Amendment 1 Questions and Answers – 02/28/2017

1. The GSA’s position is to require a payment and performance bond for $2M. This is a considerable financial investment required by a small business contractor to just provide the payment and performance bonds for this contract. Our bonding rate is slightly above 1%. A $2M payment and performance bond will cost us $21,500.00. According to the solicitation and this morning’s statements a payment and performance bond will be required with only a $1,000 guarantee for the contract. Thus, a potential loss of $20,500.00. Typically in IDIQ contracts the contractor is required to provide a letter from its surety stating its bonding capacity for evaluation purposes and payment and performance bonds are provided on a task order basis upon award. By providing payment and performance bonds per task order the contractor does not have to purchase bonding in excess of the actual awarded value. Would the GSA consider changing the requirements to require payment and performance bonds on individual task orders?

Answer: Bonding Requirements have been changed. See Section I.H. of the amended Agreement.

2. What is the average number of projects for each region and the average expected project value for task orders under this IDIQ?

Answer: We cannot provide an estimated amount of projects as this can be misleading. The number of projects is based on funding and need each fiscal year. However the average task order the past year has been between $20,000 - $30,000.00. The average task order value under this new contract could vary significantly from procurement history and is not a basis for any adjustment in contract pricing or terms.

3. Will the RS Means database be allowed to be updated as quarterly and annual updates are available? Or is the database at the time of award used for the duration of the base and all option years?

Answer: See Section II.A.

4. Is there a specific RS Means software required?

Answer: No, RS Means does have software called CostWorks. The contractors may use this software but need to make sure that the prices used are the book prices and not prices that have been adjusted via monthly/quarterly updates in the software. The use of the software is not required for this particular contract, but contractors may find it helpful.

5. How will the wage rates be updated during the contract? Will they be updated as updated when changed by the Department of Labor, updated at contract renewal or remain constant at the rates as of contract award?

Answer: See Section I.G.3.d. When each option year is exercised, the current wage rates at that time will be incorporated into the contract via contract modification (when the option is exercised). So these will be updated yearly.

6. Referencing III.B.2, is the intent of this IDIQ to be a Design/Build contract or a Design/Bid/Build contract? Will contractor provided A/E drawings be required for all task orders? If not what percentage of task orders would be considered Design/Build?

Answer: Section III.B.2. has been deleted in the amended Agreement. The contractor is not responsible for professional design services. GSA will provide the contractor with a scope of work and the contractor will then prepare their bid for construction services using the line items they feel are needed to complete the work. GSA will review those line items and negotiate accordingly.

7. Regarding the required $2M payment and performance bond, will the contractor be allowed to invoice for the cost of the payment and performance bond upon receipt by the GSA?

Answer: No, the cost of bonding shall be included in your bid factor and the contractor only recovers its cost of the bonding over time as it completes a sufficient number of task orders.

8. If a $2M payment and performance bond is provided and the GSA does not use the full capacity of the bond, will the GSA reimburse the contractor for the difference in costs? For example; a $2M payment and performance bond will cost approximately 1% or $20,000.00. If the GSA only awards $1M during the life of the contract, will the GSA reimburse the cost of $10,000 for providing an extra $1M in payment and performance bonds that were not required?

Answer: No.

9. The RS Means book has a Division 1 General Requirements Section, in addition to all of the other specific work item Divisions. The Division 1 Section provides allowances for project conditions, construction management fees, office expenses, permits, quality control, temporary utilities, office and storage space, scaffolding, temporary barricades and on and on. Most of the JOCs that we have seen, did not allow the use of Division 1. During the Pre-Bid Conference call, it was said that the contractor is to build each proposal using line items “bare costs” and without use of the City Cost Indexes; but the question was not answered if the use of Division 1- General Requirements Section is allowed?

Answer: See Section II.A. of the amended Agreement. The Division 1 – General Requirements section from the RS Means Book will NOT be allowed when pricing task orders under the contract. Any consideration for Division 1 – General Requirements must be included in the offeror’s bid factor.

10. Federal Building’s covered under this contract?

Answer: Below is a list of addresses for Federally Owned Federal Buildings and U.S.

Courthouses within Region 6 of the Public Buildings Service (the list may not be all-inclusive and may change over the life of the contract). As stated in the Pre-Proposal Conference, Region 6 PBS also has hundreds of leased locations that may require service under the subject contract. However, the vast majority of work is expected to be within the Federally Owned Inventory.

11. What is the fee for security clearances?

Answer: There is no fee for the contractor to obtain security clearances.

12. Who is the incumbent contractor?

Answer: The incumbent contractor is The Wilson Group, 1606 W Main St, Greenwood, MO 64034.

14. Should clause 52.208-9 be added?

Answer: See amended Agreement. GSA has included FAR 52.208-9.

15. Are the subcontractors that we are proposing need to be from one project or can they be from multiple projects?

Answer: This factor is seeking subcontractors that you have established relationships with, these are not project specific.

16. Just to confirm, a scanned copy of the bid bond may be submitted on the bid date with the proposal package, via email? We are to mail the original copy by mail which does not have to arrive on the bid date?

Answer: Correct

17. Page 11 & 12 of Solicitation – Project Experience & Past Performance. This is for three projects that we deem as similar in nature. Can these projects be lump sum contracts if they are similar in nature?

Answer: Please refer to II.D.C.1 of the solicitation for the requirements. GSA cannot provide further guidance on how the contractor meets this requirement.

18. Page 12 of Solicitation – Contract Experience & Past Performance. This is for one project that we deem as similar in nature to the proposed IDIQ contract? If we cannot propose this type of project does this eliminate us from obtaining the award?

Answer: II.D.C.2 of the solicitation for the requirements. One factor will not “eliminate” anyone.

Each proposal will be evaluated using the criteria set forth in II.D.C.2. If your project lacks what is being evaluated then there may be a reduction in score, but this is not a go / no go factor.

Partial point could still be obtained.

19. How many awards will be made for each geographical area?

Answer: See section I.A of the solicitation.

20. Page 6 of Solicitation. I.H Receipt of Offers. Time of the bid to be received; in the narrative, it indicates 5:00pm local time and below under time it indicates 2:00pm central time. Could you please confirm which time is correct?

Answer: Corrected via amendment 1

21. Since the GSA building locations are spread out in each geographical area. We could potentially incur travel from our home office location. Should the travel, lodging & per-diem (items 19 & 21) be placed in our Bid Factor even though many of the potential projects maybe in our home office location and would not require these travel costs? Should overtime costs be accounted for in the Bid Factor or is that an additional cost that will be addressed on a job by job basis?

Answer: See the Agreement Section II.A, no cost will be renegotiated at the task order level.

All contractor cost should be included in their bid factor.

22. Does the GSA make the decision if the option is renewed for the next year(s) or is this decision mutually agreeable by the GSA and awarded contractor; meaning either party can choose to decline, thus ending the agreement?

Answer: The exercise of each Option Year is the unilateral right of the Government.
