About this file

This justification and approval document describes a sole source contract award for internet and telephone connections to support a senior US government delegation at the 2022 G7 Summit in Germany. The Department of State required over two gigabits per second of bandwidth and 50 telephone lines to be installed at two hotel sites by June 24, 2022 to support the visit. Deutsche Telekom was awarded the sole source contract for $428,996.87 due to its reliable network and ability to meet the large bandwidth needs in the remote location within the required timeframe. The justification cited an unusual and compelling urgency exception under FAR 6.302-2 since security concerns prevented advance notice and limited the availability of alternatives capable of fulfilling the requirements.

JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION, PRICE

JUSTIFICATION (JOFOC)

INSTALLATION OF INTERNET AND TELEPHONE CIRCUITS TO

SUPPORT VIP TRAVEL AT THE G7 SUMMIT GERMANY 2022

1. I recommend that the Department of State use other than full and open competition for the acquisition of internet and telephone circuits for this VIP visit. The total cost is

410,550.00 EUR ($428,996.87).

2. Nature and/or description of the action being approved.

Senior High Level USG Principal traveling with a delegation inclusive of support elements in: Security, Communications, Logistics and Operations.

3. A description of the supplies or services required to meet the agency’s needs.

The requirement is for all telecommunication services for VIP participation in the G7 Leader’s Summit at Schloss Elmau. It shall include installation, maintenance, modifications and support for all internet circuits and telephone lines required to support the communication needs of the delegation. Primary sites for these circuits are the event hotel Schloss Elmau and support hotel Edelweiss Lodge. Bandwidth is expected to exceed two Gigabits per second, and 50+ telephone lines.

4. An identification of the statutory authority permitting other than full and open competition.

[ X ] 41 U.S.C. 253 (c) (2), FAR 6.302-2; Unusual and Compelling Urgency;

(Based on the available time and urgency of the requirement as detailed below)

Security concerns prohibit sufficient advanced notification of VIP travel to allow for sufficient time to conduct full and open competition. The Department of State can only communicate with the staff at Posts abroad when authorization is given due to security concerns. There is an extremely short turnaround time when authorization has been granted for negotiations to commence with local vendors before the actual Senior High Level USG VIP visit occurs. Therefore, competition of these services would not leave enough time for installation of internet and telephone circuits prior to the VIP visit.

A further consideration is the limited availability of telecommunications providers that can provide sufficient bandwidth in the remote location chosen for this event.

This results in an unusual and compelling urgency in accordance with 41 U.S.C.

253 (c) (2), FAR 6.302-2.

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.

Deutsche Telekom is the former state-owned telecommunications provider and widely considered the most reliable and available network in Germany. Also, most other providers ultimately ride on Deutsche Telekom circuits but introduce other gateways, bottlenecks, and limitations. Other providers would struggle to provide the very large bandwidth required to support this visit.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable.

Due to urgency and exception in FAR 25.401(a)(5) this solicitation cannot be posted but the JOFOC will be published in FedBizOpps.

7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

A determination by the Contracting Officer that the anticipated cost of the Government will be fair and reasonable, based on historical prices for similar services.

8. Any other facts supporting the use of other than full and open competition.

Unique requirements for communications support are under severe time limitations and always a determining factor in the selection process as its capacity to be augmented to the unique requirements necessary to support certain Senior High Level USG Principals.

9. A listing of sources, if any, that expressed, in writing, an interest in the acquisition.

No other sources were solicited due to the nature of the procurement.

10. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

Due to the nature of the service, the security considerations involved, the lack of sufficient time for installation, and the remote location, the Department of State cannot remove or overcome barriers to competition in relation to the visits of senior level USG officials.
