About this file
This is a Justification for Other Than Full and Open Competition document submitted by the Defense Logistics Agency (DLA) Troop Support, Subsistence Supply Chain, authorizing a sole source award under 41 U.S.C. § 1901 based on unusual and compelling urgency.
DLA Troop Support seeks to procure 35 line items of food service equipment and related supplies to support the Navy Ashore Galley modernization pilot program. Required items include various counters (curved, straight, utility, front, panini, and bread), sneeze guards, countertops, faucets, food well units (hot/cold, drop-in and refrigerated variants), induction ranges, mobile heated cabinets and plate dispensers, undercounter refrigerators and freezers, undermount sinks, ice bins, commercial food blenders, ice makers, refrigerated work tops, sandwich/panini grills, microwave ovens, conveyor toasters, counter freezers, and fry pans. The contracting officer determined the anticipated cost will be fair and reasonable. The justification was submitted on April 15, 2026, and cites the requirement for delivery by May 29, 2026. The urgent timeline results from an extended government shutdown that delayed funding availability until March 27, 2026, while the completion deadline remained unchanged. The contracting officer notes that typical competitive acquisitions require minimum 30-day solicitation periods and 120-day delivery lead times, which would prevent performance within the compressed timeframe. Future similar requirements will be solicited through standard FAR Part 12 procedures once adequate lead time is available.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION UNDER
AUTHORITY OF 41 U.S.C. 1901
1. Defense Logistics Agency (DLA) Troop Support, Subsistence Supply Chain, is the contracting activity.
2. The action being approved is the ability to solicit for DLA requirements on an Other than Full and Open Competition basis under Federal Acquisition Regulations (FAR) 12.102 for Unusual and Compelling Urgency.
3. DLA Troop Support intends to make a sole source award based on urgent and compelling circumstances. The following are the supplies required to meet DLA’s needs:
Line Item Description
1 CURVED COUNTER
2 SNEEZE GUARD, STATIONARY
3 STRAIGHT COUNTER
4 UTILITY COUNTER
5 FRONT COUNTER
6 SNEEZE GUARD, STATIONARY
7 COUNTERTOP

10 SNEEZE GUARD, STATIONARY
11 PANINI COUNTER
12 BREAD COUNTER
15 INDUCTION RANGE, COUNTERTOP
16 MOBILE PLATE AND DISH DISPENSER
17 MOBILE HEATED CABINET
18 UNDERCOUNTER REFRIGERATOR
21 UNDERCOUNTER REFRIGERATOR
23 UNDERMOUNT SINK
25 COMMERCIAL FOOD BLENDER
27 MOBILE HEATED CABINET
28 REFRIGERATED WORK TOP
29 MOBILE PLATE AND DISH DISPENSER
31 SANDWICH / PANINI GRILL
32 MICROWAVE OVEN
33 CONVEYOR TOASTER
34 COUNTER FREEZER
35 FRY PAN
4. The statutory authority permitting other than full and open competition is codified at 41 U.S.C.
§ 1901 and is implemented by the FAR. This justification is based on Revolutionary FAR Overhaul (RFO), Restricting Competition, and the applicable procedures in FAR 12.201-1 Simplified Procedures, as implemented by the Department of War Class Deviation to FAR Part 12.
5. The use of this authority is necessary because the inability to award and deliver customer requirements by May 29 would result in the Government to be seriously injured, financially or otherwise. Due to the extended Government shutdown and unavailability of funds, the customer was unable to fund this requirement through DLA Troop Support until March 27, 2026. While the availability of funding was significantly delayed, the required completion date did not change. This procurement supports the pilot program of Navy Ashore Galley modernization efforts
6. This acquisition was not synopsized due to its urgent and compelling nature, and in accordance FAR 5.101(b)(2).
7. As the contracting officer, I hereby determine that the anticipated cost to the Government will be fair and reasonable
8.
9. Typical acquisitions similar to this requirement require site visits from interested and development of drawings from interested vendors. Solicitation for competitive acquisitions are opened for no less than 30 days to provide reasonable time for this activity. The lead time for delivery of supplies and incidental installation services of resulting awards are no less than 120 days. Given the timeframe allotted for this requirement, the beforementioned process would severely prohibit the ability of this requirement to be fully performed against withing the timeframe required.
10.
11. There will not be a subsequent acquisition for the supplies or services for this specific requirement. For future, similar requirements, DLA Troop Support expects to receive funded requirements with ample lead time for contract performance, due to lifting of Government shutdown. DLA Troop Support FTRD will solicit for these requirements in accordance with FAR Part 12 procedures.
12. As the Contracting Officer, I hereby certify that this justification is accurate and complete to the best of my knowledge and belief.
