About this file
This is an Invitation to Bid (ITB #24-AM-008) issued by Pinellas County Schools for fuel procurement, specifically gasoline and diesel fuel for various school district locations. The bid seeks suppliers to provide and deliver fuel on an as-needed basis, with pricing determined by a fixed differential above or below the daily Oil Price Information Service (OPIS) rack average Tampa Pad 1 terminal cost per gallon. The contract period will run from February 9, 2025, to February 8, 2026, with options to renew for two additional one-year periods. The bid follows a multistep competitive sealed process, including a technical proposal phase and a reverse auction price proposal phase. Unpriced technical proposals are due by 3:00 pm on November 27, 2024, with the live reverse auction scheduled for December 13, 2024, at 11:00 am.
The bid specifies four fuel types: regular unleaded gasoline (10% max ethanol), mid-range unleaded gasoline, ultra-low sulfur diesel, and dyed ultra-low sulfur diesel. Delivery will be to multiple Pinellas County Schools locations, including bus compounds and administrative facilities. The contract allows for price adjustments annually based on the Consumer Price Index, with specific guidelines for fuel cost and administrative overhead increases. Bidders must have a local presence at the Port of Tampa and provide written evidence of this. The district will award the bid jointly to the two lowest bidders for each fuel type and reserves the right to purchase from alternate suppliers if needed. Additional requirements include specific fuel specifications, emergency planning considerations, and strict regulations on fuel quality, delivery, and potential spillage.

CONTRACT PERIOD
The Contract Period shall commence on 2/9/25, and end 2/8/26. Prices and discounts shall remain firm for this period and shall include ALL freight and handling charges.
RENEWAL OPTION
By mutual consent of the School Board of Pinellas County, Florida, and the successful Bidders, this contract may be renewed for two (2) additional one (1)-year periods..
SUPPLEMENTAL UNILATERAL RENEWAL PERIODS
The District, through its Director of Purchasing, has the option and reserves the right to unilaterally extend the original contract term or any renewal term for up to three (3) additional thirty (30) day periods, at the same terms and conditions. Notice of the District’s intent to renew shall be provided by the District in writing to the Contractor Supplier prior to the expiration of the contract, or the renewal period if the contract has been previously renewed.
PRICE ESCALATION/DE-ESCALATION
The District will allow a price escalation/de-escalation provision within this award. The original bid prices shall remain firm for the first term of the agreement. A price escalation/de-escalation will be allowed at each renewal period, provided the Awardee notifies the District, in writing, of the pending price escalation/de-escalation a minimum of 60 days prior to the final day of the current term. The price https://www.pcsb.org/cms/lib/FL01903687/Centricity/Domain/187/General%20Terms%20and%20Conditions%2011%2012%2024.pdf https://www.pcsb.org/cms/lib/FL01903687/Centricity/Domain/187/General%20Terms%20and%20Conditions%2011%2012%2024.pdf

If, at the point of exercising the price escalation provision, market media indicators show that the
Consumer Price Index for All Urban Consumers (CPI-U) has decreased, and that the Awardee has not passed the decrease on to the District, the District reserves the right to place the Awardee in default, cancel the award, and remove the Awardee from the District’s Bidders List for a period of time deemed suitable by the District. In the event of this occurrence, the District further reserves the right to utilize any and/or all options as stated herein.
ADJUSTMENTS TO CONTRACT TERMS & CONDITIONS NECESSITATED BY
VOLATILITY OF THE MARKETPLACE
The District may, in its sole discretion, make an equitable adjustment in the contract terms and/or pricing if pricing or availability of supply are affected by extreme and unforeseen volatility in the marketplace, that is, by circumstances that satisfy all of the following criteria:
1. The volatility is due to causes wholly beyond the Supplier’s control
2. The volatility affects the marketplace or industry, not just the particular Supplier’s source of supply
3. The effect on pricing or availability of supply is substantial
4. The volatility so affects the Supplier that continued performance of the contract would result in substantial loss or financial hardship
The determination as to whether a situation represents “extreme” volatility of the marketplace and/or whether the effect on pricing or availability is “substantial” shall be solely at the discretion of the District.
Requests for adjustments will not be considered more than once in a one-year period. Adjustments and renewal escalation may not be exercised in the same term.
CONTRACT VALUE
For the purposes of calculating the amount of a protest bond, this contract is valued at approximately
$4,000,000.00, excluding renewal options. This is only an estimate and the actual amount could vary up or down. The District will not be held responsible if actual purchases are less than this amount.
BID CONTENT & SUBMITTAL
Each bid proposal shall include all information and submittals required or requested in this bid.
Incomplete bid proposals may be declared non-responsive.

AWARD
Each fuel type (Regular and Midrange Gasoline, #2 Ultra Low Sulfur Diesel, both dyed and un-dyed for on-road use) will be awarded separately to the responsible and responsive bidders offering the lowest fixed differential per gallon. To be eligible to bid, bidders must have a local presence at the Port of
Tampa for the delivery of such fuels to the school district and must provide written evidence of such along with your bid proposal. The district shall award this bid jointly to the two lowest bidders for each fuel type. If neither of the awarded suppliers is able to provide fuel when needed in the amounts requested, the district reserves the right to purchase fuel from an alternate supplier. In a competitive solicitation in which the lowest bid is submitted by a Supplier whose principal place of business is located outside the state, and that state does not grant a preference in competitive solicitation to Suppliers having a principal place of business in that state, the preference to the lowest responsible and responsive Bidders having a principal place of business in this state shall be 5 percent. See Section 287.084 (1)(a), F.S.
A Supplier whose principal place is outside this state must accompany any written bid, proposal or reply documents with a written opinion of an attorney at law licensed to practice law in that foreign state, as to the preferences, if any or none, granted by the law of that state to its own business entities whose principal places of business are in that foreign state in the letting of any or all public contracts. See
Section 287.084 (2), F.S.
In order for your bid to be considered responsive, please be sure to utilize the form titled “Bidder’s
Statement of Principal Place of Business” in its designated section within the Bid Proposal.
NOTE: IF YOU ARE A SUPPLIER WHO’S PRINCIPAL PLACE OF BUSINESS IS NOT IN THE
STATE OF FLORIDA, YOU MUST COMPLETE THIS FORM INCLUDING A SIGNATURE FROM
AN ATTORNEY ATTESTING TO THE STATE BIDDING PREFERENCE.

Since the Pinellas County School District has been designated as a “first responder” during a disaster, each bidder should include a policy statement with their bid submittal regarding fuel deliveries preceding an emergency such as a hurricane, and immediately following, provided that rack facilities remain operational. Transport delivery bidders should include a policy statement regarding the limited basis availability of transport trailers to be filled and left at protected County facilities to serve as emergency fuel supplies. The daily cost, if any, associated with this service should be included in your bid proposal submittal.
SPILLAGE:
Award vendor and delivery subcontractor shall bear responsibility and take all precautions to prevent spillage of the fuel products during delivery. Proper equipment maintenance, constant inspection, and where necessary, the use of collection pans during fuel transfer, will be employed to avoid leaks or spills.
In the event of a spill, award vendor will be responsible for immediate containment, mitigation of the effects of the spill and clean-up of the spilled product at no cost to the Pinellas County School District.
Should the award vendor fail to take immediate action, the Pinellas County School District may contract with a third party to accomplish the required control actions and will hold award vendor responsible for the incurred costs plus legal fees, attorney costs and court costs.
REMOVAL OF UNSATISFACTORY PRODUCTS:
All petroleum products shall be carefully loaded and protected during transportation and delivery. Any petroleum products, which before their final acceptance shall be found to be unsatisfactory, shall be removed and replaced by satisfactory petroleum products by and at the expense of the bidder.
TYPES OF FUELS REQUIRED:
Blended gasoline may not exceed 10% in its ethanol content. Octane rating may not be achieved by the adding of an octane booster additive of any sort subsequent to the refinery process.
The following fuels are to be bid and supplied as needed:
Item 1 - Regular Unleaded Gasoline/10% Maximum Ethanol Blend:
