Q. Is environmental testing, drilling allowed before bid selection?
A. No testing or drilling is allowed before the bid selection. Once a selection is made the potential Exchange Partner will enter into a Letter Agreement (Template is provided in the NOA). The Letter Agreement will outline any additional testing or drilling that the potential EP is interested in doing. The language will outline what is required for clean up after the testing as well. The letter provides a due diligence period where the potential EP has time to back out without repercussions. A copy of any findings will also need to be provided to the Government upon completion.
Q. What is the Government responsible for when it comes to the Exchange Partner finding questionable environmental issues?
A. Environmental Condition of Property was completed for both properties and does not show any additional findings of concern. However, if something is found down the line the Government is responsible for remediation of anything covered by CERCLA. The Government is not responsible for any remediation when the zoning is changed to residential.
Q. Can additional soil testing be performed at Fort Sheridan?
A. During the due diligence period provided for by the Letter Agreement, it is possible for testing to be conducted. The reserves will need to approve testing at this site and a copy of the findings will need to be provided to the Government. The reserves may also put certain limitations on the testing, but that can be discussed once selection of the potential Exchange Partner has been made.
