SECTION C. PERFORMANCE WORK STATEMENT

C.1. Introduction

The purpose of this contract is to obtain and install fiber patch panels (Light Interface Units – LIU) and fiber infrastructure at the US Geological Survey (USGS) Wetland and Aquatic Research Center (WARC), Gainesville, Florida. Attendance at the site visit (see Section L) is highly recommended.

C.2. Scope

The project consists of installing a new LIU in the server room; running fiber from the server room to the auditorium (located in the same building as the server room) and three outlying buildings where the fiber will be connected to new LIUs at each location. The USGS will provide three wall-mounted racks and one full sized floor-mounted rack to hold the LIUs. All other labor and materials shall be furnished by the vendor.

C.2.1. The vendor shall furnish and install one LIU to house 48 fibers in the server room. These 48 fibers shall be connected to the outlying buildings in accordance with C.2.3.

C.2.1.1. The vendor shall install the LIU in the furnished floor-mounted, full size rack.

C.2.2. The vendor shall furnish materials and labor to install 12 strand, 50 micron fiber from the WARC server room to each of the following locations: South Modular Building Switch Closet, North Modular Building Switch Closet, Travis Smith Annex Switch Closet, and the Auditorium Switch Closet.

C.2.2.1.1. The vendor shall furnish three LIUs to house 12 fibers each in the following locations: South Modular Building Switch Closet, Travis Smith Annex Switch Closet, and the Auditorium Switch Closet, C.2.2.1.1.1. The vendor shall install the LIUs in the furnished wall-mounted racks – one at each location.

C.2.2.1.2. The vendor shall furnish materials and labor to install two fiber adapters into the existing LIU in the North Modular Building Switch Closet.

C.2.3. The vendor shall remove existing fiber connections as they are replaced by the upgraded fiber and equipment.

C.2.4. The vendor shall test and certify all installed/modified connections. The Government will verify contractor’s work is complete, is suitable to the TL/FM, and meets contract requirements before acceptance.

C.3. Technical Requirements

C.3.1. The contractor must hold a current Florida Electrical and Alarm Contractor license and shall obtain all permits required by federal, state and local regulations prior to commencement of work. All permit applications will be provided to the Technical Liaison (TL), as shall all the permits, once received.

C.3.2. Kick-Off Meeting: The contractor shall schedule and conduct a kick-off meeting on-site with the TL to review the requirements and conditions of this contract. The contractor shall have the project manager and all subcontractors (if any) present on site, or available by conference call for the kick-off meeting. The kick-off meeting shall be held prior to the commencement of work.

C.3.3. Time Line: Work may not begin without the approval of a timeline by the TL; timeline shall begin with the Notice to Proceed (NTP) and indicate the number of days to completion. The timeline will be the reference to which the contractor's progress and efforts are compared. Three paper copies or one soft copy shall be submitted to the TL at, or before, the kickoff meeting.

C.3.4. Work Hours, Outages and Interruptions: All work is to be performed between the hours of 8AM and 4:30 PM, Monday through Friday unless previous arrangements have been made with the TL. Inclement weather may force closure of the facility. No work will be performed on federal holidays without exception. The contractor is advised that the facility will continue to perform normal functions during the contract. Work shall be conducted so as to minimize interference with day-to-day operations. Contractor shall notify TL at least 3 days prior to all anticipated outages. Changes to the timeline require coordination with, and approval from, the TL.

C.3.5. Changes/Clarifications: All work must be completed as shown in the contract documents. “No cost” change orders shall be submitted in writing to the TL detailing why the work cannot be completed as shown and suggesting corrective action(s) by the contractor. The TL shall provide written consent to the proposed changes before the contractor may proceed with the changed work. The Contacting Officer’s approval must be received before commencing work which will alter the price, scope or terms of the contract.

C.3.6. Disposal and Transporting of Debris and Material: All materials and construction debris shall be removed from the work area daily and placed in an approved dumpster or removed from the site by the contractor.

C.3.7. Other Considerations: All material and equipment are to be provided by the contractor except where previously noted. No tools, equipment or manpower will be provided by the facility. Equipment may be stored in designated areas during the period of performance but the facility assumes no liability against loss or theft.

C.3.8. Materials and Tools: The TL shall designate areas where the contractor can store or place materials and equipment for short-term storage in preparation for installation. There is limited space on site for the storage of contractor equipment. Storage and security of materials and equipment as required for the performance of the contract requirements are the responsibility of the contractor. The contractor shall be responsible for making all arrangements for the receipt of materials and supplies at the job site. Government personnel are not permitted to receive or sign for items delivered to the site. Upon completion of the contract, the contractor shall remove all equipment and excess materials, and shall restore the site to its original condition, as approved by the TL, at no additional cost to the Government.

C.3.9. Contractor Parking, Security, and Smoking Regulations: The contractor shall maintain a daily log of all contractor and subcontractor employees (date, name, arrival time, departure time) and provide a copy of the log to the TL upon request. The TL will designate a parking area (or areas) for the contractor to park vehicles. There shall be no smoking in any buildings at any time; smoking is permitted in designated smoking areas only.

IMPORTANT: Contractors will be required to report to the front desk daily for entrance into the building and must wear visitor identification tags issued by the front desk at all times while on site.

C.4. GS0340 Environmentally Preferable Building Products and Materials March 2008

(a) The contractor shall use environmentally preferable products and materials where economically feasible.

Environmentally preferable products have a lesser or reduced effect on human health and the environment when compared to other products and services that serve the same purpose.

(b) Refer to EPA's environmentally preferable products web site, www.epa.gov/opptintr/epp. In general, environmentally preferable products and materials do one or more of the following –

(1) Contain recycled material, are biobased, or have other positive environmental attributes;

(2) Minimize the consumption of resources, energy, or water;

(3) Prevent the creation of solid waste, air pollution, or water pollution;

(4) Promote the use of non-toxic substances and avoid toxic materials or processes.

(c) See FAR 52.223-2 Affirmative Procurement of Biobased Products Under Service and Construction Contracts, for related bio-based product requirements.

(d) If this contract includes janitorial services, the contractor specifically must -

(1) use the following recycled content products - towels, tissue products, and plastic trash can liners, and

(2) use biobased and/or environmentally preferable cleaning products.

C.5. GS0342 Hazardous Material Identification March 2008

(a) In accordance with clause FAR 52.223-3, Hazardous Material Identification and Material Safety Data, Alternate I, the contractor shall provide Materials Safety Data Sheets (MSDS) for the following products prior to their use under this contract: adhesives, caulking, sealants, insulating materials, fireproofing or firestopping materials, paints, carpets, floor and wall patching or leveling materials, lubricants, clear finish for wood surfaces, janitorial cleaning products, pesticides, rodenticides, and herbicides.

(b) The Government reserves the right to review such products at any time. The Contracting Officer may eliminate from permitted use under this contract products with significant quantities of toxic, flammable, corrosive or Carcinogenic material and products with potential for harmful chemical emissions.

C.6. GS0343 Energy Efficient Products March 2008

(a) The clause FAR 52.223-15, Energy Efficiency in Energy-Consuming Products, applies to any power-consuming equipment to be installed or used in USGS facilities, whether title to the equipment will pass to the Government or be retained by the Contractor.

(b) For products that consume power in a standby mode (as listed on FEMP’s Standby Power Devices product listing), the contractor shall –

(1) Purchase items which meet FEMP’s standby power wattage recommendation or document the reason for not purchasing such items; or

(2) If FEMP has listed a product without a corresponding wattage recommendation, purchase items which use no more than one watt in their standby power consuming mode. When it is impracticable to meet the one watt requirement, purchase items with the lowest standby wattage practicable.

(c) The requirements of this clause do not apply if (1) no compliant product’s utility and performance can meet the contractor’s need or contract specifications, (2) compliance would not be life-cycle costeffective or (3) compliant solutions are otherwise not available.

C.7. GS0346 Construction Waste Management March 2008

(a) Items and material existing in the space or to be removed from the space during the demolition phase are eligible for reuse in the construction phase of the project. The reuse of items and materials is preferable to recycling them;

however, items considered for reuse must be in refurbishable condition, and must meet the quality standards set forth by the Government in this solicitation/contract. In the absence of definitive quality standards, the contractor is to ensure that the quality of the item(s) in question will meet or exceed accepted industry or trade standards for first quality commercial grade applications. Before use, the contractor shall submit a reuse plan to the Contracting Officer. The Government will not pay for existing fixtures and other existing improvements accepted in place.

(b) Recycling construction waste means providing all services necessary to furnish construction materials or wastes to organizations which will employ these materials or wastes in the production of new materials. Recycling includes required labor and equipment necessary to separate individual materials from the assemblies of which they form a part.

(c) The Offeror shall maintain a recycling program to dispose of or recycle construction waste in compliance with this clause. The program must cover the following requirements.

(1) The contractor will provide continuous facilities for the recycling of incidental construction waste during initial construction.

(2) Products may be excluded from the recycling program when the small quantity of material involved, the extraordinarily complex nature of the waste disposal method, or prohibitive expense for recycling would represent a genuine hardship.

(3) Records of construction materials recycled shall be maintained and accessible to the Contracting Officer.

Records shall include materials recycled or landfilled, quantity, date, and identification of hazardous wastes.

(d) As a minimum, the contractor will recycle lighting and associated support system, carpet and carpet pad, hardware, drywall, and electrical components during both the demolition and construction phases of the project, subject to economic evaluation and feasibility.

(e) If any waste materials encountered during the demolition or construction phase are found to contain lead, asbestos, PCBs (such as fluorescent lamp ballasts), or other harmful substances, they are to be handled and removed in accordance with State and Federal laws and requirements concerning hazardous waste.

(f) The requirements of paragraphs (b) through (d) of this clause do not apply when no construction recycling and salvage operation is reasonably available in the locality where work is to be performed.

C.8. GS0347 Indoor Air Quality During Construction March 2008

C.9. GS0348 Environmental Requirements - Selected Construction Materials March 2008

(a) Asbestos

No asbestos-containing fireproofing or insulation on building structures, acoustical treatment, molded or wet-applied ceiling or wall finishes/decorations, or pipe and boiler insulation (including duct, tank, etc.) will be permitted in new materials provided by the contractor under this contract.

(b) Lighting: Interior and Parking

(1) Modern diffused, fluorescent fixtures using solid state octron ballasts with energy efficient lamps (T-8 or better) and electronic ballasts shall be provided if new fixtures are to be used. Fixtures shall be capable of producing and maintaining a uniform lighting level of 50-foot candles at working surface height throughout the space. In addition, restroom lighting shall be 30 foot candles measured at counter height and 20 foot-candles measured at the floor in enclosed corridors.

(2) Exterior parking areas, vehicle driveways, pedestrian walkways and building perimeter shall have a minimum of 1 foot-candle measured at the ground of illumination and be designed based on Illumination Engineering Society standards. Exterior lighting and indoor parking shall be sufficient to accommodate security monitoring (i.e., closed circuit television camera). Indoors parking shall have a minimum of 10 foot-candles measured at the floor and be designed based on Illumination Engineering Society standards.

(3) The contractor shall provide occupancy sensors and/or scheduling controls through building automation system to reduce the hours the lights are on when the space is unoccupied. Daylight dimming controls shall be used in atriums or other space where daylight can contribute to energy savings.

(4) Lighting shall be controlled by occupancy sensors arranged to control open areas, individual offices, conference rooms, toilet rooms, and all other programmed spaces or rooms within the facility to be constructed, remodeled, or maintained hereunder. The control system shall provide an optimal mix of infrared and ultrasonic sensors suitable for the configuration and type of space. Occupancy sensors shall be located so that they have a clear view of the room or area they are monitoring. No more than 1,000 BOMA Usable Square Feet of open space shall be controlled by one occupancy sensor. All occupancy sensors shall have manual switches to override the light control with an adjustable timer to control the amount of time the lighting is manually activated. Such switches shall be located by door openings in accordance with the Americans With Disabilities Act Accessibility Guidelines and the Uniform Federal Accessibility Standards.

(c) Potable Water Supply

Solder and flux in joining potable water supply piping shall not contain more than 0.2 percent lead and domestic water pipes or pipefittings shall not contain more than 8 percent lead. In addition, the contractor is to meet standards set forth in EPA's in "Drinking Water Standards for Schools, and Non-Residential Buildings", A Publication 812-B- 94-002, April 1994.

(d) Wood Products

(1) For all new installations of wood products, the contractor is encouraged to use independently certified forest products. For information on certification and certified wood products, see web sites for the Forest Stewardship Council or the Certified Forest Products Council at www.fscus.org/ and www.certifiedwood.org/.

(2) New installations of wood products used under this contract must not contain wood from endangered wood

G17PS00735 Page 11 of 34 species, as listed by the Convention on International Trade and Endangered Species (CITES). The list of species can be found at www.certifiedwood.org/Resources/CITES/ CITESContent.html.

(3) Particle board, strawboard and plywood materials shall comply with HUD Standards for VOC emissions (particleboard: 0.2 ppm of formaldehyde, plywood: 0.3 ppm of formaldehyde).

(e) Adhesives and Sealants

All adhesives employed on this project (including, but not limited to, adhesives for carpet, carpet tile, plastic laminate, wallcoverings, wood adhesive, or sealants) shall be those with the lowest possible Volatile Organic Compound (VOC) content below 20 g/L. and which meet the requirements of the manufacturer of the products adhered or involved. The contractor shall use adhesives and sealants with no formaldehyde or heavy metals.

(f) Insulation - Thermal, Acoustic, and HVAC

(1) All insulation products shall contain recovered materials as required by EPA's Comprehensive Procurement Guideline and related recycled content recommendations.

(2) No insulation installed with this project shall be material manufactured using chlorofluorocarbons (CFCs), nor shall CFCs be used in the installation of the product.

(3) All insulation containing fibrous materials exposed to air flow must be rated for that exposure or encapsulated.

(4) Insulating properties for all materials must meet or exceed applicable industry standards. Polystyrene products shall meet ASTM C578-91.

(g) Floor Covering

All Floor covering must meet EPA and OSHA environmental health and safety requirements. In addition, the indoor air standard for 4-phenylcyclohexene (4-PC) appears as follows: to protect against induction of multiple chemical sensitivity - .005PPB; to protect against acute irritant effects - 01.7 PPB. Testing will be required on the finished flooring to establish a product content standard for 4-PC that will assure compliance with the indoor air standard.

SECTION E. INSPECTION AND ACCEPTANCE

E.1. 52.246-12 Inspection of Construction (AUG 1996)

(a) Definition. “Work” includes, but is not limited to, materials, workmanship, and manufacture and fabrication of components.

(b) The Contractor shall maintain an adequate inspection system and perform such inspections as will ensure that the work performed under the contract conforms to contract requirements. The Contractor shall maintain complete inspection records and make them available to the Government. All work shall be conducted under the general direction of the Contracting Officer and is subject to Government inspection and test at all places and at all reasonable times before acceptance to ensure strict compliance with the terms of the contract.

(c) Government inspections and tests are for the sole benefit of the Government and do not-

(1) Relieve the Contractor of responsibility for providing adequate quality control measures;

(2) Relieve the Contractor of responsibility for damage to or loss of the material before acceptance;

(3) Constitute or imply acceptance; or

(4) Affect the continuing rights of the Government after acceptance of the completed work under paragraph (i) of

(d) The presence or absence of a Government inspector does not relieve the Contractor from any contract requirement, nor is the inspector authorized to change any term or condition of the specification without the Contracting Officer’s written authorization.

(e) The Contractor shall promptly furnish, at no increase in contract price, all facilities, labor, and material reasonably needed for performing such safe and convenient inspections and tests as may be required by the Contracting Officer. The Government may charge to the Contractor any additional cost of inspection or test when work is not ready at the time specified by the Contractor for inspection or test, or when prior rejection makes reinspection or retest necessary. The Government shall perform all inspections and tests in a manner that will not unnecessarily delay the work. Special, full size, and performance tests shall be performed as described in the contract.

(f) The Contractor shall, without charge, replace or correct work found by the Government not to conform to contract requirements, unless in the public interest the Government consents to accept the work with an appropriate adjustment in contract price. The Contractor shall promptly segregate and remove rejected material from the premises.

(g) If the Contractor does not promptly replace or correct rejected work, the Government may-

(1) By contract or otherwise, replace or correct the work and charge the cost to the Contractor; or

(2) Terminate for default the Contractor’s right to proceed.

(h) If, before acceptance of the entire work, the Government decides to examine already completed work by removing it or tearing it out, the Contractor, on request, shall promptly furnish all necessary facilities, labor, and material. If the work is found to be defective or nonconforming in any material respect due to the fault of the Contractor or its subcontractors, the Contractor shall defray the expenses of the examination and of satisfactory reconstruction. However, if the work is found to meet contract requirements, the Contracting Officer shall make an equitable adjustment for the additional services involved in the examination and reconstruction, including, if completion of the work was thereby delayed, an extension of time.

(i) Unless otherwise specified in the contract, the Government shall accept, as promptly as practicable after completion and inspection, all work required by the contract or that portion of the work the Contracting Officer determines can be accepted separately. Acceptance shall be final and conclusive except for latent defects, fraud, gross mistakes amounting to fraud, or the Government’s rights under any warranty or guarantee.

E.2. 52.246-13 Inspection - Dismantling, Demolition, or Removal of Improvements (AUG 1996)

(a) Unless otherwise designated by the specifications, all workmanship performed under the contract is subject to Government inspection at all times and places where dismantling or demolition work is being performed. The Contractor shall furnish promptly, and at no increase in contract price, all reasonable facilities, labor, and materials necessary for safe and convenient inspection by the Government. The Government shall perform inspections in a manner that will not unduly delay the work.

(b) The Contractor is responsible for damage to property caused by defective workmanship. The Contractor shall promptly segregate and remove from the premises any unsatisfactory facilities, materials, and equipment used in contract performance, and promptly replace them with satisfactory items. If the Contractor fails to proceed at once in a workmanlike manner with performance of the work or with the correction of defective workmanship, the Government may -

(1) By contract or otherwise, replace the facilities, materials, and equipment or correct the workmanship and charge the cost to the Contractor; and

(2) Terminate for default the Contractor's right to proceed. The Contractor and any surety shall be liable, to the extent specified in the contract for any damage or cost of repair or replacement.

This schedule shall consist of a detailed breakdown of the contract price, segregated under each of the significant construction categories. It shall state the quantities for each of the various types of work, the unit prices, and extended totals. Subcontractors who may be involved in more than one category of work must provide the same breakout data for each category. The submission of the required data shall not otherwise affect the contract terms.

F.8. GS1354 List of Subcontractors (Construction) (JUL 2001)

For purposes of monitoring compliance with the insurance and payroll reporting requirements of this contract, the

SECTION G. CONTRACT ADMINISTRATION DATA

G.1. Contract Administration Requirements

G.1.1. The following items must be submitted to the Contracting Officer 10 days after contract award:

G.1.1.1. Payment protection - Standard Form 25a payment bond preferred (see clause 52.228-13, payment bond only

– no performance bond needed at this dollar amount), G.1.1.2. Insurance certificate (see clause 1452.228-70)

Upon receipt and approval of these documents, a NTP will be issued.

G.1.2. In accordance with clause 52.211-10, the contractor must commence work under this contract within 10 calendar days after NTP, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 30 days after NTP

G.1.3. Coordinate the scheduling of all work to be performed and technical questions regarding the project with TL. The TL will be named at the time of award.

G.1.4. The contractor is required to submit copies of all payrolls to the Contracting Officer at lanejones@usgs.gov The prime contractor is responsible for the submission of copies of payrolls by all subcontractors. This information may be submitted in any form. The optional form WH-347 from the Department of Labor may be used and is attached.

G.2. DOI ELECTRONIC INVOICING Electronic Invoicing and Payment Requirements - Internet Payment Platform (IPP) (SEP 2011)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Internet Payment Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. The Contractor must use the IPP website to register, access and use IPP for submitting requests for payment. If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the

G.3. Unilateral De-obligation of Unexpended Funds (MAY 2013)

The contractor shall submit all invoices under the award no later than 90 calendar days after the period of performance has expired, unless a request for extension has been submitted to the Contracting Officer. After 120 days has passed since the expiration of the performance period, the government reserves the right to issue a unilateral modification de-obligating any unexpended funds, and to initiate closeout procedures.

G.4. 52.000S-5079 Technical Liaison - Technical Direction (OCT 1997)

(a) The performance required herein shall be subject to the technical direction of the Technical Liaison (TL) as identified below. As used herein, "technical direction" is defined as direction to the contractor that fills in details, suggests possible lines of approach, or otherwise supplements the scope of the work set forth herein and shall not constitute a new assignment, and does not supersede or modify any article or clause of this contract.

(b) The Technical Liaison is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government. Only a warranted Contracting Officer is authorized to obligate funds on this or any other contract action.
