CONTRACTOR SUITABILITY - APPLICANT INSTRUCTIONS

UPDATED DECEMBER 11, 2014

INTRODUCTION

Homeland Security Presidential Directive 12 (HSPD-12) established the Policy for a Common Identification Standard for Federal Employees and Contractors. To comply with HSPD-12 and to address the need for management controls on contractor suitability determinations, the New England Region developed standard operating procedures (SOP) to meet the requirements of HSPD-12 and track the processing of requested suitability determinations. These instructions were created to assist contractors in the process and to coordinate contractor suitability with the Office of Personnel Management (OPM). These instructions provide information on the roles and responsibilities through the contractor suitability determination process and ensures the timely renewal of all suitability clearances. The Regional Credentialing Officer (RCO) and Office of Mission Assurance (OMA) staff are designated as the POCs for the Contractor Suitability Determination Program. All designated company point of contacts are encouraged to read these instructions in their entirety and contact the OMA staff with any questions or should you need clarification.

For FY 2015, the Office of Personnel Management (OPM) is implementing the Federal Investigative Standards (FIS) according to the phased Federal Investigative Standards Implementation Plan issued by the Suitability and Security Executive Agents. Consistent with the Initial Operating Capability (IOC) requirements of the FIS Implementation Plan, OPM is conducting Tier 1 investigations in lieu of the former National Agency Check and Inquiries (NACI) (SF 85) product and Tier 2 investigations in lieu of the former Moderate Risk Background Investigation (MBI) (SF-85P). During OPMs transition and throughout this instruction, the terms NACI and Tier 1 Investigation are interchangeable.

DEFINITIONS, ROLES AND RESPONSIBILITIES

A. Contractor Suitability Clearance Point of Contact (CSC) (POC). A non-federal employee serving as the applicant’s direct representative. The Contractor Suitability Clearance Point of Contact must remain actively involved in the Regional Contractor Suitability Program during the entire contract duration by serving as a liaison between the Applicant, Contract Company and the GSA Office of Mission Assurance (OMA) Boston Office.

B. Declaration for Federal Employment (Optional Form 306). Required document to be submitted for both a Temporary Contractor requiring a Special Agreement Check (SAC) and Long Term Contractors requiring a National Agency Check with Written Inquiries (NACI) suitability determination process.

C. Electronic Questionnaire for Investigations Processing (E-QIP). A web-based application system which houses the electronic version of the Standard Form 85 (SF- 85). E-QIP is governed and mandated by the Office of Personnel Management (OPM).

D. GSA Contracting Officers Technical Representative/Project Manager (COTR)/PM.

Government employees who have the authority to do the following:1) determine escorts;

2) notify DHS/FPS in writing of escorted contractors. GSA COTR/PM includes but is not limited to the following positions: Contracting Officers, and Property Managers.

E. GSA Office of Mission Assurance Boston (OMA) Office. The GSA OMA Boston Office maintains the responsibility for the Regional Contractor Suitability Program and is the liaison between GSA and OPM. OMA staff have the authority to do the following: 1) coordinate processing of an applicant’s suitability request; 2) notify appropriate CSC POC of suitability determination; 3) perform other duties associated with the Contractor Suitability Program.

F. Long Term Contractor - U.S. or Naturalized Citizen or Non-U.S. Citizen legally residing in U.S. A non-federal employee performing only project work on Federal premises on a recurring basis for 181 calendar days or more. These individuals must have a National Agency Check with written Inquiries (NACI), if only the non-federal employee is residing in the U.S. for 3 or more consecutive years.

G. National Agency Check with Written Inquiries (NACI). A background check that consists of a NAC with written Inquiries and searches of records covering specific areas of an individuals background during the past seven years (inquiries sent to current and past employers, schools attended, references, and local law enforcement authorities). A NACI is valid, provided there is no break in service greater than 2 years from the date OPM completes the suitability determination.

H. Special Agreement Check (SAC). A limited investigation (or series of checks) done only through special agreement between OPM and GSA. The SAC provides an alternative procedure by which the GSA can obtain searches specific to its particular needs, and includes: Security Agency Checks, FBI National criminal History Checks and Law Enforcement Checks. GSA uses the SAC for all Temporary Contractor suitability determinations. A SAC is valid for 180 calendar days from the date OPM completes the check.

I. Suitability Determination. This process is used for determining if a contractor is suitable to work on Federal property. A suitability determination establishes a contractor’s loyalty, character, trustworthiness, reliability and therefore eligibility for the issuance of a GSA identification credential. Suitability determinations are either favorable or unfavorable.

J. Temporary Contractor. A non-federal employee performing only project work on Federal premises on a recurring, non-recurring, or intermittent basis from 1 calendar day up to 180 calendar days. These individuals must have a Special Agreement Check

(SAC).

K. Tier 1 is the investigation for positions designated as low-risk, non-sensitive. It is also the minimum level of investigation for a final credentialing determination for physical and logical access. Tier 1 investigations are requested using the Standard Form (SF) 85.

L. Tier 2 is the investigation for non-sensitive positions designated as moderate risk public trust positions. Tier 2 investigations are requested using the SF 85P.

CONTRACTOR SUITABILITY DETERMINATION PROCESSES

A. Temporary Contractor. A non-federal employee performing only project work on Federal premises on a non-recurring, or intermittent basis from 1 to 180 calendar days.

These individuals must receive a Special Agreement Check (SAC) resulting in a Favorable Determination.

Previously, OPM conducted a National Agency Check (NAC) for Temporary Contractors. Per the GSA/OPM MOA, SACs are now the required background check.

The process is as follows:

1. The GSA Office of Mission Assurance (OMA) Boston provides the following information to the CSC POC:

# GSA Contractor Information Worksheet (CIW) with sections 2 through 5 completed.

# OF 306 Declaration for Federal Employment # List of Acceptable Documents (derived from Form I-9)

2. The CSC POC, working with the applicant, ensures completion of the CIW and OF- 306 for transmission electronically to R1HSPD12.Security@GSA.GOV.

# The CSC POC will send the CIW with Section 1 completed entirely to the R1HSPD12.Security@gsa.gov in a password protected file. Multiple files can be included in one email in the format: Last Name, First Name, Middle Initial and last 4 digits of the Social Security Number (i.e. Smith, John, E 5077). A second email containing the password must follow.

# Questions 1-13 of the OF 306, and if applicable, Question 16 for continuation purposes. Original signature and date of the applicant are required on page 2, Question 17a. Except where a signature is required, all fields are to be typed.

The CSC POC will then submit the form as a password protected attachment in an e-mail following the process above.

# The following requirements apply to U.S. Citizens who were born in a foreign country, are foreign born citizens, or are dual citizenship holders and is required in addition to the above documentation. If applicable please send these documents following the process above.

" If the applicant is a U.S. Citizen and was born in a foreign country, they must submit either a copy of the front page of their U.S. Passport or a copy of their U.S. Citizenship Naturalization Document.

" If the applicant is a foreign born citizen and is now a U.S. Naturalized Citizen, they must submit a copy of their U.S. Citizenship Naturalization Document.

" If the applicant is a foreign born citizen and resides in the U.S., they must submit a copy of their USCIS Alien Registration Document.

# Upon submission of the above documents to the OMA Boston Office, the applicant should look for an email from USAccess Center which will include a link (https://app3.timetrade.com/tc/login.do?url=usaccess) where they will be able to schedule an appointment for fingerprinting at one of over 200 enrollment stations nationwide. Fingerprint submissions are to be completed electronically utilizing OPM’s Fingerprint Transaction System (FTS). If applicable the OMA Boston Office will provide these cards directly to the CSC POC.

# GSA OMA Boston Office may accept faxed documents on a case-by-case basis. Due to Privacy Act Regulations you must contact the OMA office and request the fax number. All forms must be typed with original signatures. Hand-written forms will not be accepted.

# OMA Boston does NOT make adjudication or suitability determinations, only ensures the appropriate parties are aware of what documentation is required.

3. The Contractor Investigation Team shall complete the SAC suitability determination as required under the GSA/OPM MOA. Upon completion of the investigation, OPM electronically forwards the results of the suitability determination to the OMA Boston Office. Suitability Determinations may be either:

# Favorable. The applicant is determined to be suitable to perform work in the building for up to 180 calendar days.

# Unfavorable. The applicant is determined to be unsuitable to perform work in the building. This determination is frequently based upon an inconsistency between the forms submitted by the applicant and the law enforcement checks.

5. The GSA OMA Boston Office then emails the CO, COTR, and the CSC POC the results of the suitability determination. Applicants may not begin work on-site prior to a Favorable Suitability Determination. An Unfavorable Suitability Determination is final.

C. Long Term Contractor - U.S. or Naturalized Citizen or Non- U.S. Citizen legally residing in U.S. A non-federal employee performing work on Federal premises on a recurring basis for 181 calendar days or more (mechanical, janitorial, elevator, IDIQ construction contractor and cafeteria worker). These individuals must receive a National Agency Check with Written Inquiries (NACI) or Tier 1 Investigation, Favorable Suitability Determination. Applicants may not begin work on-site prior to a Favorable Suitability Determination.

In order to be eligible for a NACI/Tier 1 Investigation determination, the employee must have been residing in the U.S. for 3 or more consecutive years. If U.S. residency has been less than three years, the employee must be processed as a temporary contractor as outlined in Section A above.

The NACI/Tier 1 Investigation process is as follows:

1. The GSA OMA Boston Office provides the following to the CSC POC:

# Contractor Information Worksheet (CIW) with sections 2 through 5 completed.

2. The CSC POC, working with the applicant, ensures completion of the CIW and returns the completed encrypted form electronically to R1HSPD12.Security@GSA.GOV.

# Upon receipt of the CIW by the OMA Boston Office, the background investigation process will be initiated and the applicant will receive an email, sent to the email address contained in Section 1 of their submitted CIW, inviting them to complete the eQip application. The CSC POC will be notified of this via email as well.

# Upon submission of the CIW to the OMA Boston Office, the applicant should also look for an email from USAccess Center which will include a link (https://app3.timetrade.com/tc/login.do?url=usaccess) where they will be able to schedule an appointment for fingerprinting at one of over 200 enrollment stations nationwide. Fingerprint submissions are to be completed electronically and OPM will only accept Standard Form 87 (SF-87) fingerprint charts from those applicants residing greater than 100 miles (one way) from the nearest enrollment station. If applicable the OMA Boston Office will provide these cards directly to the CSC POC.

3. The applicant must:

# Complete the eQip questionnaire. The applicant has 7 calendar days to login to the eQip system and establish an account, followed by another 7 calendar days to complete the E-QIP application. If the applicant does not respond timely, the system will terminate the applicant’s invitation. If an application is terminated, the GSA OMA Boston Office will email the CO, COTR/PM, and CSC POC of the termination and the entire application process must begin again. The applicant must:

" Complete the eQip application " Complete questions 1-13 of the OF 306, and if applicable, Question 16 for continuation purposes. Print, sign and date the form. With the exception of those fields requiring signature, all required fields are to be typed.

" Scan and attach applicable documentation to the SF85 in eQip.

" Digitally sign 2 signature pages of the eQip application (CER & REL) " Release the document within eQip (Release to Agency)*

* NOTE: Applicant must be fingerprinted prior to releasing their SF85 in eQip.

# A copy of two documents that establish “proof of identity” as listed on page 9 of the Form I-9 Employment Eligibility Verification must be provided at the time of fingerprinting. Additional information will be provided when scheduling the fingerprinting appointment at an MSO station.

# The following requirements apply to U.S. Citizens born in a foreign country, foreign born citizens, and dual citizenship holders and are required in addition to the above documentation.

" If the applicant is a U.S. Citizen and was born in a foreign country, they must submit either a copy of the front page of their U.S. Passport or a copy of their U.S. Citizenship Naturalization Document.

" If the applicant is a foreign born citizen and is now a U.S. Naturalized Citizen, they must also submit a copy of their U.S. Citizenship Naturalization Document.

" If the applicant is a foreign born citizen and resides in the U.S., they must also submit a copy of their USCIS Alien Registration Document. If the applicant claims dual citizenship, they must sign, date and submit the DHS ICE Citizenship Declaration Form.

4. A Help Desk has been established to provide applicants assistance with eQip processing. They can be reached by calling 202-969-4101 between the hours of 9:00am

– 5:00pm EST or by e-mail at Contractor.Investigation@GSA.GOV.

5. OPM reviews the eQip package, including attached forms to ensure all required information has been provided. If errors or omissions are detected, OPM will reject the eQip submission back to the contractor for correction. Once corrected, the contractor will resubmit to OPM via eQip in accordance with paragraph 3.

6. OPM will complete the preliminary suitability portion, as required under the GSA/OPM MOA. Upon completion of that investigation, OPM electronically forwards the results of the preliminary suitability determination to the OMA Central Office and forwards the eQip package to the Federal Investigation Section (FIS) of OPM for final suitability processing.

Suitability Determinations may be either:

# Pre-Favorable. The applicant is determined to be suitable to perform work in the building up to 180 calendar days. If the applicant has not received a Favorable NACI/Tier 1 Investigation by the end of the 180 calendar days, he/she may continue to work under the existing determination until further notice.

# Unfavorable. The applicant is determined to be unsuitable to perform work in the building. This determination is frequently based upon an incongruity between the forms submitted by the applicant and the law enforcement checks. The applicant may appeal this decision within 30 calendar days. All appeals on Unfavorable Suitability Determinations are handled by OPM.

# Clarification. The applicant must contact the OPM Federal Investigative Service (OPM-FIS) within 15 calendar days to provide additional information in order to complete the background investigation for a suitability determination. Failure to respond within the above time-frame will result in an Unfavorable Suitability Determination.

# Favorable NACI/Tier 1 Investigation. Upon completion of OPM investigation and final Favorable Suitability Determination by OPM, the CO, COTR/PM, and CSC POC will receive notification from GSA OMA Boston Office of the applicant’s NACI/Tier 1 Investigation determination.

7. The OMA Boston Office emails the CO, COTR, and the CSC POC the result of the suitability determination.

8. In the event the applicant receives an Unfavorable or Clarification Suitability Determination, the applicant is afforded an opportunity to explain and correct any inconsistencies by providing additional supporting documentation to OPM FIS, which may or may not change the suitability determination.

9. The GSA OMA Boston Office must provide an up to date list of all cleared Contractors to the local DHS/FPS Official. The Contract Company is responsible for providing the following information in order for OMA Boston to compile and maintain the Contractor list:

# Building name and location of work (i.e. room number, floor and agency) # Name and address of Contractor Company # Last, First and Middle name of all Contractor(s) # Dates and times of activity.

Personal Identity Verification (PIV) Card Tracking- In the rare instance the contractor is issued a PIV card for the performance of their duties, as outlined in the contract, the following must be adhered to.

1. Contractors that have been issued PIV Cards are required to return their PIV Card to their government sponsor when one of the following occurs:

# Termination of employment # Expiration of PIV Card # Completion of contract in which the PIV Card was issued (if the contractor is anticipated to work on future contracts, there is no justification to retain a PIV Card).

# PIV Card is no longer needed to complete work
