization payment item, Government furnished property, equipment and facilities, and expediting assistance.

1.10.2.6 Assistance by Government

To be weighted from .12 to .03 on the basis of average to above average.

Things to consider: use of Government owned property, equipment and facilities, and expediting assistance.

1.10.2.7 Subcontracting

To be weighted inversely proportional to the amount of subcontracting.

Where 80 percent or more of the work is to be subcontracted, the weighting is to be .03 and such weighting proportionately increased to .12 where all the work is performed by the Contractor's own forces.

1.11 BLASTING

Blasting will not be permitted for this project.

1.12 CONTRACTOR QUALITY CONTROL RESPONSIBILITY

The Contractor is fully responsible for the management and supervision associated with Quality Control of all construction work included in this contract. The Government is responsible for Quality Assurance by reviewing all Contractor documentation and work has been completed to meet contract requirements.

1.13 LIQUIDATED DAMAGES

Refer to contract clause LIQUIDATED DAMAGES – CONSTRUCTION (FAR 52.211-12) of Section 0700 CONTRACT CLAUSES in Volume 1.

1.14 PERFORMANCE BOND

The Contractor's Performance Bond shall remain effective throughout the construction period.

a. In the event the Contractor fails to commence and diligently pursue any construction warranty work required, the Contracting Officer will have the work performed by others, and after completion of the work, will charge the remaining construction warranty funds of expenses incurred by the Government while performing the work, including, but not limited to administrative expenses.

b. In the event sufficient funds are not available to cover the construction warranty work performed by the Government at the Contractor's expense, the Contracting Officer will have the right to recoup expenses from the bonding company.

c. Following oral or written notification of required construction warranty repair work, the Contractor shall respond in a timely manner.

Written verification will follow oral instructions. Failure of the Contractor to respond will be cause for the Contracting Officer to proceed against the Contractor.

SECTION 01 11 00 Page 11

1.15 DAMAGE TO THE WORK

The responsibility for damage to any part of the permanent work shall be as set forth in contract Clause PERMITS AND RESPONSIBILITIES of Section 0700 CONTRACT CLAUSES in Volume 1. However, if, in the judgement of the Contracting Officer, any part of the permanent work performed by the Contractor is damaged by flood, earthquake, hurricane, or tornado, which damage is not due to failure of the Contractor to take reasonable precautions or to exercise sound engineering and construction practices in the conduct of the work, the Contractor will make the repairs as ordered by the Contracting Officer and full compensation for such repairs will be made at the applicable contract unit or lump sum prices as fixed and established in the contract. If, in the opinion of the Contracting Officer, there are no contract unit or lump sum prices applicable to any part of such work, an equitable adjustment pursuant to Clause CHANGES in Section 00700 CONTRACT CLAUSES in Volume 1 will be made as full compensation for the repairs of that part of the permanent work for which there are no applicable contract unit or lump sum prices. Except as noted herein provided, damage to all work (including temporary construction), utilities, materials, equipment and plant shall be repaired to the satisfaction of the Contracting Officer at the Contractor’s expense, regardless of the cause of such damage.

1.16 PROTECTION OF EXISTING CONDITIONS AND NEW WORK

In addition to “FAR 52.236-9, Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements,” the Contractor shall:

a. Perform excavation, transportation, and construction operations in such a manner as to prevent injury or damage to any portions of the existing work which remain.

b. Perform excavation, transportation, and construction operations in such a manner to prevent injury and damage to new work. Repair or replace portions of new work which have been altered during construction operations, at no additional cost to the government.

c. Repair or replace portions of existing conditions which have been altered during construction operations to match existing or adjoining work, as approved by the Contracting Officer. At the completion of operations, existing surfaces and vegetation adjacent to the new work shall be in a condition equal to or better than that which existed before new work started.

PART 1 GENERAL

1.1 SUMMARY

This section describes how Line Items will be measured and paid for when making progress payments for this Craney Island (CI) Dike Construction contract . Work to be measured is described in the applicable specification sections listed for each Line Item. Measurement procedures for payment, required quantity surveys and/or procurement documentation and payment restrictions are also described in applicable specification sections. Allocate costs for work not specifically mentioned to the Line Item most closely associated with the work involved. Unless there is a specific Line Item for administrative costs, such as Quality Control and Safety, allocate such costs proportionally across all Line Items.

1.2 SUBMITTALS

Government approval is required for submittals with a "G" designation;

submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. Submit the following in accordance with Section 01 33 00 SUBMITTAL PROCEDURES:

SD-01 Preconstruction Submittals

Schedule Of Values; G

Using the information obtained from the Contractor's Before Dike (BD) surveys for the area specified in the Task Order, the Contractor shall submit a breakdown by Acceptance Areas for Line Item 0003 - Placement of Fill Material on Dikes Measured by BD/AD Surveys. Each Task Order will require its own Schedule of Values based on the area awarded . The maximum number of acceptance areas is based on the total distance between the stations per the layout of the Government's center line. The distance is the difference between the Task Order's starting and ending station numbers, which is then rounded up to the nearest 10,000, and then divided by 1,000 (for example: if the length is 135+00 feet, this rounds up to 14,000 and the maximum number of acceptance areas is 14).

The Schedule of Values should list all acceptance areas with their starting and ending station numbers, the dike length, the calculated volume of new fill, and surface areas for clearing and grubbing and hydroseeding, the agreed upon unit price, and the total contract dollar value for each acceptance area. A Schedule of Values shall be submitted for each Task Order. See Section 01 78 00 SURVEY AND RECORD CONSTRUCTION DRAWINGS for additional information.

1.3 LUMP SUM PAYMENT ITEMS

Payment items for the work on this Craney Island (CI) contract for which contract lump sum payments will be made are listed in the CONSTRUCTION

SECTION 01 22 00.00 10 Page 3

COST SCHEDULE and described below. All costs for items of work which are not specifically mentioned to be included in a particular lump sum or unit price payment item, shall be included in the listed lump sum item most closely associated with the work involved. The lump sum price and payment made for each item listed shall constitute full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for which separate payment is not otherwise provided.

Progress payments for lump sum line items will be made in accordance with the Payments listed Under Fixed-Price Construction Contracts clause of Section 00700 CONTRACT CLAUSES. If this contract contains either the Continuing Contracts clause or the Continuing Contracts (Alternate) clause, the Contractor should take into account the amount reserved for contract payments when preparing the construction schedule.

1.3.1 Cost Schedule Line Item No. 0001 - Mobilization and Demobilization

1.3.1.1 Mobilization and Demobilization

This pay item includes all costs connected with the mobilization and demobilization of all of the Contractor's equipment, as defined below, which will be paid for at the contract lump sum price for this item (exclusive of work included in line items 0002 to 0014). Sixty percent (60%) of the lump sum price will be paid to the Contractor upon completion of his mobilization to the work site. The remaining forty percent (40%) will be paid to the Contractor upon completion of a full demobilization at the end of the contract. In the event the Contracting Officer considers that the amount in this item, sixty percent which represents mobilization and forty percent which represents demobilization, does not bear a reasonable relation to the cost of the work in this contract, the Contracting Officer may require the Contract or to produce cost data to justify this portion of the bid. Failure to justify such price to the satisfaction of the Contracting Officer will result in payment of actual mobilization costs, as determined by the Contracting Officer, at the completion of mobilization, and actual demobilization costs, as determined by the Contracting Officer, at the completion of demobilization. The determination of the Contracting Officer is not subject to appeal.

Full mobilization is defined as the initial movement of the Contractor onto the site and associated documentation in preparation for the start of construction. Payment for this initial mobilization will be included in the first Task Order issued as well as the final full demobilization.

1.3.1.2 Full Mobilization

Full mobilization shall include all costs for operations accomplished prior to commencement of actual construction operations. This shall include, at a minimum, the following:

a. Transportation of personnel, equipment, and materials to the job site.

b. Any required labor and materials to set up working operations including installation of the Contractor's office trailer (i.e.

administrative, electricity, telephone, lay down area

SECTION 01 22 00.00 10 Page 4 preparations, etc.)

c. Construction of access to the construction area.

d. All cost for any other associated work that is necessary in advance of the actual project including establishment of project management and coordination.

e. To support the preparation of the specification required documentation specified as being due before actual construction work can start at the site including, but not limited to, a quality control plan, work plans as required by individual specifications, a progress schedule, an accident prevention plan;

an activity hazard analysis, and an_environmental protection plan.

A complete set of documentation will be required for each individual Task Order .

1.3.1.3 Full Demobilization

A full demobilization shall include all work required for a final closeout of project including, but not limited to, permanent transportation of personnel, equipment, and materials from the job site, decommissioning of temporary facilities , and cleanup of all work areas. Except for the new dike construction areas, all sites shall be returned to their original condition as found at contract award and as determined by the Contracting Officer. Full demobilization may also be paid at the end of a task order and should only occur when the Contractor, in agreement with the Contracting Officer, is leaving the site with no expectation that a new task order is going to be issued for the foreseeable future. Additionally, if a subsequent task order is not awarded within 30 days after completion of a task order, the full demobilization will be paid; the Contractor will be entitled to another full mobilization/demobilization once the next task order is awarded. Partial demobilization and remobilization may be paid under the payment item no. 0002.

Anticipated quantity: 1 full mob/demob per contract year.

1.3.2 Cost Schedule Line Item No . 0002 - Partial Demobilizations and Remobilizations

The Government expects to award multiple task orders during each of the three contract years in a sequential and timely manner so that the Contractor will remain working continuously between Task Orders, and may leave his equipment on-site during the transition between Task Orders.

This line item is to cover partial demobilizations and then remobilizations of equipment and personnel when the Government does not award the subsequent Task Order within 10 to 30 days after completion of previous task order which results in the Contractor temporarily and partially removing equipment and personnel from the site while waiting for the next Task Order to be issued (exclusive of work included in line items 0001;

and 0003 to 0014).

This line item is to cover all contractor costs to leave equipment on site, return equipment to the site if removed, including transportation costs, maintenance costs, and all other associated costs for the period of time between the completion of work on a task order and the award of the subsequent task order. This line item does not apply if a subsequent task order is awarded within 9 days of completion of a previos task order. No costs will be paid for equipment, including transportation costs, SECTION 01 22 00.00 10 Page 5 maintenance costs, and all other associated costs if the Contractor has removed the equipment from the Craney Island site for other work during this delay.

The Government's intent is to notify the Contractor within 9 days after completion of a task order whether a subsequent task order is going to be awarded within 30 days following the completion of a task order.

1.4 UNIT PRICE PAYMENT ITEMS

Payment items for the work of this contract on which the contract unit price payments will be made are listed in the CONSTRUCTION COST SCHEDULE and described below. The unit price and payment made for each item listed constitutes full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for each of the unit price items The contract unit price multiplied by the agreed upon quantity is considered full compensation for all work, included in the Task Order.

1.4.1 Cost Schedule Line Item No. 0003 – Placement of Fill Material on Dikes Measured by BD/AD Surveys

This line item includes payment for placement of fill material on dikes (measured by BD/AD surveys)and shall be by cubic yard of soil placed, compacted, and accepted by the Government as detailed in the contract drawings and specifications (exclusive of work included line items 0001 to 0002; and 0004 to 0014). Work at the borrow sites is included in this line item including excavation, mixing of materials, and transport to the dike construction areas. All methods, material and labor required to construct this item in accordance with plans and specifications shall be all inclusive and complete but does not include material placed in the containment cell or lost due to compaction. All work and quantities shall be verified and approved by the Contracting Officer's Representative. See Sections 31 00 00 EARTHWORK and 35 41 01 LEVEE CONSTRUCTION.

Anticipated quantity: 200,000 - 300,000 cubic yards per contract year.

1.4.1.1 Measurement

The unit of measurement is by cubic yard. Contractor will submit their calculation of quantities by acceptance area along with AD surveys as part of their payment requests. Both the BD and AD surveys shall have the same placement templates which shall be used to determine volumes.
