About this file
This addendum to the Florida Fish and Wildlife Conservation Commission (FWC) solicitation FWC 25/26-25 provides clarifications and answers to bidder questions regarding the Electronic Measuring Systems for Statewide At-Sea Observer Program. The document clarifies that the electronic measuring system must have a battery capacity sufficient to support up to 20 hours of total use per trip—not necessarily continuous operation—to accommodate fishing time within 44-hour field days that include transit periods. The sealed proposal deadline remains 3:30 PM Eastern Time on Monday, January 26, 2026, with responses received after this exact time deemed non-responsive. The contract term is three years from purchase order issuance, with options for yearly renewal for up to five additional years at the Commission's discretion.
The addendum addresses three substantive questions: First, it clarifies battery operation requirements as 20 hours of cumulative use within a single trip rather than continuous operation, with capacity achievable through either a single charge or multiple included batteries. Second, regarding software security requirements in Section 6.1.10, the FWC mandates that any cloud-based SaaS or software with data-sharing functionality must include SOC-2 Type II certification or equivalent documentation and an Information Security Policy; however, software operating exclusively locally on devices without external data sharing or cloud storage may satisfy requirements through core functionality review, vulnerability assessment, and privacy policy documentation. Third, the FWC declined to incorporate extended warranty options beyond the standard one-year coverage for board electronics, sensors, and batteries into vendor responses. Bidders must submit responses in accordance with Florida Administrative Code Chapter 28-110 and may file protests with the FWC Purchasing Office at 1875 Orange Avenue East, Tallahassee, Florida 32311-6160.

OBSERVER PROGRAM
UPDATE: QUESTIONS AND ANSWERS
The enclosed addendum has been issued for consideration in the preparation of your response to the Florida Fish and Wildlife Conservation Commission’s (FWC) Solicitation No. FWC 25/26-25, “Electric Measuring Systems for Statewide At-Sea Observer Program”.
All responses to the subject solicitation must be received no later than 3:30 PM (ET) on Monday, January 26, 2026.
A response received after the exact time specified will not be considered.
Failure to file a protest within the time prescribed in Section 120.57(3), Florida Statutes (F.S.), or failure to post the bond or other security required by law within the time allowed for filing a bond shall constitute a waiver of proceedings under Chapter 120, Florida Statutes. Written notices, formal requests and proceedings must conform with the requirements set forth in Chapter 28-110, Florida Administrative Code (F.A.C.). Protests must be filed with the Purchasing Office, Fish and Wildlife Conservation Commission, 1875 Orange Avenue East, Tallahassee, Florida 32311-6160 within the time prescribed in Section 120.57(3), F.S. and Chapter 28-110, F.A.C.

FWC SOLICITATION ADDENDUM 2
BEGIN ADDENDUM
QUESTION #1
For section 4.1.8, does the requirement specify 20 hours of continuous battery operation, or sufficient capacity to support a 20-hour field day with intermittent power usage?
ANSWER #1
The requirement is up to 20 hours of total use for a given trip. Up to 44-hour continuous field days are observed by this project. It’s estimated that approximately 20 hours of fishing time is recorded on a 44 hour trip (with 24 hours of non-continuous expected transit time that the system would not be in use). The electronic measuring system must have capacity for 20 hours of use, not necessarily continuous but within the same trip, either on a single charge, or through multiple included batteries.
QUESTION #2
For section 6.1.10, if the software lacks cloud-based connectivity or data-sharing features, do these requirements still apply? Alternatively, if such features exist but are disabled by default and require user activation, are the requirements applicable in that case?
ANSWER #2
Yes, to remain in compliance with regulatory and internal agency policy any cloud-based SaaS or software with data-sharing functionality must include at least a SOC-2 Type II report (or equivalent) and Information Security Policy in order to conduct a comprehensive security review of any vendor that we are looking to integrate with.
Ideally the more tangible documentation on any third-party vendor that we’re looking to integrate with would be best as we would be able to effectively assess any supply-chain related risks that we may be taking on by incorporating with that vendor.
However, if a software is found to operate completely locally to the device in which it is installed, meaning no external data sharing and no external cloud/server storage. A review of the software’s core functions, vulnerability reputation, concurrent security updates/patches, privacy policy etc. might suffice depending on the nature of the software and the justification. This would be a plus, although we would still need the requested security documentation listed for auditing purposes.
QUESTION #3
Our standard warranty covers the board electronics, sensor, and batteries for one year.
Would the Commission be interested in extending this warranty to five years for an

additional cost? If so, where should this cost be reflected in the itemized cost sheet (e.g., included in the per-unit price of the complete hardware kit)?
ANSWER #3
No please do not include an extended warranty in the response.
