COURT OF INTERNATIONAL TRADE

JUDGES’ ELEVATOR MODERNIZATION PROJECT

AMENDMENT 1 TO SOLICITATION GS02P16PVC70002

Questions & Answers

1. Please provide photographs of the following: Car top, pit showing compensation cable & sheave pit ladder light switch and buffers, and full view of the cab.

Photographs are below:

2. Please confirm the 14 items listed in the Project Information IA Project Summary titled “Scope of Work” are actually the “Statement of Work” that is referenced in the bid documents.

“Scope of Work” explains what services are to be included in this particular project and the work that will be performed under a future contractual agreement. It is a subset of information that is included in a “Statement of Work.”

The “Statement of Work” itself is the comprehensive list of requirements and specifications for performance and delivery of the project in its entirety, but not set in stone until it is part of a finalized contractual document.

Therefore, “Scope of Work” is NOT the same thing as “Statement of Work,” (SOW) however, the scope information is included as part of the SOW.

(Solicitation sections referenced: Page 2 of the SOW, under “1. Project Description” or the second page of the contract draft model following the table of contents “I. Project Information, I.A. Project Summary” which mirrors the same section from the SOW).

3. During the site visit, it was indicated a new cab is not part of this bid. However, in the scope of work (aka Statement of Work) the fifth item on the list states “New Cab”.

Please clarify is a new cab required as part of this bid.

The project is to be per the Statement of Work and therefore includes a new cab.

4. Technical Questions:

A. Do the sheaves in the wheelhouse on the roof need to changed (new), checked or refurbished? That is not addressed in the “Scope of Work”.

The sheaves in the wheel house needs to be new.

B. What manufacturer & type of door operator is required?

GAL or Otis or an approved equivalent is required.

C. Is it a GAL or Otis or another manufacturer?

GAL or Otis or an approved equivalent is okay.

D. What type of controller?

An Otis controller or an approved equivalent will be required.

E. Since this is a designbuild project can the contractor use a controller which is custommade into proprietary equipment? If so, can the contractor own the software and diagnostic tools for troubleshooting?

No, the controller cannot be custommade into proprietary equipment. The contractor shall use a wellknown manufacturer’s standard product that is easy to acquire and maintain.

5. The scope of work does not provide for any maintenance after the government accepts the project. Normally, there is a 1year warranty on the parts & labor. Does that standard apply to this project?

YES, a 1year warranty does apply to this project.

Referencing SOW page 17, section 3.3.1.3.1 “Warranties, Guarantees and Certificates”:

contractor shall “prepare and submit warranties, guarantees, and certificates, ensuring the GSA rights and responsibilities are clearly defined. This includes, but is not limited to, all warranty/guarantee/certification necessary to verify that the property meets the standards of Local Law 11.”

Referencing CONTRACT AGREEMENT DRAFT Section I.V.B. Clauses Incorporated by Reference:

FAR 52.24621 Warranty of Construction (Mar 1994) is included, which covers a 1year warranty for the government “from the date of final acceptance of the work.”
