About this file
This file is an email chain involving Sarasota County Public Utilities, Sarasota County Planning and Development Services, and the Florida Fish and Wildlife Conservation Commission (FWC) regarding a utility easement brush clearing project with potential gopher tortoise habitat concerns. The project involves clearing brush along a utility right-of-way to access and maintain air release valves (ARVs) and valves on two force mains. Multiple county staff, including Kyle Proctor (Wastewater ARV & Valve Supervisor) and Allison Moran (Wildlife Specialist), are coordinating to address the presence of numerous active gopher tortoise burrows within the proposed work area.
A related state and local contract opportunity has been issued by Sarasota County seeking quotes from Authorized Gopher Tortoise Agents to perform relocation work. The contractor will need to apply for and obtain the appropriate FWC permit, capture tortoises, and temporarily exclude them from the utility construction site in compliance with FWC permitting guidelines. The project site is located on Longwood Dr. Blvd. near Parcel ID 001630001, and requires careful environmental management to protect the protected gopher tortoise population while allowing necessary utility maintenance access.

Good afternoon Kyle, @Allison Moran is correct. A temporary Exclusion Permit could potentially be used for this scenario. On page 43 of the Gopher Tortoise permitting guidelines, “This permit applies to situations that require the temporary exclusion of tortoises from the utility construction corridor for up to 6 months, and where habitats within the corridor will be restored to provide suitable habitat for tortoises following completion of the utility installation. These permits require the temporary installation of filter fabric (silt fencing) or other comparable fencing (buried at least eight inches into the ground) along the outer edge of the construction right-of-way to block tortoise re-entry into the corridor during construction activities. Such fencing is only required along those portions of the construction corridor where tortoises are documented and are to be relocated from the construction area.”
If this project would have to exclude tortoises for longer than 6 months or if the habitat within the corridor will not be restored to provide suitable habitat for tortoises following completion of the utility installation than another permit would need to be applied for.
You will need to hire an authorized gopher tortoise agent for this permit type.
To find an Authorized Agent in your area, please visit https://app.myfwc.com/maps/gtmapping/gtpermitmap.html . Under the Additional Permits section, please select the check box next to “Authorized Gopher Tortoise Agent”. Then, please select the “By County” tab that is located above the Florida map. A list should be shown that depicts each county in Florida. Select the checkbox next to the appropriate County. After clicking the “Search” button, a map should be shown across your screen. This map will contain blue pin icons. Each icon is an individual Authorized Gopher Tortoise Agent. Once you click on a blue pin icon, the Authorized Agents name and contact information will be shown.
Let us know if you have any other questions.

Hi Kyle, This would be for FWC to answer, but in general if there are burrows within 25 feet of the proposed work area where heavy equipment will be used, a permit from the State for an authorized agent to relocate the tortoises is usually required. I’ve copied Marty and Andy for guidance in addition to Lisa.

All, I met with Wayne and his crew today. We walked the easement to see what would need to be cleared within the easement for us to gain access to maintain these valves. Wayne's crew has marked out more than enough for us to proceed.
Lisa, In regards to the turtles, what accommodations need to be made for us to proceed?
Thanks

Good Morning, Gopher tortoises are protected by State regulations. I’ve copied Lisa with FWC into the loop to help answer questions.
Lisa, I spoke with Teri this morning about a County project that involves large mowers to clear a County Right-of-Way in order to access underground utilities. Staff onsite observed a large amount of tortoises when placing survey flags. To proceed, would a consultant survey and potential permit for relocation be required to continue with the mowing/clearing effort by Utilities?

Kyle and Danny, There are a dozen or more active turtle burrows on the large parcel. You may not be able to mulch or mow. I am copying Allison Moran, Wildlife Specialist with Environmental, for guidance.
Thanks, Teri

Teri, Yes, please have the limits staked out. I would also like to have an updated survey map if possible.
Julian, Can you please let me know when you will be going out to place the stakes? I would like to go out with you so I get photos of them and their surrounding area.

Kyle, Sarasota County owns the parcel outlined in yellow per ORB 2867, Pg 2787. Do you need this property's North and East lines staked to ensure you do not clear on private property?
We can also stake the easement in blue over Lot 17/Harold Ave.
I will need an org. code to charge for the field work.

Hi Wayne, I am the new wastewater ARV and valve supervisor and I have two force mains that have been hemmed in with brush. I need to get the brush cleared so my crew can access the ARVs and valves on the lines and maintenance them. I was told by my manager Danny Young that I would need to get the easement surveyed first. Can you assist me with this or point me in the right direction? Attached are snipits of the area I need surveyed.
