About this file
This is an Invitation for Bid (IFB) issued by the State of Colorado Department of Human Services, Southern District Procurement, for the supply of stoker bituminous coal. The solicitation seeks bids for free-burning bituminous coal to supply the Colorado Mental Health Institute at Pueblo and other human services facilities. The estimated annual requirement is approximately 20,000 tons (more or less), with daily consumption varying from 0 to 20 tons during summer months to 0 to 60 tons during winter months, depending on the availability and cost of alternate fuel sources such as natural gas. Bids were due on May 16, 2016, at 10:30 a.m. Mountain Time. The contract period is 12 months beginning July 1, 2016, through June 30, 2017, with four one-year renewal options at the State's sole discretion. All deliveries must be weighed on a 50-ton truck scale at the Colorado Mental Health Institute at Pueblo, with payment made according to delivered net weight. The State intends to award the contract to a single vendor based on the best overall economic value, considering price, administrative costs, payment terms, delivery conditions, and proximity to user sites.
All pricing must be quoted on an F.O.B. Destination and Installation basis, with prices remaining firm for the initial fiscal year. All bids must include a complete proximate coal analysis from a representative recent sample, including ash fusion temperature data, and identify the mine location and source. The coal specifications require a maximum of 12% ash, 0.74% sulfur, 14% moisture, with a minimum of 11,300 BTU/pound as received and an ash fusion temperature of at least 2,500 degrees Fahrenheit. Vendors must provide quantity discount structures for daily bulk deliveries ranging from 250 to 20,000 tons and must be registered on Colorado VSS at the time of bid opening. Price increases for renewal years are limited to the lesser of the consumer price index for the previous 12 months or 5 percent, unless the vendor provides specific cost documentation supporting higher increases. The successful vendor must comply with Colorado insurance requirements, including workers' compensation, general liability with minimum combined single limits of $1,000,000, maintain the coal quality throughout contract performance, apply water-soluble chemical treatment to control fugitive particulate dust, and submit monthly proximate analysis reports to the Division of Facilities Management within two weeks of the sample date.

Bids will be evaluated primarily on the best price for overall economic value of coal, which includes recognizing costs associated with damage and repairs to Physical Plant equipment through mining, shipping, receiving, handling, burning, and disposal. Evaluation of Bids may also take into account administrative costs, payment terms, delivery conditions (any restrictions, minimum order quantity or dollar amount), and any exceptions taken to any requirement of the Bid, volumes at individual user sites, and proximity of user sites. Administrative costs include, but are not limited to, time and costs associated with ordering, receiving, stocking and paying invoices.

All prices quoted are to be per ton of two thousand (2,000) pounds net weight. Each load, delivered by end dump truck/trailer, will be weighed over a 50-ton truck scale located on the Colorado Mental Health Institute at Pueblo grounds near the Central Plant, Building 35. Payment will be made in accordance with delivered weight as shown on the scale ticket. A scale ticket will be issued in duplicate for each load of coal delivered. Each scale ticket will show the name of the company delivering coal; gross, tare, and net weights; as well as the name of the person weighing the load, who will be an employee of the Colorado Department of Human Services. One copy of the scale ticket will be issued to the truck driver. An itemized invoice in duplicate is to be rendered for each month’s deliveries.

Deliveries will be scheduled by Southern District Division of Facilities Management (DFM) personnel to maintain adequate inventory on hand. Trucks will be dumped into the coal hopper or storage bunker as directed by DFM personnel, with not less than one hour between successive loads.
Each bid shall be accompanied by a complete analysis of the coal you intend to supply. This analysis shall be a representative sample of recent date, and will be used in evaluating the bids. Each bid shall also be accompanied by the name and location of the mine from which the coal is to be mined, and any substitution is subject to prior approval by Department of Human Services, Southern District Division of Facilities Management.
Successful vendor must adhere to DFM Security Instructions for Contractors, State of Colorado Insurance Guidelines and Submission to Background Investigation.

Note: If legislative or regulatory action causes a change in emission permit requirements, then the coal quality is subject to be adjusted accordingly. Individual loads that exceed the reject limits or are contaminated with foreign material, may be rejected or reloaded and weighed for credit at the quoted price. Determination that the coal fails to meet the analysis submitted with the bid is reserved to DFM Personnel, but it will be the responsibility of the coal supplier to maintain quality control. The Coal fugitive particulate dust must, upon delivery to Central Plant, be controlled via water-soluble chemical treatment to mitigate coal dust reaching the atmosphere.
The supplier shall provide mine run proximate analysis to DFM monthly, within two weeks of the sample date.
DFM Personnel shall be furnished a local contact in the event coal deliveries are not arriving, or the need to adjust delivery schedule should arise.

Invitation for Bid Number This solicitation is for a one year period beginning July 1, 2016 through June 30, 2017 with four (4) one year options to renew. Renewals on option years will be at the sole discretion of the State of Colorado. Vendor MUST provide documentation supporting availability of coal. Vendor MAY provide documentation supporting availability of coal for entire five-year bid period. All bid prices will remain firm for the first fiscal year of the award. Price increases will be accepted a minimum of sixty (60) days prior to the award anniversary date. It is understood the pricing of this commodity can be erratic. In the event a five percent increase is unreasonable and would threaten the survival of the vendor’s business for a future period, it is the vendor’s responsibility to provide specific documentation to support increases in excess of the five percent allowable. An example would be initial cost-plus documentation from mine source or supplier at inception of agreement, when increases would be in excess of that allowable, new cost-plus documentation would be provided with request for increase.
As the deliverable is required to maintain the safety and health of clients entrusting their welfare to the State of Colorado, failure to meet deliverable requirements, for cause, other than acts of God, will constitute breach of agreement. Vendor will be responsible for obtaining alternate supply and costs associated in excess of agreement. In the event awarded vendor is unable to supply coal and DFM must use an alternate vendor, awarded vendor may be responsible for any difference in costs.
