About this file
This document is a Class Justification and Approval (CJ&A) from the Naval Air Systems Command (NAVAIR) authorizing a sole-source follow-on Basic Ordering Agreement (BOA) with General Electric Aerospace (GEA) for CH-53K T408-GE-400 (T408) engines and associated support equipment. The agreement covers engineering development model (EDM) engines, system demonstration test article (SDTA) engines, low-rate initial production (LRIP) engines, full rate production (FRP) engines, foreign military sales (FMS), and engine improvements. The contract will support program management, engineering, logistics support, recurring and non-recurring requirements, and various technical studies through 30 September 2030.
NAVAIR determined GEA is the sole source for these specialized engines due to their unique corporate investments, technical expertise, and historical development of the CH-53K engine. Market research including two Sources Sought notices and two Synopses on SAM.gov yielded no alternative vendors. The government estimates significant duplicative costs in establishing another source, and GEA remains the only provider with sufficient technical data package and specialized H-53 capabilities. The efforts will be funded through Research, Development, Test, and Evaluation (RDT&E), Aircraft Procurement Navy (APN), Operations and Maintenance Navy (OMN), and Foreign Military Sales (FMS) appropriations.

4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 3204(a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
In accordance with FAR 6.302-1(a)(2)(ii)(A), the Government has deemed the requirements listed above to be available only through the original source and award to other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition in fulfilling the Navy’s requirements.
GEA is the sole source designer, developer, and manufacturer of the T408 engines. Additionally, GEA has made corporate investments in T408 engine development, and as such, they are the only source with the requisite skilled personnel, knowledge, experience, and data to perform the requirements. Without Government Purpose Rights (GPR) to this data, the Government does not have a sufficient technical data package to compete the efforts described under this CJ&A. In 2006, GEA was established as the CH-53K engine supplier as a result of a competitive source selection conducted by Sikorsky, under the initial CH-53K System Development and Demonstration (SDD) Contract. A sole-source GEA contract was established in 2013 for T408 engines for the CH-53K SDTA aircraft. The Government estimates the duplicative cost to stand up another source for such specialized supplies and services that require unique H-53 capabilities to be , which is based on the development effort awarded to GEA and escalated to current year costs utilizing HIS Aerospace 2024 RDT&E escalation rates. Therefore, awarding to another source other than GEA would result in a substantial duplication of cost that is not expected to be recovered through competition.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Market research was conducted for the proposed effort via a Sources Sought notice posted to the SAM.gov website on 31 July 2024. A response to the Sources Sought notice was received from BHPE LLC, however, the company did not provide the Capabilities Statement required by the notice, which was also requested directly by NAVAIR via email. As a result, there was not enough information to determine if the company was a capable source. No other vendor expressed interest or submitted a Capabilities Statement. An additional Sources Sought was posted to the SAM website 6 March 2025 to reflect an updated PSC. There were no responses received. In accordance with FAR 5.201(b), a Synopsis was posted on SAM.gov dated 22 August 2024; no responses were received. An additional Synopsis was posted to the SAM website 31 March 2025 to reflect an updated PSC; no responses were received. No additional market research was conducted because it is not practicable, for the reasons discussed in Paragraph 5 above, for any company other than GEA to provide the required supplies and services.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies and/or services covered by this CJ&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NAVAIR has no plans at this time to compete future contracts for the types of supplies/services covered by this CJ&A. If another potential source emerges, NAVAIR will assess whether competition for future requirements is feasible. As this is a follow-on for supplies and services previously awarded on a non-competitive basis, in accordance with DFARS PGI 206.304(a) (S-70) (i), the prior CJ&A was provided to the approval authority to review. Approval of this CJ&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a) (S-70) (ii).
