About this file

This Addendum #1 document contains Franklin County's responses to 33 questions submitted by potential bidders regarding RFP #26-0526-1 for aerial and underground fiber optic cable infrastructure construction in Franklin County, New York, under the New York State Municipal Infrastructure Program Phase 1. The project encompasses 36.8 miles of aerial and 12.2 miles of underground fiber optic cable installation, with construction scheduled for completion by December 31, 2026. The work includes new strand installation with double lashing on existing poles, one new pole placement (30-foot class 5), direct boring and plow methods for underground work using traditional shielded loose tube fiber in 2-inch HDPE smoothbore conduit, and distributed split network architecture utilizing 1x8 and 1x4 MSTs with approximately 4,100 projected fuses. Bidders must account for unforeseen ground conditions, aerial make-ready work (0% completed), and all traffic control and inspection costs within their pricing. The County will provide all permits, fiber optic cable, and design drawings, while contractors must furnish all remaining materials, labor, and equipment, with payment issued upon completion, splicing, testing, and acceptance of each project segment.

The County has declined to waive the $10,000 per calendar day liquidated damages provision for delays beyond the December 31, 2026 deadline and rejected the request for bid submission deadline extension. Franklin County will supply the required bond form at the time of award rather than with the initial bid documents, and the surety must be authorized to do business in New York (the RFP contained a typo referencing New Jersey). No geotechnical reports or environmental permitting documentation are available from the County. Contractors must carry construction costs until project completion and area acceptance, with milestone or mobilization advance payments not available as an option. All contractors and subcontractors must submit insurance certificates including a $5,000,000 umbrella policy and Owner's Contractors Protective Insurance. The project is subject to New York State prevailing wage requirements and OSHA regulations, with no prior identical or substantially similar contracts awarded within the past five years and no set-asides designated for disadvantaged enterprises.

Franklin County - MIP 1 RFP# 26-0526-1 Addendum #1 Reponses to Questions 5/19/26

1.) Liquidated damages of $10000/day is an extremely punitive provision – can this be waved?

Response: No.

2.) Should pricing include all different ground conditions?

Response: Bidders should be prepared to encounter different ground conditions.

3.) What is the breakdown of aerial vs buried?

Response: 36.8 miles of aerial and 12.2 miles underground including coils.

4.) Can we get the total aerial footage and total Underground footage? Will the underground fiber be plow, drill or trenched fiber and what is the breakdown?

Response: See question # 3. Direct boring and plow are allowed on this project.

5.) For the underground work, will we be paid extra for rock, or does that need to be included in the price?

Response: Unforeseen ground conditions should be included in your bid.

6.) Are there any geotechnical reports available?

Response: No.

7.) Are designs, completed by others, ready to issue to construction?

Response: Design drawings are included in the RFP package.

8.) Has all required RoW permitting been submitted and approved by all relevant agencies?

Response: Permits have been received and are in process.

9.) Has all required environmental permitting been submitted and approved by responsible agencies?

Response: All applicable permits have been applied for.

10.) Is the aerial portion new strand, anchors and down guys to support the fiber installation or an over-lash operation?

Response: New strand (double lashing required), no over-lashing, new anchors and down guys.

11.) Is there any aerial make ready on existing poles and if so has that work been completed or should make ready (pole attachment alterations) be priced on this bid?

Response: Permits have been received and are in process.

12.) What % of make ready has been completed?

Response: 0%

13.) What is required for ‘as builts’ to be submitted back to the client?

Response: See “Scope of Work” in RFP. As-built drawings and field redlines.

14.) What type of network will be built, Distributed split or centralized split?

a. What split ratio will be used, 1x32 or 1x64?

Response: Distributed split 1x8 and 1x4, using MST’s.

15.) Is there a middle mile or feed component to this build, or just last mile distribution?

Response: Just last mile.

16.) Will this be a plug and play network at the terminal, or will the drop wires be hard fused inside the closure?

Response: MST’s will be utilized.

17.) Estimated splice points per home or mile?

Response: NA

18.) Underground fiber conduit and cable, micro or traditional?

Response: Traditional, underground fiber is shielded loose tube, conduit 2” HDPE smoothbore.

19.) Will the aerial network require new poles to be placed?

a. New strand on existing poles or over lash?

Response: 1 new pole needs to be placed.

20.) The Bid Bond section references a surety “authorized to do business in the State of New Jersey.” As this is a New York project, please confirm whether this is a template error and whether the Bid Bond must instead be issued by a surety authorized to do business in the State of New York.

Response: This is a typo, State of New York

21.) The RFP states that the Bid Bond must be submitted on Franklin County’s approved bond form or another form acceptable to the County; however, no bond form is included in the bid documents. Please confirm whether Franklin County has a specific bond form that must be used, or if a standard surety/AIA-style bond form is acceptable.

Response: Winning bidder(s) will be provided this information at the time of award.

22.) Given the number of questions being submitted, would the county consider extending the bid submission deadline in order to allow time to receive answers and compile a thorough bid?

Response: No.

23.) Pg 14 to top of 15 re: Drawings and Submittals - it reads that we as contractor would be submitting permits to the county within 10 days of contract. This makes the Dec 31 deadline is extremely tight. Please clarify the timing of this section and all other references to permits should be made clear that the County has prepared the permit drawings and is responsible for any revisions, time delays etc.

Response: Franklin County provides all permits.

24.) Pg 15 #7 says we would be responsible for all costs of police, inspectors, road flaggers, access fees and should include this in our pricing, but it’s unclear how much of this would be required to add into our pricing up front. See mobilization note below.

Response: Contractor is responsible for providing traffic control.

25.) Pg 17 section F Payment - this is saying we would not be paid until completion and approvals for each segment (assuming that is by each drawing area; Burke, Mohawk, Bombay, etc.). This means we would be carrying out all costs through construction.

Can we ask how long each segment is? If it’s 50 miles, that's a lot of cost to carry until its complete in 3 or 4 months. Our contracts generally include 10% up front for mobilization costs (locates, traffic control, equipment, crews, etc.), and then milestone payments through construction as civil, cable placement, and splicing/testing are completed. Is milestone payment an option? Or is contractor expected to carry 100% of the costs until project completion?

Response: Payments will be made after area is fully constructed, spliced tested and accepted.

26.) Is the Owners Contractors Protective Insurance a necessity? Is this policy in case the bidder uses a subcontractor or is it a policy on the bidder. If all other insurance requirements are met, including the $5,000,000 umbrella, this policy seems like a unnecessary duplication.

Response: All contractors and subcontractors must submit insurance certificates.

27.) Is all Power and Comms make ready complete in the CHTG 1 SA?

Response: No.

28.) Can you explain what "other" refers too, when its listed on the legend for the service area maps?

Response: Disregard.

29.) Will Ribbon fiber or loose tube fiber be utilized for this project?

Response: See question #18, loose tube.

30.) Approximately how many fuses are projected for the CHTG 1 SA?

Response: 4100±

31.) Is Franklin County providing the new poles to be set or will the contractor need to provide them?

Response: Contractor to provide the 1 required pole.

32.) If Poles are not being provided what size and class is required.

Response: 30ft class 5.

33.) In the CHTG 1 SA, the drawings mentioned MST service areas, yet there are no MSTs called out in the design. Will this area be feeding drops with tray mounted splitters directly out of the Apex-X2 enclosures?

Response: There are MST service areas, splitter downstream side will be spliced to MST.
