FIELD PROCUREMENT OPERATIONS COORDINATION OF

FS-6300-0060 (REV.04/14/2021)
(NOTE – This document is intended to be used when program staff are asking procurement to issue a solicitation prior to funds. Completed and attach this form to the package submitted in IAS. When submitting, the requisition should be no-commit in IAS that upon receipt of funds, will be amended/modified to commit)

Funding Estimate:
This project is a priority for the region/forest and will be funded as soon as they are available.
4G32.703-4 Release of Solicitations in Advance of Funding Availability
1. It is preferable to issue solicitations based on fully funded, approved requisitions.
2. Contracting, program, and budget staff should work together under all circumstances to ensure funds are fully obligated to meet Forest Service objectives.
3. Under special circumstances, such as a Continuing Resolution (CR) it may be appropriate to issue solicitations prior to the receipt of a fully funded requisition which may be accomplished using a "no-commit" requisition.
4. Acquisition, Program, and Budget offices must jointly agree in writing to authorize the contracting office to issue solicitations in advance of funding. This should only be authorized when there is significant confidence that the contract will be funded as soon as funds are available.
5. When issuing solicitations in advance of available funds, the following statement must be included in any such solicitation:
"Notice to Offeror(s)/Supplier(s): Funds are not presently available for this effort. No award will be made under this solicitation until funds are available. The Government reserves the right to cancel this solicitation, either before or after the closing date. In the event the Government cancels this solicitation, the Government has no obligation to reimburse an offeror for any costs."
6. It is not appropriate to use the Availability of Funds clause, FAR 52.232-18, as prescribed in FAR 32.703-2(a), when funds are not available due to a CR. The Availability of Funds clause is specific to funds in the upcoming fiscal year. In other words, use of FAR 52.232-18 is based solely on availability of funds in the following fiscal year rather than the availability of funds later in the current fiscal year.
