About this file
This document is a Limited Source Justification authorizing the Bureau of Land Management (BLM) at the National Interagency Fire Center (NIFC) to negotiate with only one source, Forest Technology Systems LTD (FTS), for FTS weather repair parts and sensors used to maintain RAWS weather stations. The justification cites FAR 8.405-6(b) which allows for the purchase of items peculiar to one manufacturer. FTS is the sole manufacturer and provider of the replacement parts, which are exact matches for the existing RAWS equipment. No market research was conducted as FTS is the only authorized source. The total estimated value of this acquisition is less than $182,000. The BLM will not issue a Request for Quotation, but will place an order directly with FTS. Responsible firms believing they can provide comparable items must provide convincing evidence that their items can meet the requirements at a lower cost by 3pm MT/5pm ET on 08/22/2024. All responses will be fully considered, but if no affirmative responses are received, an order will be placed with FTS.

_____ FAR 8.405-6(a)(1)(i)(B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized
_____ FAR 8.405-6(a)(1)(i)(C) In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures
__XXX_ FAR 8.405-6(b) Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer. A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer.
5. The authority and supporting rationale (see 8.405-6(a)(1)(i) and (b)(1) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
The weather sensors are assembled and manufactured solely by Forest Technology Systems.
RAWS exclusively utilizes FTS sensors, allowing RAWS systems to be standardized for uniformity, ease of maintenance, and reliability.
The listed weather sensors have been tested and certified by FTS as replacement parts for their equipment. The sensors are exact replacements for FTS weather stations. The specifications must be exact with no substitutes.
6. A determination by the ordering activity contracting officer that the order represents the best value consistent with 8.404(d).
FTS holds a GSA contract and GSA catalog items and pricing are considered fair & reasonable.
Additionally, pricing of parts is consistent with previous orders within the last couple of years (not all parts have been ordered recently) with an expected markup due to market pricing.
7. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
No market research was conducted. FTS parts have been tested and certified by the manufacturer as the only authorized replacement parts for RAWS equipment. This allows for RAWS systems to be standardized for uniformity, ease of maintenance, safety, and reliability. FTS is the only vendor that can provide this product. GSA pricing via GSA contract GS-07F-9253S provides the best value to the government.
8. Any other facts supporting the justification.
None.
9. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
These items are manufactured or assembled by FTS specifically for use on their stations, therefore, must be purchased from FTS. This allows for RAWS systems to be standardized for uniformity, ease of maintenance, and reliability. It allows all agencies to be assured of proper sensor or equipment type to be delivered in a timely manner when ordered by RAWS customers.
FTS weather stations are the standard for current and future RAWS maintenance.
RAWS maintains nearly 2200 FTS Weather Stations strategically located nationwide. The cost of replacing all the stations would be prohibitive for allowing competition at this time. If there was a need to replace our current systems, this requirement would be competed.
10. The ordering activity Contracting Officer’s certification that the justification is accurate and complete to the best of the Contracting Officer’s knowledge and belief and evidence that the supporting data that form a basis for the justification have been certified as complete and accurate by technical/program personnel.
I certify that the facts and representations under my cognizance, which are included in this justification and which form a basis for this justification, are complete and accurate.
