About this file

This is a Notice of Intent to Petition for a Protective Order submitted by Gartner, Inc. to the Mississippi Department of Information Technology Services (ITS) regarding the Mississippi Statewide Data Exchange Project (Project #SB2267). Gartner submitted bid materials in response to ITS's Request for Proposals in November 2025. Following a Public Records Request submitted in July 2026 by Drew Ecker of World Wide Technology requesting copies of all bid responses and evaluation materials for the project, Gartner provided notice of its intent to petition the Chancery Court for a protective order to prevent the disclosure of its submission materials. The petition deadline is August 11, 2026.

Gartner asserts that its submission contains trade secrets and confidential commercial and financial information protected under Mississippi Code Annotated §25-61-9(1)(a) and §75-26-3(d). The confidential information identified includes details related to Gartner's clientele, work approach, staffing, and internal operations. The notice was issued on July 28, 2026, and copies were provided to both ITS and the public records requestor, Drew Ecker, as required by Mississippi law.

Re: Gartner’s Notification of its Intent to Petition for a Protective Order

Dear Ms. White:

Gartner, Inc., by and through undersigned counsel, hereby provides the Mississippi Department of Information Technology Services (“ITS”) with timely notice of Gartner’s intent to petition the Chancery Court for a protective order in connection with materials it submitted in response to ITS’s Request for Proposals for Mississippi’s Statewide Data Exchange Project (the “Project”).

In November 2025, Gartner submitted bid materials in connection with the Project.

Several months later, in July 2026, ITS received a Public Records Request from Drew Ecker who is affiliated with World Wide Technology. Mr. Ecker requested the bid responses that ITS received and considered for the Project.1 After receiving this request, ITS issued a third-party notice to Gartner stating that Gartner’s submissions were responsive. On July 21, 2026, a Gartner representative confirmed receipt of such third-party notice.

Pursuant to ITS’s Public Records Policy, this letter serves as Gartner’s notice to ITS that it intends to petition the Chancery Court for a protective order with respect to its submission materials. A protective order is warranted because Gartner’s submission contains “trade secrets or confidential commercial or financial information” that is protected by Miss. Code Ann. § 25- 61-9(1)(a); Id. § 75-26-3(d) (defining “trade secret”); UnitedHealthcare of Mississippi, Inc. v.

1 In his request, Mr. Ecker stated the following: “I am requesting electronic copies of the awardee(s) bid responses for Mississippi Statewide Data Exchange Project #SB2267 that was due 11/21/2025 and who the awarded contractor was. If there were numerous bidders, I would like to request copies of the finalists for this opportunity. I would also like to request any evaluation or scoring sheets.”

Amerigroup Mississippi, Inc., 389 So. 3d 317, 326–28 (Miss. 2024) (determining how the phrase “confidential commercial or financial information” should be defined). Specifically, Gartner has identified confidential information within the submission materials related to Gartner’s clientele, its approach to work, staffing, and internal operations.

Upon filing its petition, Gartner will ensure that ITS is provided with a copy prior to the applicable deadline, August 11, 2026. Should you have any questions regarding this notice, please do not hesitate to contact me.

Sincerely, Megan Celeste Medlicott Megan Celeste Medlicott cc2: Drew Ecker, foiainformation@wwt.com

2 As required by Miss. Code Ann. §25-61-9(1)(a), Mr. Ecker, the requestor, must also be notified of Gartner’s intent to petition the Chancery Court for a protective order. This letter shall serve as such notice.
