Director/CEO Letter No. 17 24 April 2017

SUBJECT: Asbestos and Lead Based Paint (LBP) Abatement

All Exchange Associates

1. Asbestos is a hazardous air pollutant and a hazardous substance. Improper handling and disposal of asbestos exposes the Exchange to fines, penalties and the indefinite liability for future cleanup at any site where asbestos is disposed. Additionally, asbestos is regulated by the Occupational Safety and Health Act (OSHA) to protect workers. The following policy is intended to ensure proper minimization of the risks associated with asbestos, as well as protection of all concerned.

2. Asbestos was used extensively in military buildings and in equipment as fireproofing and fire retardant material through at least the 1970s. Military construction from World War II onward used asbestos extensively for its fire protection qualities. Exchange buildings from that period constructed to military standards also included extensive asbestos material. Even today, small amounts of asbestos are often found in roofing materials, floor tile and glue or mastic for floor coverings. Since asbestos remains legal for many uses today, no building, regardless of age, is certain to be free of asbestos.

3. The Exchange must include the cost of asbestos removal in renovation projects where asbestos is disturbed but could have otherwise be left in place. With this in mind, asbestos-related work by the Exchange must be done with great care.

4. The Exchange is also responsible for LBP encountered in renovation projects. All such work must use care for protection of human health and the environment, as outlined in the procedures attached.

5. It is the policy of the Exchange that if asbestos or LBP is suspected, a preconstruction survey by qualified experts will be accomplished and documented. All reasonable efforts will be made to avoid disturbing asbestos and LBP and minimize what must be disturbed. The Exchange will ensure that all applicable laws and regulations are carefully followed when dealing with asbestos or LBP.

6. All projects will follow rules, regulations and best management practices concerning protection of the health of project workers, Exchange patrons and associates, and others that may be involved in the abatement process. The specific guidance in the attached will be followed for all renovation projects.

This rescinds Director/CEO Letter 16-17 dated 14 March 2016.

SPECIFIC GUIDANCE TO BE FOLLOWED FOR ALL EXCHANGE RENOVATION

PROJECTS

All work will be in accordance with applicable federal, state and local laws and regulations. All work will be consistent with applicable requirements of the base/post asbestos management plan, giving due deference to the base or post as owner of the building and of the asbestos or lead based paint being abated.

A. ASBESTOS

Definition: “qualified expert” or “qualified personnel” shall mean a person who has the requisite training and accreditation as an inspector, project designer, supervisor or worker (as applicable in context) as set out in the US Environmental Protection Agency (EPA) Model Accreditation program, including the equivalent training and certification required by state programs for the site of the work.

1. All projects involving renovation when asbestos is suspected must have a survey of the work area by a qualified expert and meet all applicable environmental and safety requirements. Samples will be taken as necessary, including chain of custody documentation, and will be analyzed in accredited laboratories using required and appropriate test methods. If a pre-existing survey by base, post or the Exchange is used to meet this requirement, then it must be approved as currently adequate by a qualified expert.

2. All contract specifications for asbestos surveys and for abatement must be drafted or approved by qualified experts.

Specifications will comply with all applicable environmental laws and regulations as well as all applicable health and safety regulations. These include, but are not limited to, the Clean Air Act; Toxic

Substances Control Act; CERCLA; and the OSHA.

3. Abatement projects will follow all normal project requirements, such as post or base environmental approvals.

4. All work must be done by experienced, qualified contractor personnel with qualified supervisory personnel.

a. Contractor must demonstrate at least five years’ experience in asbestos abatement work for renovations or demolitions in projects of similar scope to the subject of the contract.

b. Contractor must demonstrate a clean record of no violations of state or federal environmental, health or safety violations in the last five years.

c. Contactor must provide adequate insurance coverage for claims that may occur before the expiration of any applicable statute of limitations. The Exchange Finance and Accounting Directorate will approve the insurance coverage as to policy and amount, considering all relevant factors and in consultation with Exchange General Counsel and Exchange Real Estate (RE) Environmental or other expert consultants, if needed.

d. Contractor must submit a final report to the Exchange on abatement work done, including required certifications, protective measures used, monitoring results, work logs, worker health and training records, summaries of any problems encountered during the job that might raise safety or health concerns, any disposal of materials containing asbestos and any other deliverables under the contract.

5. All appropriate work site measures must be taken to ensure the health and safety of abatement workers, Exchange customers, Exchange associates and the general public.

6. All work must be documented with appropriate records including daily logs, sample and monitoring results, and photographs of protective measures and work underway.

7. Disposal of asbestos waste from abatement projects will be done by the base or post.

Reimbursement of disposal costs will be included in project costs if base or post funds are certified not sufficient or not available. At a minimum the base or post must always designate the disposal site and sign the disposal manifest as owner, with documentation of the disposal site designation and manifest kept in the Exchange Asbestos Abatement file on the project as set out in paragraph 9 below on retention of records.

8. Asbestos abatement for renovations at Exchange facilities not on an installation controlled by the Army, Air Force or Navy, such as Exchange Headquarters or a distribution facility, will follow the same procedures as on bases and posts. Since disposal of asbestos must be done by the Exchange, the following will apply:

a. If disposal can be done economically through the worldwide Memorandum of Agreement between the Exchange and the Defense Logistics Agency-Disposition Services (DLA-DS), then use DLA-DS to dispose of asbestos debris.

b. If disposal is by the Exchange, then the disposal site will be selected by the Exchange after a due diligence investigation of the disposal site is conducted by the Exchange contracting officer. This investigation will include financial and operational responsibility of the site operator, disclosure by the contractor of all environmental, safety issues within the last five years, such as citations, notices of violation or other enforcement actions by the United States, EPA or OSHA, or state or local equivalent regulatory authorities. Contractor must also disclose all pending legal proceedings related to asbestos abatement or disposal, against the contractor or contractor’s employees. The same responsibility determination will apply to transporters of asbestos if contracted directly by the Exchange.

9. All abatement projects will have a qualified supervisory expert who is independent of the abatement contractor and under direct contract with the Exchange or a fully qualified Exchange associate who must:

a. Review and approve surveys and specifications prior to contract solicitation.

b. Review abatement contractor work plans (including monitoring plans), site protective measures, worker training records, worker personal protective equipment and monitoring equipment prior to start of abatement work.

c. Adequately oversee all stages of work, including independent air monitoring, where appropriate, and having authority to recommend or require immediate work stoppage and suggest corrective action.

d. Reviews and recommend whether contractor records and submittals should be approved by the Exchange contracting officer or if additional documentation is required.

e. Submit a review of abatement contractor’s final report for the Exchange on abatement work done, concurring with report, or noting any errors and recommending any appropriate corrective action to cure the report errors.

f. Have certification as an asbestos supervisor and designer.

10. The Exchange will retain all essential asbestos records for at least 30 years, including surveys, laboratory reports, contractor close-out reports, copies of insurance policies and disposal records.

These surveys will be submitted by contractors in electronic format and will be retained by the Exchange RE Directorate in electronic format. All recordkeeping requirements of the applicable federal, state and local regulators, if different, will also be followed by contractors and by Exchange associates involved in surveys or abatement. The Exchange will coordinate all records with the building owner.

B. LEAD BASED PAINT

1. LBP can be a health hazard to workers and others who may come in contact with it, and to the environment at disposal sites. It is federally regulated under the Resource Conservation and Recovery Act (RCRA), CERCLA or the Superfund and OSHA, as well as many applicable state programs on hazardous and solid waste.

2. For each renovation project a qualified person shall review the facility and its history of construction and renovation if LBP is suspected.

a. For projects in which there is an A-E of record, if lead paint is not suspected, the A-E shall state so in writing for the project file and the project can precede with a note to the renovation contractor the LBP is not expected to be present. However, stop work and notify the contracting office of the need to take appropriate action if it is discovered or suspected on the work site.

b. If the A-E believes there is a reasonable possibility that LBP is present in the intended work area, the A-E will provide specifications and statement of work or work plan to remove or abate such lead paint as necessary for the renovation project. These work plans will fully comply with OSHA, particularly 29 CFR 1926.62, RCRA, other applicable state and federal regulations, and follow industry best practices.
