SCOPE OF WORK

Program and Project Schedule Analysis

Replace Airport Traffic Control Tower, ATCT

Bipartisan Infrastructure Law

Des Moines, Washington

January 18, 2024

U.S. Department of Transportation Federal Aviation Administration

DRAFT

Bipartisan Infrastructure Law Projects

1. INTRODUCTION

1.1. The Federal Aviation Administration (FAA) intends to replace multiple low activity Airport Traffic Control Towers throughout FAA’s Western Service Area. These projects are funded through the Bipartisan Infrastructure Law. The Department of Transportation has established a goal of constructing 30 new ATCT’s by 2030. Multiple delivery methods are being explored: Design-Build under FAA’s Basic Order Agreement, Design-Build Open to all, and Design-Bid-Build.

The Western Service Area has seven ATCT’s identified in initial tranche or projects under the BIL Program. The first three projects are located in Pocatello Idaho, Ogden Utah, and El Monte California. These projects will be consolidated for a Design- Build contract to implement and staggered as NEPA, and the Real Estate processes are completed.

The implementation strategy has not been finalized for the four remaining sites.

As the remaining four sites are established, the scope defined for Pocatello Idaho, Ogden Utah, and El Monte California is required for the remaining sites.

The purpose of this contract is to provide program and project schedule support for the multiple BIL projects throughout the life of the project and individual projects, from contract award, construction, installation, and Commissioning.

1.2. The FAA will solicit proposals from design-build contractors. A critical component of the proposals will be a project schedule. The forensic scheduler is referred to as vendor in the scope of work. The vendor will complete a thorough review of the design build proposals and rank the overall quality of each prospective contractor’s proposal with emphasis on the schedule. The FAA will use the rankings as part of the design build contractor proposal evaluation process as approved by the FAA Contracting Officer (FAACO). The evaluation process will also be provided to the prospective design build contractors to maintain transparency as the contract award process unfolds.

1.3. Program Support consists of supporting FAA’s mission to replace or establish multiple BIL ATCT’s in the Western Service Area. The purpose of this effort is to provide FAA advance notice of actions required to maintain the goal of 30 by 2030. Examples of these items:

• Procurement Dates: Funding Availability, Solicitation, Advertise, Award

• Need by Dates: NEPA, Lease, Availability of Government Furnished Materials, Utility contracts.

• Resource Coordination: Electronic Equipment Installation start date

As work progresses on the Program, the FAA will utilize the Vendor’s quarterly reports and analysis to determine actions required to maintain the overall program schedule.

The analysis must contain recommendations to maintain the schedule. This could include staggering activities, or early start. The NEPA process and leasing activities must be monitored.

1.4. Project Support consist of typical contract monitoring and analysis for either a Design-

Build or Design-Bid-Build implementation methods.

After the contract is awarded, this contract will also include review of all schedules, and participation in weekly progress teleconferences, submitted by the design-build contractor or design-bid-build contractor including but not limited to:

• Analysis support for the selection of the best qualified DB Team for the BIL ATCT projects

• Monthly schedules submitted with the contractor’s pay application

• Three week look ahead schedules

• Any other project schedules or fragnets submitted during the course of the project

• Schedules submitted as part of Office of Dispute Resolution for Acquisition

(ODRA) or other dispute resolution processes including litigation.

The FAA will rely on deliverables supplied under this contract to manage expectations of all our project stakeholders and to ensure the general contractor meets their contractual obligations. The FAA intends to include liquidated damages on the design-build contract which will be assessed if the contractor does not meet their contractual completion date. Conversely, FAA is reserving the option to implement an award fee program to encourage collaboration and clear communication between all parties.

1.5. Electronic Equipment Installation Schedule: As each BIL ATCT reaches beneficial occupancy, FAA intends to begin equipment installation activities. The vendor will generate an installation schedule for each site in coordination with FAA’s Lead Electronic Engineer for each project.

2. GENERAL SCOPE

This contract will be awarded on a time and materials (T&M) basis. Base contract work includes review of the contractor proposals, a report detailing your findings, and a ranking in quality for each proposal. This effort is expected to occur during the construction contract solicitation phase of the program. The base contract also includes review and development of project schedules throughout the life of the project.

For bidding purposes, the vendor must assume design-build contract award for the initial project to be in the Summer 2024 and construction start in late Fall 2024. The contractor must assume design-build work is complete in 2026 for Pocatello, Idaho.

Work on possible ODRA or other dispute resolution proceedings must be proposed on a hourly rate for schedule analysis and litigation support. This will be a contract option that may/may not be required.

2.1. Program: Vendor must review FAA’s overall program for schedule and resource issues.

The reporting must provide trend analysis for late or delayed activities affecting individual project schedules. The program schedule will be utilized by FAA to determine resource allocation and deployment of FAA’s Equipment Installation Teams.

2.2. Deliverables under this contract include a report of findings for each design-build proposal. Vendor must review schedule logic, activity relationships, constraints, overall accuracy, accuracy of the critical path, and any other relevant properties of the design-build schedule proposal and include a quality ranking for each proposal.

2.3. Project: Vendor must review schedule logic, activity relationships, constraints, overall accuracy, accuracy of the critical path, and any other relevant properties of the design-build schedule proposal and include a quality ranking for each proposal.

Deliverables include a report of findings after review of the monthly schedule submission. Vendor must review the schedule submission, daily/weekly reports, payroll records and all other relevant documents to determine if the contractors schedule is accurate and achievable. Report must include documentation of activities in the schedule that are not accurate compared to onsite progress, shall highlight logic changes in the schedule, and document areas of future schedule risk. Vendor shall participate in weekly progress teleconferences for the life of the project.

Vendor must review all Requests for Equitable Adjustment documents and/or any Change proposals that include schedule impacts. Vendor must make a recommendation to the FAA on the validity of all request for time extensions and provide supporting documentation.

This work will include the in-depth review/analysis of the following items:

a. Construction schedules

b. Relevant contract drawings and specifications

c. FAA Weekly Reports

d. Owner’s Meeting Minutes

e. Requests for Information (RFI’s)

f. Submittals

g. Procurement Change Requests (PCR’s): PCRs are government initiated requests for contract changes, they are initiated by the government and submitted to the vendor for review/validation/pricing, may or may not result in a contract modification

h. Notification of Impact letters: Letters are initiated by the vendor as soon as practical after the vendor becomes aware of a potential impact, they are submitted to the FAA and followed up with a Change Estimate (CE) which includes details on cost and schedule impacts

i. Change Estimates: CE’s are issued by the vendor and given to the FAA for review/validation/pricing

j. Non-compliance reports (NCR’s)

k. Schedules produced by the construction contractor and received as part of owners meeting minutes, email, etc.

2.3.1 Project Sequencing: At the time of this writing, December 7, 2023, Pocatello Idaho, will be followed by Ogden UT and El Monte. The sequencing is dependent upon completion of the NEPA process and establishment of the land lease. Assume each project contract is 24 months overlapping for an overall duration of 42 – 48 months.

2.4 Electronic Equipment Installation: In coordination with FAA, the Vendor must develop an electronic equipment installation schedule by system for the project. FAA anticipates the equipment to be similar at each site. This schedule will be used by FAA to deploy resources and identify any potential delays in implementing Commissioning of the facility into the National Air Space. For planning purposes, this activity is estimated to be six months.

2.5 Contract Option ODRA and/or Litigation support

At the request of the FAA, the vendor shall review and analyze all claims submitted by the construction contractor. The purpose of the review/analysis is to determine the legitimacy of the claim based on the vendor’s accumulated project knowledge, past experience, as well as the information provided in the claim.
