About this file

This document is a Request for Response (RFR) from the Massachusetts Department of Mental Health (DMH) seeking to establish a pool of individuals and non-profit corporations to provide guardianship and/or conservatorship services for individuals receiving services from or paid for by DMH. The RFR outlines the responsibilities of the selected vendors, including attending required court hearings, preparing reports for the Probate Court, and declining cases with conflicts of interest. The minimum qualifications for guardians are specified, and vendors can apply to provide services throughout the state. DMH will consider factors such as proximity to the individual in selecting a guardian.

The RFR states that the rate is non-negotiable, and DMH will not absorb the liability insurance costs incurred by the vendors. DMH is not considering a reciprocal arrangement with other agencies to serve as one another's guardians.

Would DMH permit an appeal for particular experienced guardians that we already work with but are not licensed (i.e., ministers)? The minimum requirmeents are set forth in Section 4 of the RFR. Having a license (attorney, or other professional license) is not a requirment. Key requirments include having expereince providing Guardianship Servies and experience working with individuals with serious mental illness. There are other requirments, but licensing is not one. Please review Section 4 for more information.

Can we apply for different regions in one application? If you apply and are qualified, you can provide services throughout the state. The application process is not by DMH Area. 71/13/23Jennifer Higgins/Center for Human DevelopmentQuestions for First Round Applications7. Would DMH consider a reciprocal arrangement with another agency to serve as one another's guardians to avoid any conflict of interest? We are not sure what the question is asking. This RFR is exclusive to DMH. Guardians would be expected to decline cases in which their accepting an appointment would result in a conflict of interests.
